Consideration of Board signature of document 2013-055, a Power Line Easement to Central Electric
Cooperative.

BACKGROUND AND POLICY IMPLICATIONS:
Deschutes County owns two 20-acre undeveloped lots off Bill Martin Road near Tumalo (map
attached). The property owner to the north, Jim Holt, is building a house and needs to bring power to
his site. There is an existing power pole on the south line of Taxlot 1201 owned by Deschutes County.
Central Electric Cooperative proposes to serve the Holt property using an above ground power line
from that existing pole across county-owned property.
Although Deschutes County has a policy not to grant easements to private property owners, granting
this easement will make it easier to serve the county-owned lots in the future. There is clear benefit to
Taxlots 1200 and 1201. There will be no cost to Deschutes County.
FISCAL IMPLICATIONS:
None.

POWER LINE EASEMENT
The undersigned, DESHUTES COUNTY, a political subdivision of the State of Oregon, Grantor hereby conveys to
CENTRAL ELECTRIC COOPERATIVE, INC., a Cooperative Corporation , Grantee, an easement on the following
described real property in Deschutes County, State of Oregon :
A 20 foot wide strip of land located in the Southeast Quarter (SE 1/4), of Section 25 , Township 16 South, Range II East,
Willamette Meridian , Deschutes County, Oregon . Said real property described as Parcel I & 2 of Partition Plat 20 II-II
recorded 11 /01 /2011 , in Deschutes County Official Records No. 2011-38710 . Said strip of land being more particularly
described in Exhibit "A " (Page 2 ofJ), and as depicted in the Exhibit "B" (Page 3 of3), attached and made a part hereof.
This easement is granted on the following terms and conditions:
I. SCOPE. This ea sement shall be of a width reasonably necessary for the installation , con struction , recon struction , maintenance and
operation of an electric tran smission or distribution line of one or more wires and all nece ss ary or desirable appurtenances (including ,
but not limited to tower s, poles , props , guys, guy stubs, anchors and other supports); and include s the right to place all or any part of
such lines underground and th e right to place guys and guy stubs and anchors outside of th e easement. Central Electric Cooperative
shall also have the right to permit other utilities such as telephone and T.V. cable to use the facilitie s installed in this easement. This
easement also giv es Central Electric Cooperative the right to go upon adjacent lands of the grantor for the purpose of constructing,
reconstructing, stringing new wires on, maintaining, inspecting and removing such lines and a ppurtenances. Central Electric
Cooperative has the right to clear the easement of brush, trees and structures; and th e right to top, trim , clear or cut away trees outside
of the easement which might endanger such lines.
2. LOCATION. The centerline of said easement shall be located as described and shown in Exhibit "A" and "B".
3. GRANTOR'S WARRANTIES. Grantor warrants that grantor has the right, title and ability to convey valid title to this easement.
4. GRANTOR'S RIGHTS. Grantor shall have the right to use the land subject to this easement so long as grantor's use does not
interfere with this ea sement ; provided that grantor shall not place any structure upon the easement without the prior written consent of
Central Electric Cooperative.
5. CONSIDERATION. The consideration for this transfer is for value other than monetary value.

A 20-Foot Wide Power Line Easement granted to Central Electric Cooperative
A 20-foot wide strip of land located in the South one-half of the Southeast one
quarter of Section 25, Township 16 South, Range 11 East, W.M., Deschutes County,
Oregon.
The centerline of said power line easement is described as follows:
Beginning at a point on the south line of Parcel 2 of Partition Plat 2011-11,
Deschutes County, Oregon, said point being North 89°58'548 West, 1604.72 feet
from the southeast corner of said Parcel 2; thence leaving said south line of
Parcel 2, North 30°20'178 East, 381.21 feet to a point on the south line of
Parcell of Partition Plat 2011-11, Deschutes County, Oregon, said point being
North 89°57'46" West, 1412.51 feet from the southeast corner of said Parcell;
thence leaving said south line of Parcel 1, North 13°28'33 R W, 339.35 feet to a
point on the north line of Parcel 1 of Partition plat 2011-11, Deschutes County
Oregon, said point being North 89°57'07# West, 1492.34 feet from the northeast
corner of said Parcell. The lengths of the exterior lines of this easement are
to be adjusted to terminate on the beginning and ending property lines they
intersect.
