No. BACKGROUND AND POLICY IMPLICATIONS: Every two years, the University of Oregon's Oregon Office for Community Dispute Resolution (OOCDR) makes funding available to eligible applicants through a publicly advertised application process coordinated by counties in partnership with OOCDR. To qualify for the program, each county must adopt a resolution stating its intent to participate and to engage in a selection process to award grant funds to a local service provider. Consistent with OOCDR guidelines, Deschutes, Jefferson, and Crook Counties may adopt a joint resolution indicating intent to participate or may opt out of the program allowing the Dean of the University of Oregon School of Law to assume the county role. Although Crook County's participation was solicited, its leadership has decided to opt out of the program this biennium. As a result, the resolution reflects Deschutes County and Jefferson County only as participants. Following adoption of the resolution, both counties will advertise the application process and select a grantee to perform mediation services within their boundaries. Additional information about the OOCDR program can be found in the attached letter from the OOCDR. FISCAL IMPLICATIONS: None. The OOCDR will enter into a grant agreement and disburse funds directly to the selected grantee. Lfi) p LC LEGAL COUNSEL For Recording Stamp Only BEFORE THE BOARDS OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON AND JEFFERSON COUNTY, OREGON A Resolution in the Matter of Participation in Funding Activities of the Oregon Office for Community Dispute Resolution * * RESOLUTION NO. 2013-019 * WHEREAS, the Deschutes County Board of Commissioners and the Jefferson County Board of Commissioners believe that the settlement of disputes by mediation may lead to more long-lasting and mutually satisfactory agreements; and WHEREAS, mediation may reduce the need for time-consuming and costly litigation; and WHEREAS, the Oregon Legislature has charged the State Board of Higher Education acting by and through the University of Oregon on behalf of the University of Oregon School of Law (Grantor) with the responsibility to foster the development of community mediation programs by making grant monies available to participating Counties; and WHEREAS, any County wishing to participate must formally notify Grantor of its intent to participate; now, therefore, BE IT RESOLVED BY THE BOARDS OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON AND JEFFERSON COUNTY, OREGON, that: Section 1: Deschutes County hereby notifies Grantor of its desire to participate in the expenditure of funds for community dispute resolution programs within Deschutes County and agrees to engage in a selection process and to select as funding recipients those entities both qualified by the standards and guidelines adopted by Grantor and capable of and willing to provide community dispute resolution services according to the rules adopted by Grantor. Section 2: Jefferson County hereby notifies Grantor of its desire to participate in the expenditure of funds for community dispute resolution programs within Jefferson County and agrees to engage in a selection process and to select as funding recipients those entities both qualified by the standards and guidelines adopted by Grantor and capable of and willing to provide community dispute resolution services according to the rules adopted by Grantor. Section 3: This resolution shall take effect upon its adoption by both Deschutes and Jefferson Counties. Assuming funding for 2013-2015 is reauthorized by the 2013 Legislature at the same level as the prior biennium, grant funds for your County will be approximately $36,422.00 for the period July 1, 2013 - June 30, 2015. The funding for these grants is currently derived from an appropriation from the general fund for "the purpose of providing dispute resolution services in counties" and will be allocated per Administrative Rules. Enclosed is a review of all the information necessary to proceed with the request for application process. The first step in the local selection process is the County's adoption of a resolution to participate. ORS 36.160 requires that a County notify the Oregon Office for Community Dispute Resolution (OOCDR) of its intent to participate in the selection process to award grant funds. A sample county resolution is provided in the enclosed RFA packet. Upon your County's adoption of the resolution, please send a copy to OOCDR. Following is the timeline for the 2013-2015 grant process: By March 15, 2013 March 29, 2013 County Commission adopts a resolution of desire to participate in the process. Legal ad published by the County to announce the application process (sample included). The County and OOCDR make RFA packets available to applicants. May 31, 2013 OOCDR issues notices of eligibility to applicants and County. June 7, 2013 Any appeals from applicants determined ineligible by OOCDR must be received by 5:00 pm. June 14, 2013 County Commission selects grantee(s) and notifies OOCDR of selection. June 28, 2013 OOCDR enters into Grant Agreement with the grantee(s). According to the Administrative Rules, each County Commission needs to designate a County dispute resolution program coordinator. OOCDR staff provides technical assistance and advice to this County staff person to make sure the process runs as smoothly as possible. If you have received this letter and are not the County's dispute resolution program coordinator, please forward these materials to the proper person. OOCDR encourages collaboration in all phases of the grantee selection process. In some Counties there will be only one interested and qualified applicant. However, if your County receives applications from more than one qualified applicant, we encourage you to have conversations with all applicants to determine whether there are ways for them to work together to best provide dispute resolution services in your County. You may elect to opt out of the selection process if you,desire. In that case, the Dean of the University of Oregon School of Law will assume the county's role in the process. If this is your choice, please provide OOCDR with a written notice to opt out by March 15, 2013. A sample Opt Out notification form is available upon request.
