PUBLIC HEARING ON THIS DATE? No. BACKGROUND AND POLICY IMPLICATIONS: Deschutes County Health Services, Public Health Division has prepared an Invitation To Bid (ITB) for the pharmaceuticals that the department needs to purchase. Public Health has enrolled in the 340B Prime Vendor Program, established by the Health Resources and Services Administration (HRSA) to increase the discounts already offered under the Section 340B of the U.S. Public Health Service Act. The program provides discounts on outpatient drug purchases to 340B covered entities such as public hospitals, community health centers, Title X grantees and other safety-net healthcare providers serving low income and uninsured patients. Public Health received one response to the ITB, which was from Smith Medical Partners. Smith Medical Partners offers the products at the 340B pricing and free shipping. Public Health obtained permission from the Board to order from Smith Medical Partners in the interim of accepting bids from other vendors for pharmaceutical products. Public Health requests the Board's approval to award the contract to Smith Medical Partners and continue ordering pharmaceuticals, as they are the best vendor for the products the department needs. FISCAL IMPLICATIONS: Contraceptive items priced at the HRSA 340B Program rates. Rates are set by the HRSA and change on a quarterly basis. RECOMMENDATION & ACTION REQUESTED: Board approval and signature of Document No. 2013-118, an Intent to Award Contract Letter. NOTICE OF INTENT TO AWARD CONTRACT In December 2012, Deschutes County, Oregon considered proposals for vendors who provide reproductive and public health clinic medications, contraceptives, devices and pregnancy tests, at or below the HRSA 340 B Pricing and Prime Vendor Program rates with the intent to award an agreement to one or more contractor(s) who can offer all or most of the aforementioned items. It was determined, after careful consideration, that the preferred vendor selected from the bidders who chose to reply to the Invitation to Bid (ITB) will be Smith Medical Partners. A copy of this Notice of Intent to Award Contract is being provided to the firm or individual that submitted a proposal for this service. See attached list. Any firm or person who believes that they are adversely affected or aggrieved by the intended award set forth in this Notice, may submit a written protest within five (5) calendar days after the issuance of this Notice of Intent to Award to the Board of County Commissioners of Deschutes County, Oregon, at the above address. The five (5) day protest period will expire at 5:00 p.m. on Monday, April 1, 2012. Any protest must be in writing and specify any grounds upon which the protest is based. If a protest is filed, a hearing will be held at 10:00am on April 3, 2013, before the Board of County Commissioners of Deschutes County, Oregon, acting as the Contract Review Board, at the Deschutes County Services Building, 1300 NW Wall St., Bend, Oregon, 97701. If no protest is filed within the protest period, this Notice of Intent to Award Contract becomes an Award of Contract without further action by the Board of County Commissioners, unless the Board, for good cause, rescinds this Notice before the expiration of the protest period. The successful bidder on a Deschutes County project is required to execute the Contract. In addition to the execution of Contract, the Contractor will be required to provide a certificate of Commercial General Liability insurance.
