NO BACKGROUND AND POLICY IMPLICATIONS: Jake Polvi approached the Road Department concerning the installation of a gate at the end of Peacock Lane by his property located at 22622 Peacock Lane. The reason for the gate is to allow lake to graze the southern portion of his property, reduce the noxious weeds in the general area and prevent illegal dumping in the area. Road Department staff visited the site and did not see any reasons why a gate could not be installed in this location. It meets the following criteria for gate installation: I. It is a dead end road 2. It is not a road that is generally used by the public. It is a dead end road used only by the residents living along it. 3. All parties affected by the gate have signed off on its installation 4. The gate will not restrict access to public land 5. Installation of the gate will help reduce noxious weeds and illegal dumping along this portion of the right-of-way. 6. Peacock Lane is not located within a recorded subdivision. Deschutes County does maintain a portion of Peacock Lane but the maintenance stops short of where the gate will be installed. See attached maps and photos for location of the proposed gate. Gate may be reviewed by the County at any time and upon a finding that the gate does not meet the criteria of the Gate Permit Resolution 90 081, the permit may be revoked by the Board of County Commissioners. 2. The design shall be approved by the County Engineer. 3. If the gate is locked, a key must be deposited with the fire district, Sheriff's office and with the Deschutes County Road Department with a map showing the gate location and telephone number of the applicant or contact person. 4. The gate location shall be as shown on the attached Exhibit "[]If. 5. , if required, must be to supplement gate. 6. No mail will be delivered inside , therefore, post office boxes or an approved mail box location outside shall be used. 7. Access for existing utilities and facilities in the area behind the must be maintained at all times. 8. If the applicant wants the road accessed by the gate to be included in the county maintenance system, the will be removed and the roadway brought up to a condition acceptable to the County Road Department prior to acceptance into the system. 9. Per Deschutes County Code 10.04.020, the gate is for the purpose of prohibiting motor vehicle traffic only. Pedestrian, bicycle and horse travel will still be permitted. You'll also find (1) a letter of support from the adjacent land owners; (2) Exhibit A -Tax Map, which shows the location of the gate; (3) Exhibit B -photos of existing conditions; (4) Exhibit C - a photo of an example gate to be installed; and (5) Exhibit D -aerial of gate location. Presently, the road is a dead end road that does not provide any benefit to the public. We are the last owners on the road. Mature juniper trees and woody debris, are blocking access to this section of road. This section of road ends at our West fence boundary because it was previously vacated to prevent access onto the airport property. We recently purchased the property and would like to install the gate, so we can graze the South portion of our property and reduce the noxious weeds in the general area. Additionally, the gate will prevent further illegal dumping in the area. Last week I picked up a truck load of garbage that was recently illegally dumped. In the attached photos you'll also see the road is currently blocked by mature junipers and woody debris. This impacted section of road has not been used in a very long time. We feel the installation of the gate will have public benefit by prevent further illegal dumping and help reduce the impacts on noxious weeds in the area.
