TITLE OF AGENDA ITEM:
Consideration of First and Second Reading by Title Only and Adoption of Ordinance No. 2013-008
Amending Deschutes County Code 18.04.030 and 18.113, to Change the Ratio of Overnight to
Residential Units in Destination Resorts and Declaring an Emergency and Establishing an Effective
Date of 30 Days from Adoption.

BACKGROUND AND POLICY IMPLICATIONS:
Pronghorn Intangibles LLC has applied for text amendments to the Deschutes County Code (DCC) to
change the ratio of required overnight lodging to residential units for Destination Resorts outside the
Bend Urban Area, case file Text Amendment (TA)-13-1. The Board held a public hearing on April 29,
2013 and Board verbally approved this proposal. The Board directed staff to draft the ordinance to
include an emergency clause with a 30-day delay in the ordinance effectiveness. The purpose would be
to have an effective date in line with the statutory effective date for ordinances adopted by cities.
An alternative version of the ordinance is also being provided in the event the Board decides not to
include the 30-day delay in effectiveness. When adopting the Title 19 amendments, the Board did not
include a 30-day delay. Because these Title 18 amendments are being adopted later into the
construction season, the Board may want to not include the 30-day delay in order to allow the applicant
to get started earlier on the construction of the overnight lodging units, which they cannot do until the
amendments are effective and they can then apply for CMP and FMP amendment approval based upon
the new code provisions.
FISCAL IMPLICATIONS: None.
RECOMMENDATION & ACTION REQUESTED:
Motion 1: Approval of first and second reading of the preferred version of Ordinance 2013-008 by title
only, then,
Motion 2: Adoption of Ordinance 2013-008.
