Consideration of Chair Signature of Document 2013-183, an Addendum To Real Estate Sale
Agreement between Deschutes County, Seller, and Biogreen Sustainable Energy Co., Buyer.

BACKGROUND AND POLICY IMPLICATIONS:
On June 29, 2009, the Board of County Commissioners (lithe Board") signed an Option Agreement (DC
2009-312) giving Biogreen Sustainable Energy Co. ("Biogreen") the exclusive option to purchase land
in the La Pine Industrial Site. Biogreen, based in St. Helens, Oregon, wishes to purchase 19.5 acres of
land to build and operate a biomass power facility. If Biogreen exercises its option, the purchase price
will be $1,200,000.
The Board has granted Biogreen's requests to extend the Option twice (DC 2011-330 and 2012-261).
Biogreen now requests an extension to June 1,2014 to enable them to obtain a viable power purchase
agreement.
FISCAL IMPLICATIONS:

Staff recommends Board authorization for Chair signature of Document 2013-183.
