BACKGROUND AND POLICY IMPLICATIONS:
The City of Bend and North Unit Irrigation District approached the Road Department concerning the
installation of a gate on McGrath Road just north of the entrance to the Water Reclamation Facility.
The City of Bend has the following reasons for the gate request:
1. They are in the process of upgrading their facility and want to keep the public out of the construction
area.
2. The gate will reduce the incidents of vandalism on their property located on either side of McGrath
Road
North Unit Irrigation District had the following reasons for the gate request:
1. Vandalism is a growing problem with their canal.
2. People are using their canal for recreational purposes exposing the District to liability issues.
In the past, there had been a berm in this location with reflective metal posts installed but the berm and
posts were removed when the irrigation district started work on lining their canal. When the berm was
removed, a metal gate was installed to allow construction traffic in and the chain on the gate was
repeatedly cut and the gate was also extensively damaged so it does not function anymore (see attached
photo). Road Department staff visited the site and did not see any reasons why a gate could not be
installed in this location. It meets the following criteria for gate installation:
1. It is a dead end road
2. It is not a road that is generally used by the public. It is a dead end road used only by the residents
living along it.
3. All parties affected by the gate have signed off on its installation
4. The gate will not restrict access to public land
5. Installation of the gate will help protect property owned by the City of Bend and North Unit
Irrigation District.
6. McGrath road is not located within a recorded subdivision.
Deschutes County does not maintain this portion of McGrath Road. See attached maps and photos for
location of the proposed gate.
FISCAL IMPLICATIONS:
None, the City of Bend and North Unit Irrigation District will be resonsible for installation and
maintenance of the gates.

Pursuant to ORS 368.056 the Board of County Commissioners of Deschutes
County, Oregon authorizes the City of Bend to maintain a gate upon the public
right of way described as:

CONDITIONS FOR APPROVAL
1. Gate permit may be reviewed by the County at any time and upon a finding that
the gate does not meet the criteria of the Gate Permit Resolution 90 081, the
permit may be revoked by the Board of County Commissioners.
2. The design shall be approved by the County Engineer.
3. If the is locked, a key must be deposited with the fire district, Sheriff's
office and with the Deschutes County Road Department with a map showing the gate
location and telephone number of the applicant or contact person.
4. The location shall be as shown on the attached Exhibit "B".
5. Fencing, if required, must be adequate to supplement gate.
6. No mail will be delivered inside gate, therefore, post office boxes or an
approved mail box location outside gate shall be used.
7. Access for existing utilities and irrigation facilities in the area behind the
gate must be maintained at all times.
8. If the applicant wants the road accessed by the gate to be included in the
county maintenance system, the gate will be removed and the roadway brought up
to a condition acceptable to the County Road Department prior to acceptance into
the
9. Per Deschutes County Code 10.04.020, the gate is for the purpose of prohibiting
motor vehicle traffic only. Pedestrian, bicycle and horse travel will still be
permitted.

Re: Letter of SUpport for McGrath Road Barricade/Gate
Dear County Commissioners,
North Unit Irrigation District submits this letter in support of a permanent traffic barricade or
traffic gate at the end of McGrath Road near the districts main canal.
In 2011112 the district performed construction operations at its main canal near the termination
point of McGrath Road at the main canal (see attached map). As part of the construction process
the district requested a temporary gate be installed at the termination point of McGrath Road in
the interest of public safety and to minimize Wlauthorized access to the location during the
construction process. Installation of a temporary gate was subsequently approved by City and
County officials. Upon completion of the main canal project the gate remained in place to
address ongoing trespass and vandalism issues in this area and as an attempt to minimize the
damage being caused by the public to the districts improved facilities.
Since that time it has been a constant battle keeping the public from entering the districts
property at the McGrath Road terminus. The district has replaced numerous cut chains and locks
at the McGrath location with the culmination of the problem being the gate having been rammed
and run down (see attached photos). The south side of the canal has locked gates to the east at
Pronghorn Club Drive and to the west at Hamehook Road making this location the only
uncontrolled access point. Local law enforcement has been called on several occasions but given
the rural nature ofthe location, law enforcement has little chance apprehending the culprits as
they are notified after an incident has occurred.
I understand that in the mid to late 1990's there was a permanent barricade and berm at this
location to keep the public from entering. The barricade and berm were removed as part of
another construction process and while the berm was pushed back up after construction was
completed the barricade was not replaced.
The district has made a significant investment improving its service roads and facilities in this
area as part of the main canal project. Unless a barricade or gate is approved for this location the
public will continue to gain unauthorized access to this location further jeopardizing the district's
facilities and public safety.
"Conserve Water -The Supply Is Limited"
I further understand the City of Bend is in the beginning stages of a Water Reclamation Facility
Expansion Project at this same location. A barricade or gate would be helpful to the city in its
efforts in controlling this area during and after its expansion construction project.

Dear County Commissioners,
The City of Bend Water Reclamation Faci'lity submits this letter in
support of a permanent barricade until such time that McGrath road is
extended or to facilitate maintenance activities for North Unit Irrigation
District and/or the City of Bend.
Restricting public access "mainly vehicle and ATV" beyond where t he
pavement ends would assist us in managing our resources and limit
staff time attending to fences, gates, vandalism and theft.
In the mid 1990's a substantial barricade was in place at the end of
McGrath road. At that time North Unit Irrigation District commissioned a
canal lining project to conserve water. The end of McGrath road was
utilized by a contractor as their staging area for this activity. Since that
time various gates and barricades have proved to challenging as we
attempt to secure our property and manage our assets.
The Water Reclamation Facility has recently begun a two and a half year
secondary expansion project. Our contractor will have access to our
property to mine for rock and fill to meet the needs of the expansion. We
believe public safety, our ability to manage Water Reclamation Facility
resources, and the safety of contractors would be improved with a
permanent barricade or an enhanced gate system.
