BACKGROUND AND POLICY IMPLICATIONS:
Mike Trammel contacted the Deschutes County Road Department concerning the installation of a gate
on Upas Avenue next to his property. The reason for the gate is the amount of vandalism and illegal
activity that occurs at the end of the road next to his property. It has gotten to the point where he does
not feel that his family is safe because of this activity. Due to the presence of a rock outcropping which
shields this portion ofBLM property from public view, this particular location adjacent to residential
property attracts significant dumping, shooting, motorized access, drinking and drug use as evidenced
by the presence of paraphernalia. This tract of BLM land adjacent to the Trammel residence is
designated non-motorized and non-shooting.
North Unit Irrigation District is supporting the gate request for the following reasons:
1. Vandalism is a growing problem with their canal.
2. People are using their canal for recreational purposes, exposing the District to liability issues.
This area has been designated as a non-motorized area by the Bureau of Land Management (BLM) and
we have been working with the BLM concerning the installation of this gate. They are in favor of the
gate but are working though some internal issues regarding the gate. The Road Department has decided
to proceed with the gate permit as it does not block access to the BLM land; its main purpose is to stop
the illegal activity which is occurring at the end of the road and the gate will protect the interests of the
property owner and North Unit Irrigation Canal.
Road Department staff visited the site and did not see any reasons why a gate could not be installed in
this location. It meets the following criteria for gate installation:
1. It is a dead end road
2. It is not a road that is generally used by the public. It is a dead end road used only by the residents
living along it.
3. All parties affected by the gate have signed off on its installation.
4. The gate will not restrict access to public land.
5. Installation of the gate will help protect property owned by Mike Trammel and North Unit Irrigation
District.
6. Upas Avenue is located in the Lake Park Estates Subdivision.
Furthermore, staff does not feel that installation of a gate will move problem activities to the other side
of the gate due to the fact that the screening from public view provided in the existing location will not
be present from the other side of the gate. This location is within full view of several residences as well
as the travelling public.
Deschutes County does not maintain Upas A venue. See attached map for location of the proposed gate.
FISCAL IMPLICATIONS:
None. Mike Trammel will be responsible for installation and maintenance of the gates.

The Road Department recommends signature of Document No. 2013-512, Gate Permit No. 13-003 for
Upas Avenue

Pursuant to ORS 368.056 the Board of County Commissioners of Deschutes
County, Oregon authorizes Mike Trammel to maintain a gate upon the public right
of way described as:
Upas Avenue located within Township 14 South, Range 13 East, Section 36
located in Deschutes County, Oregon.
in accordance with the conditions of approval (Exhibit "A") and in the location
shown on the map (Exhibit "B") attached hereto and by this reference made a part
hereof.

GATE PERMIT 13-003
CONDITIONS FOR APPROVAL
1. Gate permit may be reviewed by the County at any time and upon a finding that
the gate does not meet the criteria of the Gate Permit Resolution 90-0Bl, the
permit may be revoked by the Board of County Commissioners.
2. The gate design shall be approved by the County Engineer.
3. If the gate is locked, a key must be deposited with the fire district, Sheriff's
office and with the Deschutes County Road Department with a map showing the gate
location and telephone number of the applicant or contact person.
4. The gate location shall be as shown on the attached Exhibit "B".
5. Fencing, if required, must be adequate to supplement gate.
6. No mail will be delivered inside gate, therefore, post office boxes or an
approved mail box location outside gate shall be used.
7. Access for existing utilities and irrigation facilities in the area behind the
gate must be maintained at all times.
B. If the applicant wants the road accessed by the gate to be included in the
County maintenance system, the gate will be removed and the roadway brought up
to a condition acceptable to the County Road Department prior to acceptance into
the system.
9. Per Deschutes County Code 10.04.020, the gate is for the purpose of prohibiting
motor vehicle traffic only. Pedestrian, bicycle and horse travel will still be
permitted.

Re: Letter of Support for Upas Avenue Traffic Gate
Dear County Commissioners,
North Unit Irrigation District (NUID) submits this letter in support of a permanent traffic gate
at the end of Upas Avenue near the district's main canal.
The concerns expressed by Upas Avenue area residents are consistent with those ofNUID for the
area including the area between Upas Avenue south to the Ochoco Hwy (Hwy 126). This area is
a magnet for unauthorized uses, vandalism. trespass, dumping, shooting, drug use, tires and
general activities that are not conducive for the area or for the safety of the public. A recent
human caused fire in that area further lends support for the need to control unauthorized access.
In 2010/11 NUlD spent a considerable amount of time and resources repairing the district's
service road and canal banks in the Upas Avenue area that was a result of damage caused by the
general public gaining access from Upas Avenue and Deschutes CountylBLM properties. In
addition to the service road/canal bank repairs, NUID gated its service road access at Ochoco
Hwy (Hwy ]26) and O'Neil Hwy limiting pubJic access, which has helped, but is far from a
complete tix for the area. Today the road again continues to degrade based on unauthorized use
and unauthorized access through Upas Avenue and Deschutes CountylBLM properties.
The addition ora permanent gate on Upas Avenue will help to minimize those unauthorized and
illegal activities in that area. Furthermore, if the gate could block access to BLM property off of
Upas Avenue that would be an additional benetit to NUID, BLM and Deschutes County. NUiD
has met with BLM on several occasions regarding this matter. Like the rest of us BLM struggles
to find ways to control the undesirable activities of the public in this area.
