The County and you have an existing employment agreement dated September 1, 2008 , Document Number 2008-558. By letter, dated August 7 , 2013, you have provided 90 days advance written notice of your intention to retire. Therefore , effective November 5, 2013 you will retire from your salaried Legal Counsel position, the employment agreement will terminate and you will be eligible for PERS pension benefits. In accordance with county code and effective November 6 , 2013 you will be reinstated as a non­ benefited employee in the position of Legal Counsel. Your compensation will be the monthly amount you are currently being paid (Regular pay, Longevity, Deferred Compensation and Cell phone allowance) and the expectation is that your hours would vary depending upon the needs of the county and the office of legal counsel. You will no longer accrue Time Management Leave. You will receive no compensation or leave accrual on account of holidays. You will receive no county-paid health, life or long-term disability benefits , although you may elect to continue coverage at your own expense. You will receive no COLA. Except as provided in the immediately preceding paragraph , you will receive no deferred compensation or other county paid retirement contributions. Upon final separation from employment you would not be entitled to a severance payment, as the employment agreement referred to above is terminated. You will receive no compensation or mileage reimbursement, while traveling to and from your home. Provided, that if you are required to attend to County business away from county offices, you will be compensated for per diem and mileage expenses, pursuant to county policy. You will be expected to remain a member in good standing of the Oregon State Bar. You will be responsible for payment of required Bar dues and assessments. DC 2 0 13 · 6? 7 Enhancing the Lives of Citizens by Delivering Quality Services in a Cost-Effective Manner As a PERS retiree who is receiving a service retirement allowance, you may be employed by a participating employer, including Deschutes County, without loss of retirement benefits as long as the period or periods of employment by one or more participating public employers does not exceed 1,039 hours in a calendar year. The Personnel Rules and policies of Deschutes County apply to your position, except as otherwise specified in this letter. Upon acceptance your Employee Recognition Award account will be credited with 3600 points. This letter sets forth the entire agreement of the parties.
