Consideration of Signature of Order 2013-054, Rescinding Order No. 98-021 Which Established a
Designated Speed of 45 mph on a portion ofNW 74 th Street in Redmond and Substituting an ODOT
Designated Speed of 35 mph.

BACKGROUND AND POLICY IMPLICATIONS:
In 1998, the residents living along 74th S1. north of Eagle Crest (see attached map) approached the
County asking for a speed limit to be set on 74 th Street from Highway 126 to the end of pavement 465
feet north of Poplar Drive. Since this road was a low volume local road, it did not qualify for an ODOT
speed study, but the 1991 Oregon Revised Statutes allowed the local agencies to do their own speed
studies on "low volume or non-hard surfaced roads" and then the appropriate speed would be set by an
Order signed by the Board of County Commissioners.
The speed study was completed by the Traffic Engineer for the Deschutes County Road Department,
and a recommended speed of 45 mph was set by Order No. 98-021. In 2003, ORS 81 0.180(8)(a) was
revised to designate ODOT as the sole authority to designate speed zones on County Roads, effectively
removing the Counties' ability to set speed zones either on low volume or non-hard-surfaced County
Roads.
In June of 2013, the residents again approached the County requesting a new speed limit of 35 mph be
set on 74 th Street. The reason for the study was that most ofthe lots on the street were now built on and
there was more traffic with higher speeds. There had also been several instances of cars running off
several of the curves in the road onto private parcels. A request for a speed study was sent to ODOT
and the new traffic volumes allowed them to justify a new speed study. The result of their study
showed the establishment of a 35 mph zone was appropriate and this speed was also acceptable to the
Sheriffs Department.
Before this speed order can be put into effect, the original speed zone designated by Order No. 98-021
needs to be rescinded by an Order signed by the Board of County Commissioners. Signature of Order
No. 2013-054 will rescind Order No. 98-021 and will make ODOT's Order No. J8677 (see attached
order) the legal current speed zone order.
FISCAL IMPLICATIONS:
The County Road Department will be responsible for the installation and maintenance of the signs. We
are already responsible for the maintenance of the existing signs, so our maintenance costs will not
increase.
RECOMMENDATION & ACTION REQUESTED:
The Road Department recommends signature of Order No. 2013-054

WHEREAS, In 1998, pursuant to ORS 810.180(8)(a), the Board of County
Commissioners, as a road authority was delegated authority to designate reasonable and
safe speeds on low volume or non-hard-surfaced County roads; and
WHEREAS, The County exercised its authority to conduct a speed study on NW
74th Street according to the criteria adopted in 1998 by the Oregon Department of
Transportation (ODOT); and
WHEREAS, The results of the 1998 speed study indicated a recommended speed
of 45 mph for the section of 74th Street from Highway 20 to a point 465 feet north of Poplar
Drive; and
WHEREAS, The Board of County Commissioners established the speed of 45 mph
on 74th Street pursuant to Order No. 98-021; and
WHEREAS, In 2003, ORS 810.180(8)(a) was revised to designate ODOT as the
sole authority to designate speed zones on County Roads, effectively removing the
Counties' ability to set speed zones either on low volume or non-hard-surfaced County
Roads, and
WHEREAS, In response to a request by local residents living along 74th Street, a
new speed study was performed by ODOT with a recommendation of 35 mph for this
section of 74th Street from Highway 20 to a point 465 feet north of Poplar Drive (Speed
Zone Order No. J8677 dated 10108/2013); and
WHEREAS, Before ODOT's Speed Zone Order No. J8677 can go into effect, Order
No. 98-021 needs to be rescinded; now, therefore
THE BOARD OF COUNTY COMMISSIONERS FOR DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1 That Order No. 98-021 is hereby rescinded.

Thank you for your letter of 10/4/2013 concurring with the proposed
speed zoning on Cline Falls Hwy Connection #015AJ of McKenzie Hwy and
NW 74th Street from McKenzie Hwy (OR 126) to 450 feet north of Poplar
Drive (Request ID 7088). Enclosed is a copy of Speed Zone Order No.
J8677 dated 10/8/2013 establishing this speed zone.
Please provide us with a copy of the County's rescission of Deschutes
County Board of Commissioners Order 98-021 issued by on January 14,
1988 for our records. Then, please work with ODOT Region 4 staff and
advise us of the dates the signs are installed.
