Also present were Erik Kropp, Deputy County Administrator; Laurie Craghead, County Counsel; George Kolb, Road Department; Cynthia Smidt and Will Groves, Community Development; and approximately twenty other citizens. Chair Baney opened the meeting at 10:00 a.m. __________________________ 1. PLEDGE OF ALLEGIANCE 2. CITIZEN INPUT Molly Mount, program manager for FoundersPad, a group that helps with startups, gave a brief presentation and said they are trying to engineer a tech cluster in this area. She is also involved with Seven Peaks Funding, which provides funding for entrepreneurial companies. 3. Before the Board was Consideration of Chair Signature of Document No. 2014-051, the 2014 Fund Exchange Agreement with ODOT regarding Surface Transportation Program Funds for State Funds. George Kolb gave an overview of the item. The County exchanges federal funds for state funds, for a fee to the State, because this eliminates some requirements attached to federal funding. Will Groves provided an overview of this item. No appeal was filed after the Hearings Officer’s decision, so the Board has to consider this without a hearing or taking testimony. Before the Board was a Public Hearing on Document No. 2014-042, an Outdoor Mass Gathering Permit Application for the 4 Peaks Music Festival on a Tumalo Area Property (File No. OMG-13-1). Chair Baney opened the hearing and read the opening statement. In regard to conflicts of interest, ex parte contacts and biases, the Commissioners disclosed none. There was a work session held previously to discuss this issue. No challenges were offered from the audience. Cynthia Smidt provided a brief overview of the application and process . There was one written letter in support received last week. Deputy Chief O’Malley of Bend Fire Department also provided a letter. The maximum of 1,000 people to attend the event includes everyone: staff, vendors, visitors and others. Insurance has been found acceptable. County Environmental Health has approved after adding conditions. The Deputy Fire Chief has approved with conditions. There were concerns from the Sheriff’s Office regarding traffic and noise, and a revised plan was submitted and approved by Lt. McMasters of the Sheriff’s Office. There will be one crowd control person per 100 people, day and night. Traffic control individuals will be certified. The Sheriff’s Office will have direct contact with these people and will receive their information thirty days in advance. Minutes of Board of Commissioners’ Business Meeting Wednesday, February 12, 2014 Page 4 of 13 The applicant asked for a waiver of the ambulance being on site. They will have medical personnel and an AED on site, and they have not had to have an on-site ambulance previously. It is felt the proposal is adequate. Deputy Chief O’Malley submitted a letter since he cannot be here today. At the work session on January 29, the Board recommended the applicant look into contract ambulance services. The applicant may address this. The applicant has met the requirements of the application. Laurie Craghead said this is a gathering of fewer than 3,000 people for less than 240 hours. It is not a land use decision so therefore , by statute, is permitted outright if conditions are met. Steven Hultberg and Stacy Totland came before the Board. Mr. Hultberg stated that mass gatherings are different than traditional land use. Rather than have these subject to total local control, they are subject to local health and safety standards. They have recommendations and a sound decision from Deputy Chief O’Malley. There are two fire stations relatively close, and an AED on site. An ambulance sitting there the whole time means it is not avai lable to the public at large. Generally one ambulance is required for 10,000 people. The Les Swab Amphitheater holds up to 8,000 people and does not have an ambulance on site during events. There have been no medical emergencies at all at past events. Over 130 people have submitted comments, some have attended once or more, and it is considered family friendly. It is not a rock show. There have been no noise violations or tickets given. There have not been public health or transportation issues, and no real medical emergencies. The event has a solid track record , and the standards for public safety have been met. Stacie Toteland of 4 Peaks stated that the ambulance requirement was waived in previous years. She spoke with a representative CMT ambulance services and he is open to providing services as needed. There will be an AED on site. If an ambulance is parked on site, it takes away from its other services. Commissioner Unger asked about the medical personnel. Ms. Toteland said there is a first aid tent staffed with certified CMT’s. They will have a full medical kit. Ms. Totland said that the Oregon Detective Agency will provide security, with a ratio of 1 to 100 people. A couple of these personnel were armed last year per his company’s policies. There were four on site last year. Ten at any given time should be sufficient, and they will be there 24 hours a day, based on the number of people at different times. They can provide this information in advance to the Sheriff’s Office. Ms. Craghead noted that a condition would be added, to provide these names to the Sheriff’s Office thirty days in advance. Norm Pfaff provided a handout. He said he has lived in that area for 16 years. The south side of his property is on the north side of Tumalo Road. The festival is on the south side, so the properties are only divided by a two-lane country road. He has been in the area for nearly 40 years, and is a past member of the Greater Bend Rotary and a businessman. Six of the past 16 years he was Vice President or President of the Tumalo West Water District. He does not represent either of these entities at the time, but wants to show he is an involved citizen. He said his comments are factual. In 2007, 4 Peaks received an outdoor mass gathering permit for its music festival. He does not believe the adjacent property owner knew what was going on, and showed up for the 2008 festival. There was no festival in 2009, but in 2010 they received a basic event parade permit, for a gathering of less than 500 attendees, with no hearing required. This avoided the 2008 scrutiny. They subsequently applied for the same permit for the next three years. He said there were nine complaints from the 2007 festival and a number of other violations. In 2008, a letter was sent to neighboring properties. He referred to his letter and a list of the 28 property owners who were notified. On May 6, the Bulletin ran a story about this event. He researched all of the letters and learned there were seven responses from adjacent property owners; one in support and the others against. The permit was granted anyway. After the festival, Risk Management sent a letter on October 8. He loves music and concerts but there are appropriate venues for these events. This hearing would not be necessary if it was normally allowed. The rights of local property owners are being neglected. He cited several departments and agencies that require coordination. The approval is a checklist of things to be done in order to be approved. He wants them to look at common sense. Minutes of Board of Commissioners’ Business Meeting Wednesday, February 12, 2014 Page 6 of 13 One neighbor has submitted more than 50% of the complaints to the Sheriff’s Office. Maybe no ticket was issued, but there were a number of calls each year. This person purchased his own sound equipment to measure the decibel level. The Deputy agreed that the maximum had been exceeded. However, they are not going to go onto the stage and issue a citation. He knows from experience that most concerts never end on time. With overnight camping, the noise does not end. After the Saturday finale in 2011 the partying escalated until the Sheriff was called at 1:15 a.m., and another call was made ten minutes later regarding apparently drunken drivers with a spotlight pointed at his house. Nothing was done to cause them to do this. He yelled at them to leave but hoped he did not have to defend his property. The outcome could have been bad if they had not stopped. An officer went out and things died down. He said that all rural property owners are subject to strict land use laws. He wanted to know why this not the same for an LLC who can hire an attorney and get an application approved at the expense of taxpayers. This has been discussed in the same light as weddings. There are very different types of individuals involved in a music festival. He asked if the Commissioners have attended either weddings or the festival. He feels that the people are quite different. The event goers are camping out all night for three nights. If a burglar wanted to case a future victim’s home, the city might be easier in most cases. Sitting along a road in the country would be more noticeable. However, they could be at the festival drinking and smoking pot, and decide to come back and break into his home. He feels there are better locations for this festival in the area, such as the Sisters Rodeo grounds, the Fair & Expo or other locations. It should not be on farm land. If they truly want a grassroots festival, they could contract with a rancher with a lot more acreage, maybe in Millican away from most people. Adjacent property owners have attended hearings when possible and voiced concerns. The permits were granted. During the concert they phone complaint s to the Sheriff, but no one is listening. They still get to have these events. Society has the givers who give back and follow the rules; and the takers who want to bend or break the law at the expense of others. Minutes of Board of Commissioners’ Business Meeting Wednesday, February 12, 2014 Page 7 of 13 The Commissioners are the elected officials. It sounds like it is a done deal again. He feels the Board should step outside the box and support the taxpaying constituents and those who are having their rights abused. They need to be forced to find a new site. He knows what has taken place historically, but it continues to be approved. Patrick Hogan, 19496 Tumalo Reservoir Road, lives next door to Mr. Pfaff, and across the street from the festival. He has a completely different view, attends each year, and has seen one of the best productions in his life there. He has been involved in music for many years. The quality is second to none. There are no evil people, just lots of kids laughing and others having a good time. It is a beautiful site, changed and improved over the years, and each year there are all kinds of music. The people are not crazy and it is family friendly. He also worries about the evil in society, but if you attend the event, you do not feel the slightest evil there. He said Mr. Pfaff is worried about something that does not exist there. As he has seen them over the year evolve at the site, they have improved it. It is a benefit to the County because it is a beautiful site, with green fields in a nice community. Kristin Wills with her child Kai said she has organized the children’s area for the past two years plus this one. She has been an attendee at festivals for over ten years and knows this is a family thing. They love 4 Peaks and are glad they don’t have to travel out of the state for this event. It is great for her and her kids. Multiple parents thanked her for the organization last year for parents and families. It is a safe environment for kids and parents. The number of children is great, and there is a lot of fun for them. She is not sure who the bad people are that were mentioned. He hopes this is granted again. Howard Koff testified that he is Stacy Totland’s father. He had no expectations of speaking today and is not involved with the planning. He has observed his daughter doing this work and is very proud of her for founding this festival. He speaks as a dad, grandfather and is proud to take his granddaughter to this festival each year. He is part of the establishment and probably would not have known about this otherwise. He respects Mr. Pfaff’s views as well. He feels it is important to dispel some of the fallacious statements made and some of the myths. He has been involved in a couple of things; for instance, catering for 21,000 to 24,000 people a year. He was involved in the 1984 Olympics in southern California as well. Minutes of Board of Commissioners’ Business Meeting Wednesday, February 12, 2014 Page 8 of 13 His daughter did not fail to submit an OMG application to avoid a public hearing. She did not expand it previously due to the economics of the times. It had to be shrunk. Times have changed and she chose to expand this family event now. He said that Lisa and Gary Armstrong are providing their ranch at no cost so their family and friends can also participate. They are using common sense and historical patterns. He was at each one except one. He was at the first one and did not expect that at 10:00 p.m., they would cut the music. It does end at 10 p.m. He expects some complaints but hopes they can put those in perspective. He lived on the beach in Malibu and dealt with crowds. His home in Coachella Valley is near the concert venues there. He feels they should let people congregate and enjoy their music. He can’t speak about people in their cars and on the road. The nature of this group is peaceful. He has been to weddings that got out of hand more than this event. The caliber of people and their conduct, from what he has seen, is wonderful. He rents a motorhome and transports the bands from the airport. He has gotten to know these bands, which travel around the country. They are impressed by the event and the people. He is usually not a camper but he stays there for this event. He loves to associate with the people, parents, children and grandparents, who attend. There are givers and takers in the world. He and his wife are philanthropic and hopes his family members are all givers. This is Stacy’s passion and he hopes she can make some money this year. She gives to people and agencies. He felt an obligation to respond to what was said. With his background and experiences, and as part of the establishment, he feels this festival should be allowed. Mr. Hultberg then rebutted public testimony. He said that 4Peaks is not seeking special permission. It is an outright allowed use. Security will be provided along the road and precautions will be taken. Regarding noise, there are complaints for any event, anywhere. A ticket can be issued or it can be shut down. They are cautious about the noise ordinance. Ms. Totland stated that she works at Mosaic Medical, so does have a job. She does not think any of the Board members have been to the site. The main reason she wants a permit for a larger event is that it makes sense now. She urges everyone to join, the tickets are free, and bring the family. Minutes of Board of Commissioners’ Business Meeting Wednesday, February 12, 2014 Page 9 of 13 She has offered hotel rooms to the neighbors if they want to be away from home during the event. They have done all in their power to comply and to try to show the neighbors that it is family friendly and very benign. They also give back to the community, can employ more people and have more businesses join in. Part of the proceeds will also go to a local nonprofit. Ms. Craghead noted that the State established this statute to allow these events, and the County just added more requirements and conditions. Mr. Pfaff said he wanted to rebut. Ms. Craghead said the normal process is the applicant gets the last word unless it is relating to new information. Chair Baney clarified the information has to be new from the applicant or others. Mr. Pfaff stated that he did not attack Ms. Totland directly, and favors music festivals. Someone can check the details of the facts as submitted by him. He is not being misleading. It’s a good thing, but needs to be in a different venue. Chair Baney feels the neighbor part is important. The applicant chose not to respond further. Ms. Smidt said in 2007 there were a lot more negative comments than in 2008. The organizers have worked hard in the neighborhood and the complaints have reversed to more in support. There were no negative calls when the notification letters went out. The Sheriff knows what they have gotten in over the years, and the neighbors have become more supportive. If the Board waives the ambulance on site, they can add that the AED be on site in the first aid tent. They will verify security, environmental health components, fire protection, and the AED needs to be a condition. The security piece would be approved by Sheriff’s Office with names of the security personnel provided to them. They have noted concerns about noise, but there were no citations issued per the noise ordinance. In all, there were 31 conditions of approval. Ms. Craghead said that Risk Management has approved with the County listed as additional insured on the endorsement. They would have a first aid station with trained personnel and an AED, rather than an ambulance on site. Chair Baney closed the hearing and the Board deliberated. Minutes of Board of Commissioners’ Business Meeting Wednesday, February 12, 2014 Page 10 of 13 Commissioner Unger explained that almost all land outside urban areas is forest or EFU of some kind. This land is governed by State rules. With the residential nature of farmland, many areas don’t have dense housing like there is here. He is surprised there are not more conflicts. State statute is part of County code. If conditions are met, they can move forward. Regarding ambulance service, it seems that normal operations would be followed, either from Tumalo or another station as needed, if it is okay with the Fire Department. He is ready to approve this. Commissioner DeBone said he deduced the ambulance issue is being approached correctly. It is nice for people to visit a beautiful area and enjoy this type of event. The fact that it is family friendly is important. He does not see any reason to deny it. Chair Baney stated she feels the same. The conversation isn’t whether it should be on the property, but if the burden of proof is being met. She hopes they can retain neighborly relations and keep communications open. Commissioner Unger suggested that the Board review the outdoor mass gathering permit in the future to make sure it does not need further refinement. Alan: request the board review the OMG permit in the future and discuss further to make sure it does not need refinement. This is a de-novo hearing on an Outdoor Mass Gathering permit for the 4 Peaks Music Festival. County File Number is OMG-13-1 and Board Document Number 2014-042. B. In the application, the applicant is proposing to hold a music festival on June 20-22, 2014 on property located at 19449 Tumalo Reservoir Road. C. The Board takes notice of the record below and includes that record as part of the record before us. I II. BURDEN OF PROOF AND ApPLICABLE CRITERIA A. The applicants have the burden of proving that they are entitled to the proposal sought. B. The standards applicable to the application before us are the following: 1 1. As you are aware, the event organizers had secured Outdoor Mass Gathering (OMG) permits for music venues at the same location in 2007 and 2008. You indicated an OMG permit was denied to the organizers in 2009. However, our Community Development department has informed me they have no record of a denial. Rather, they did not receive an application for a permit that year. In 2010 Four Peaks Presents, LLC applied for an Event permit rather than an OMG permit because they reasonably expected fewer than 500 attendees. The tickets reportedly sold were well under 500, which meets the criterion for an EventIParade permit. The approval process for an Event permit requires that several County staff members review the application and supporting documents. Depending on the nature of the event, staff is usually looking carefully at traffic and crowd control plans, conflicts with road use, and food and sanitation sources. The 4-Peaks Jamboree application was reviewed by the following departments and staff: Sheriff's Office (one Lieutenant and one Field Law Enforcement Tech); Road Dept. (County Engineer and Operations Manager); Community Development Department (Senior Transportation Planner); Environmental Health (two EH Specialists and one supervisor). If there are any questions or concerns, those are addressed and resolved prior to the permit being approved by the Deputy County Administrator. For the purpose of this event, we also verified there were no pending code enforcement issues with the property. You expressed dissatisfaction with the lack of neighbor notification before the event. The organizers said they didn't think there were any homes located within a 750 ft. radius. If another event is proposed at this same location, we will ensure that the first 3-4 homeowners on Coyote Run Lane receive notification letters at least five days before the event. We will further suggest that as a good neighbor policy the notification area be expanded to include all neighbors who could potentially be impacted by the event. Deschutes County does not have any jurisdiction over fire issues, so if your area is serviced by a rural fire district, we recommend you talk to a representative in your district or to a City of Bend fire official. In closing, we recognize that not all venues are suited to everyone's tastes. However, we are committed to providing fair and impartial consideration to each and every event applicant. Due diligence was performed when reviewing the 4-Peaks Jamboree application and approving the permit. We understand your concerns about music venues in your neighborhood. Unfortunately, there are no quick and easy answers that will guarantee the satisfaction of all parties, other than to encourage the spirit of compromise and good-will. In the meantime, we will do our part to ensure that county code and laws are adhered to and enforced whenever necessary. Thank you for bringing your concerns to our attention. I'm Norm Pfaff, and have lived at 64420 Coyote Run Lane in the Tumalo area for nearly 16 years. The south side of my acreage is along the north side of Tumalo Reservoir Road, while the site of the 4-Peaks Music Festival, borders the south side of Tumalo Reservoir Road, so .... the properties are only divided by that 2-lane county road. I'm a couple of months short of being a resident of Deschutes County for the past 40 years, and for over 30 years I was a partial owner and principal in a local company that grew from two employees in 1974, to eleven employees when I left the company. I am a Past President, and Charter member, including 37 years of service with the Greater Bend Rotary Club. I have an inactive status at thf>time, but am still currently a member in good standing with the club. A few years ago I recall that we had surpassed $2,000,000 in donations and support for youth activities in Deschutes County. Also, six of the past 15 years, I have also been either the Vice President or President of the Tumalo West Water District - a local water company serving the needs of 21 property owners in the adjacent properties to the site of the Music Festival. I do NOT represent either of these organizations, but wanted to mention them to illustrate how I have been an active volunteer and participant in our Bend community. I believe ALL of my statements today are factual, and do not represent any exaggerations or heresay. In 2007, 4-Peaks received an OMG permit (Outdoor Mass Gathering) for their music festival which was for up to 1000+ attendees, which required a public hearing similar to this one today. I don't believe many ofthe adjacent homeowners had any idea what was really going on, but we did show up in force when the process was repeated for the 2008 Music Festival, which became quite controversial. There was NO festival in 2009, and then in 2010, two days before the one-day festival planned for that year, they received a "basic Event/Parade permit" for a gathering of less than 500 attendees, and to which this type of permit did NOT require a public hearing, and was able to avoid the scrutiny and criticism that occurred at the 2008 public hearing. They have subsequently pursued this permit in 2011, 2012 and 2013 so they can continue to avoid the public hearing. At this time I would like to submit documents for the commissioners reference while I make additional comments regarding this OMG Permit request, which for 2014 is now for up to 3000 attendees. In April of 2008, Deschutes County sent a letter to the 28 owners of adjacent or neighboring properties of the site of the 4-Peaks Music Festival, which was a notice of that public hearing. I have endosed that notice, in addition to the April 22nd letter that my wife, Jodi, and I sent to the County. You will also find a copy of the 28 property owners that the County gave me, with names/addresses. On May 6th, the Bulletin reported on the public hearin& and stated the County had reCeiVed 120 letters regarding the music festival, with about 80 in support -many from outside the area and even out of state, while about 40 were opposed to the festival. I personally went to the County and researched AlL of those letters, and learned that 7 responses of the 120, weffi>m the list of 28 adjacent property owners, with ONE in support, and SIX opposed to the festival. Obviously, the permit was granted. After the music festival in August that year, I met with Judy Summers, Claims Coordinator for the Risk Management Department of Deschutes County. I have enclosed her 2-page letter dated October 8, 2008, that summarized our meeting and the approval process of the OMG permit. This topic has obviously been a "lightening rod"! Don't get me wrong - I love music, concerts . and various festivals, but there are appropriate venues for these events. And ...... ifffff th is music festival fit into all ofthe normal rules and regulations set by the County, this public hearing would NOT even be necessary, but .......it doesn't fit in to what is normally allowed 11m So why are we making an exception for 4-Peaks Music Festival, with the rights of local property owners being neglected? In order for this request to be granted, there are many steps that are required, including this public hearing, the traffic and crowd control issue, any conflicts with road use, food and sanitation sources, coordination with the Sheriffs Office, County Road Dept, County Environmental Health Dept, the Community Development Dept, as well as the rural Fire District. The application itself, includes verbage regarding starting and ending times of the live music, and maximum allowable sound decibels, etc.. And the approval is like going down a "check list" of things before the permit is granted. Looks pretty straight forward, but ....... can we get down to some "common sense", and can we address some historical patterns regarding th is music festival ? #1) One neighbor that I will not identify by name, has probably submitted more than 50% of the complaints phoned to the Sheriffs office, and I know for a fact, that he purchased some sound equipment to measure the decibels levels, and has complained to the Sheriffs office for violations, and when the Sheriffs patrolman came out, he took out his equipment to also perform a measurement, and agreed that the maximum level was being exceeded. All well and good, and noted, but ..... what can really be done 1 ESPECIALLY if you continue to grant permits the following year. #2) We also know from experience, that most music concerts and festivals never end on time, so maybe you are 15 or 20 minutes with Nan encore", which is really fine and well, but ..... with a festival like this one, with overnight camping, does that really end the "NOISE" 111 !!! I'm here to tell you that after the Saturday night finale in 2011, that the partying did not die down­ it escalated to where we finally telephoned the Sheriffs office on Sunday morning, July 17th, at 1:15 am, complaining that the people were playing their Nboom boxes" at the highest possible volume, and were yelling and screaming and singing. It was not more than 10 minutes later, that we telephoned the Sheriffs office again, this time complaining, that these drunken people were out on Tumalo Reservoir Road in a pickup, driving less than 5 mph and sometimes completely stopping in the road, with a spot light pointed at our property, .....• and house, and two individuals had crossed the road, and were on my property with flash lights, and with a number of others ready to follow across the road. I yelled at the top of my lungs, on three occasions, for them to get off my property, before they realized I was standing on my deck yelling at them. In that situation, what was I to do if they became unruly and chose to challenge me? Did I have the right to defend my property -if they reached as far as my deck, could I have used my gun to try to persuade them to discontinue their aggressiveness 10K, I know you will not, and can not, speak about legal matters involving law enforcement and the district attorneys office, but ...... by granting this permit, thLi County is creating a situation where this incident can occur, with a much differe~'rfdfng, than with them agreeing to leave my property. Deputy Peetze with the Sheriffs office did phone us back at 2:30 am to report that a patrolman went back out to check the situation, and we had noticed that everything quieted down shortly after our confrontation at 1:30 or so that morning. #3) All rural property owners are subject to very strict land use laws, yet how ~n it be that our rights are in essence neglected, because an llC (limited liability corporation) that has no assets and has no individuals being held accountable, can hire an attorney, throw money around and get something like this OMG permit approved ?111 I know that many have combined their discussion of a music festival like 4-Peaks, with different wedding venues in their requests for OMG permits with the County, however ...... please do not mistake that we are talking about two very different utypes of individuals". Have any of you three commissioners been to the 4-Peaks Music Festival, or camped out there to personally view the caliber of people in attendance? How about one of the wedding venues? I'm pretty sure, that if any of the three of you have a da ughter that is getting rna rried, you a re more likely to be able to select 6()OA,-70% of the types of people at on"e of the wedding venues for your daughters wedding ceremony, while maybe only 10%-20% of those attending the camping and music festival at 4-Peaks would be included in that list of invitees! That of course, is just my opinion, and not subject to my previous statement about FACTS being disclosed in my discussion. One final thought regarding the character of individuals attending the 4-Peaks Festival: if a burglar wanted to "case" a future victims home, it would seem much easier in the city where there is so much more congestion, while if someone was sitting in their car, along the side of Tumalo Reservoir Road, they are going to attract much more attention. What a much easier means of casing a future target home, by going to a 3-day overnight camping and music festival, to sit around drinking beer, smoking pot, etc., and looking over at my house, and saying to themselves: " some day, I'll remember to come back out to this future target !" I'm really not trying to be dramatic about all of this, but simply put ...... aren't there much better sites for an overnight camping and music festival, than right here in our farm land area? What about the Les Schwab Amphitheatre, or the stage area in Drake Park at Mirror Pond, or the Deschutes County Expo & Fair with room for overnight camping. The Sisters Rodeo grounds would be another great selection. Why ..... do we, the adjacent property owners, have to be subjected to this debacle ????
