TITLE OF AGENDA ITEM:
Consideration of first and second readings by title only and adoption by emergency of Ordinance No.
2014-005, an ordinance amending the City of Bend's Urban Growth Boundary (UGB) to include a 33
acre property.

BACKGROUND AND POLICY IMPLICATIONS:
The Bend La Pine School District applied for a comprehensive plan map amendment to include
approximately 33 acres near the interesection of Skyliners Road and Skyline Ranch Road within the
City of Bend's UGB (See: County file no. PA-13-4). The Deschutes County Hearings Officer held a
public hearing on December 19, 2013 and rendered a decision approving the amendment on January 9,
2014. That decision is now final. Pursuant to DCC 22.28.030(B), the Hearings Officer has the
authority to make the decision and, since no appeal has been filed, the Board shall adopt the Hearings
Officer's decision without additional argument or testimony before the Board.
FISCAL IMPLICATIONS:
None.
RECOMMENDATION & ACTION REQUESTED:
Motion 1: Move first and second reading by title only of Ordinance 2014-005.
Motion 2: Move adoption of Ordinance 2014-005 by Emergency.

RE: Ordinance Adoption (2014-005) for Plan Amendment expanding the City of Bend
Urban Growth Boundary for new middle school
Summary
On January 9,2014. the Hearings Officer approved a request for a Plan Amendment for the
subject property to incorporate it within the City of Bend Urban Growth Boundary (UGB) to
accommodate a planned middle school. No opposition to the proposal was entered into the
record.
In 2010 the district completed a new School Facility Plan. The purpose of the 2010 plan was to
identify and plan for future facility needs. In 2012 the district completed an update to the 2010 plan
to reflect changing needs based on more current data. The 2012 update identifies the need for a
new middle school in the northwest part of Bend.
The district conducted a search for sites within the UGB that would be adequate for the new middle
school but did not locate any suitable sites. Thereafter the district searched for a suitable middle
school site outside the UGB. Through that search the district identified the subject property located t adjacent to Miller Elementary and Summit High Schools.
I Because no appeal was filed. pursuant to DCC 22.28.030(B), the Board must approve the zone
change and plan amendment without further argument or testimony.
I On February 19, 20M. the Bend City Council completed the second reading and approval of the
ordinance for the plan amendment and annexation agreement to incorporate the subject property I in the UGB and city limits.

Scheduling
This item is scheduled for the Board's morning meeting on February 26.2014. Copies of the
Ordinances and all exhibits are attached for your benefit. The applicant has requested that the
ordinances be adopted by emergency to meet the goal of opening the school in the fall of 2015.
Representatives of the school district will be attending the work session on February 24.2014 to
provide further information regarding this proposal and the request for adoption by emergency.
