PUBLIC HEARING ON THIS DATE? NO BACKGROUND AND POLICY IMPLICATIONS: The Road Department was approached by Luis Elenes, owner of tax lot 141314 DOOO 1 00, concerning the vacation of the portion of the 1909 Lower Bridge Road (aka Lambert Road) that is located on his property. This right-of-way bisects his property and he would like it vacated to better utilize his land, as the right-of-way could affect set-backs for future structures on his property. Base on the property having frontage on NE 43 rd Street, Smith Rock Way and Wilcox Avenue, the Road Department determined that there is no future need for this right-of-way for road purposes. Since the right-of-way proposed to be vacated is entirely on the Elenes property, this is a 100% vacation and no public hearing is required. Signature of Resolution No. 2014-041 initiates the vacation process FISCAL IMPLICATIONS: None. WHEREAS, the owner of the land abutting the proposed right-of-way to be vacated, petitioned for vacation of a public road known as all of the Portion of Lower Bridge Road (aka Lambert Road) as shown on Partition Plat 2009-01 located in Deschutes County, Oregon; and WHEREAS, the Board of County Commissioners has determined it to be in the public interest to consider such vacation; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That it is the intent of the Board of County Commissioners of Deschutes County, Oregon, to vacate all the Portion of Lower Bridge Road (aka Lambert Road) as shown on Partition Plat 2009-01, described in Exhibit "A", attached hereto and by this reference incorporated herein, because it appears the road is no longer needed for public use, and will not be needed in the future. Section 2. That the County Road Official shall file a Report with the Board of Commissioners, describing the ownership and uses of property to be vacated, and whether the vacation would be in the public interest, within fourteen (14) days of the date of this Resolution.
