PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: The J Bar J Boys Ranch, Inc. originally leased the subject property from Deschutes County beginning in August 1971 for a period of 10 years. J Bar J Boys Ranch, Inc., acting on a purchase option included in the lease agreement, bought the property in April 1980. In March 1983, J-Bar J Properties (the entity to which the property was transferred by J Bar J Boys Ranch, Inc.) amended their operating by-laws to include a reversionary clause to Deschutes County. The clause generally states that if the property ceases operations as originally intended in their operating by-laws, ownership reverts to Deschutes County. The reversionary clause was formally accepted by Deschutes County on March 23, 1983. The J Bar J Boys Youth Services have continuously operated at the site for over 40 years, with over 30 years of ownership under the reversionary clause. Through this continual ownership and operation, the conveyance has met the original intent and the minimum statutory reversionary requirement of 20 years. FISCAL IMPLICATIONS: There is no consideration for this release of interest. RECOMMENDATION & ACTION REQUESTED: Staff recommends signature of Document 2014-207. Box 6005 Bend, OR 97701 Bend, OR 9770U005 QUITCLAIM DEED I KNOW ALL MEN BY THESE PRESENTS, that DESCHUTES COUNTY, a political subdivision of the State of Oregon, hereinafter called Grantor, does hereby remise, release and quitclaim to J Bar J Properties, a non-profit Oregon I corporation, hereinafter called Grantee, and unto Grantee's heirs, successors and assigns, all right, title and interest in that certain real property including the reservation for use described in the Acceptance of By-law Amendment, approved by the Deschutes County Board of Commissioners on March 23, 1983, and recorded on March 30, 1983, as document number 9-134 of the Deschutes County Official Records on the following described real property in Deschutes County, Oregon, Southeast one-quarter of Southeast one-quarter (SE1I4SEII4) of Section Twenty-three (23), Township Seventeen (17), Range Twelve (12) East of the Willamette Meridian, Deschutes County Oregon .. This instrument will not allow use of the property described in this instrument in violation of applicable land use laws and regulations. Before signing or accepting this instrument, the person acquiring fee title to the property should check with the appropriate city or county planning department to verify approved uses and to determine any limits on lawsuits against farming or forest practices as defined in ORS 30.930. The true and actual consideration for this conveyance is zero dollars. Relinquishment of this reversionary interest is authorized pursuant to ORS 271.335. DATED this 23 day of April, 2014.
