Consideration of Board signature of Document 2014-264, a Bargain and Sale Deed of3.23 acres to
Midstate Electric Cooperative, Inc.

BACKGROUND AND POLICY IMPLICATIONS:
In April, 2014, as a result of the La Pine Land Conveyance Act of2012, the United States of America,
through the Bureau of Land Management (BLM,) conveyed a 150 acre tract of land along the western
boundary of the City of La Pine to Deschutes County. As was acknowledged in the Act, the tract
contained an electric power substation and associated right-of-way (a 3.23 acre substation parcel and
approximately 2.25 acres of right of way) not to be used for outdoor recreation, open space, or public
parks, including a rodeo ground as was the intent of the remaining 144.5 acres of the tract. The 3.23
acres where the electric power substation is located is a separate and previously created legal lot that
was included in the collective land conveyance from the BLM. Pursuant to the La Pine Land
Conveyance Act of2012 and the acknowledged historic use of the property as described therein,
Deschutes County is conveying the 3.23 acre parcel to Midstate Electric Cooperative for the continued
use for such purposes. Pursuant to the provisions of ORS 275.225, Deschutes County is authorized to
privately sell a parcel when it has a real market value less than $15,000 and is unsuitable for a dwelling.
The subject property has an assessed and real market value of$4,130 and is developed with an electric
power substation which makes it unsuitable for a dwelling and only attractive for continuing the
existing use. On this basis, the property is being privately sold to Midstate Electric Cooperative, Inc.
FISCAL IMPLICATIONS:
No on-going implications. Deschutes County will convey the property to Midstate Electric
Cooperative, Inc. for one dollar ($1.00).

LEGAL DESCRIPTION
A parcel of land containing 3.23 acres, more or less, located in the Southeast One~Quarter of the
Northwest One-Quarter (SE 114 NWl/4) of Section 15, Township 22 South, Range 10 East,
Willamette Meridian, Deschutes County, Oregon, being more particularly described as follows:
Commencing at a 2" brass cap at the Center-Quarter corner of said Section 15; thence North
14°56'30" West a distance of 111.41 feet to a 3-1/2" aluminum cap at the intersection of the west
right of way of Pengra Street and the north right of way line of Sixth Street, the True Point of
Beginning; thence North 00°40'45" East along said west right of way line, a distance of 450.00
feet (N 00°14'30" E, 450 feet) to a 3-112" aluminum cap; thence North 89°59'30" West a
distance of 300.00 feet (S 89°34'07" W, 300 feet) to a 3-1/2" aluminum cap; thence South
00°40'45" West a distance of 491.97 feet (S 00°14'30" W, 495 feet) 10 a 3-1/2" aluminum cap at
said north right of way line; thence along said north right of way line the following two (2)
curves:
121.91 feet along the arc of a 1170.00 foot radius curve to the left, the long chord of which bears
North 81 °29'57" East a distance of 121.85 feet;
181.73 feet along the arc of a 1230.00 foot radius curve to the right, the long chord of which
bears North 82°26'02" East a distance of 181.57 feet (Eastward a scaled distance of 305 feet) to
the True Point of Beginning, and terminus ofthis description.
