DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, JUNE 30, 2014
Commissioners' Hearing Room -Administration Building -1300 NW Wall St., Bend
Present were Commissioners Tammy Baney, Anthony DeBone and Alan Unger.
Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy
County Administrator; David Doyle, John Laherty and Laurie Craghead, County
Counsel; and two other citizens.
Chair Baney opened the meeting at 10:30 a.m.

2. CITIZEN INPUT
Citizen William Kuhn spoke about the LUTS system and difficulty he is having
with it. He liked it the way it was previously, for business purposes. There is a
transition period going on at this time. He submitted a ten-page document in
this regard. He finds this frustrating.
Tom Anderson stated that CDD is changing its whole system to Acela, which
will be statewide. The old system was a legacy system and is obsolete. The
goal is to get there and it will be customized as appropriate.

Mr. Kuhn said that Deschutes County has in the past been considered a leader
in this. He is disappointed with the tone of correspondence with his attorney on
the Dowell issue.
3. Before the Board was Consideration of First and Second Readings by Title
Only, and Adoption by Emergency of Ordinance No. 2014-019, Pertaining
to the Release of a Dog Found to Have Harmed Domesticated Fowl.
John Laherty explained that this is a housekeeping matter and relates to a 2012
ordinance. A provision for injuring but not killing domesticated fowl was
inconsistent in Code. The title did not include the emergency clause so he
asked that this be amended as appropriate.
The Board asked if the titles should be the same in the two sections. Mr.
Laherty said the titles are instructional only. The Board supported the
emergency clause.

18. ADDITIONS TO THE AGENDA
Before the Board was Consideration of Board Signature of Order No.
2014-018, Extending the Deadline for Submittal of Written Arguments in
the On-the-Record Review of an Appeal Filed by the Flight Shop and Aero
Facilities.
Laurie Craghead stated that the appellant did not provide the necessary
transcript in a timely manner, and there was a request from the applicant to
dismiss the case. She interprets there is an affirmative duty of the appellant to
ask for this, and there are jurisdictional defects.

To remedy the situation, the Board can reopen the deadlines to get arguments
from both parties. Or, the Board can keep the record closed. The applicant
would like this dismissed, but did want the Board to hear it so there would be
deference at the State level.
Chair Baney feels that the Board should allow this to come in and be reviewed.
She supports reopening to allow for this. Commissioner Unger wants to
achieve the best decision and developing the record fully, especially since this
is local. Dave Doyle said giving due process is important.

Good Morning William,
The Deschutes County Community Development Department has converted to a new, hosted land use
permitting software effective May 25, 2014. Due to our conversion to new permitting software, the
custom applications that were developed for our previous permit system can no longer be updated (i.e.
-Pending Land Use Applications). We are currently in the process of rebuilding the tables that retain
our land use permit data. Once those tables are rebuilt, we plan to generate a new application for our
public web site that will make querying and viewing land use and building permit data much easier than
before.
We do not have an exact timeline for the completion of this process due to the complexity of the
project, but are hoping that the application will be available this summer.

You can now search for Deschutes County's building permits online via the State of Oregon's e
Permitting web site.
http://www.oregon-epermitting.info/
Once you get to this site, click on "Property Owner", then click on "ePermit Look-up". This will bring up
a General Search screen that will allow you to search for permits within any participating jurisdiction in
the state. Enter your Start and End Dates, then enter the number "247" into the "Record #" field. The
247 corresponds to the jurisdiction code for Deschutes County. If you do not use a jurisdiction code, you
will receive permit data for all partiCipating jurisdictions in the state. You can also filter the search by
using any of the other fields available on the general search screen. To find detailed information about
a particular permit that is displayed in your search results, just click on the Record Number (permit
number).
Once you have completed your search, you can also download your results to an Excel spreadsheet.

Hi Bill,
Typically, documents that are scanned in our office will be available to view in Dial within 2-3 working
days. Due to your question regarding why the documents on serial number 163466 were not viewable
in Dial, we found a problem with our process. The documents that you have described below fell into a
category that were excluded from Dial inadvertently. That problem has now been fixed and the
previously excluded documents should be available to view by tomorrow morning, or maybe even as
early as this afternoon.
Once the documents are updated and available on Dial, I will let you know.

Thank you Tim,
The reason I started watching the land use and building permits was for my
business as an investment advisor. By following the ebb and flow of these types of
permits I was able to incorporate the data into my "Risk Factor Method of
Investing". Not having this data available on the County level as it had been
reported is equal to losing an early warning radar for the economy. I miss the
statists as they had been. The new statistics as they are presented by CDD are
too bland and not nearly detailed enough.
Please do your best to complete your project. This type of public record is
important to have easily available.
Does anyone at CDD know if the Dowells filed an appeal of the Hearings Officer's
Decision for DR-13-16 / MA-14-1? When I stopped in at CDD late yesterday
afternoon they were not able to tell.

The posting to the Dial system didn~t reference the Appeal #.
Over the weekend attempts to find the Dowell Appeal # failed due to the Dial system not being
able to display images.

We have asked for a site visit to the tax lot which is in dispute.

On Monday the 16th of June 2014 William Kuhn addressed the County Commission regarding
his feelings regarding the recent Two Bulls Fire and not being able to legally sell their property
based on governmental restrictions put on his property by the County. William also mentioned
he had a injury to his eye called a traumatic cataract while clearing fire fuels on BLM property
near his home. Mr. Kuhn is still under the care of his eye specialist.
Afterword, Assistant County Counsel Laurie Craghead wrote the Kuhns' property tax attorney
where she wrote the following:

FYI: Bill was at the Board of Countv Commissioners' meeting this morning. He spoke at the athens Input
time, apparently, saVina that he could not sell his property because of the lack of a homeowners
agreement. I arrived at the meetin8 Just after he spoke. In the next day or two, the vIdeo from the
meeting will be online for the public to see and I'll review that.
Apparentlv, Bill's eyesight Is sufficient for him to d rive himself to the meeting, take notes, read his
computer and read documents, the latter was with a magnifying glass, but he was reading documents
nonetheless.
Also, just wanted to let you know that most of the documents you listed in your discovery request call be
found online using tne County's DIAL system, a system with which Bill is very familiar. Several of the
documents requested, of course, are attorney/client prlvJ1esed documents, if they exist at all.
