Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; David Doyle and Laurie Craghead, County Counsel; Will Groves, Community Development; James Lewis, Property & Facilities; and two other citizens. Chair Baney opened the meeting at 10:00 a.m. __________________________ 1. PLEDGE OF ALLEGIANCE 2. CITIZEN INPUT None was offered. 3. Before the Board was Consideration of Board Signature of Resolution No. 2014-104, the La Pine Urban Renewal Plan. Minutes of Board of Commissioners’ Business Meeting Monday, August 4, 2014 Page 2 of 5 Elaine Howard, consultant for the City of La Pine, provided an overview of the item. The Plan will not be effective until later in August due to a parcel that is owned by and is under the jurisdiction of the County. The Plan explains the indebtedness and timeframe. It will allow the City to do certain projects including streetscaping to make it more of a community. Infrastructure is part of this Plan, and they have grants and opportunities to work with development partners. The projects are general in scope as the City is trying to figure out prioriti es for projects, and pursuing grants. Commissioner DeBone acknowledged someone’s possible concern about a perceived conflict of interest. He and his wife have a business in the urban renewal area, but the property is owned by someone else. Dave Doyle said that he feels there is no conflict of interest, but it is up to Commissioner DeBone to decide whether to vote. Commissioner Unger feels Commissioner DeBone can do his duty as a Commissioner regardless, and should be a part of this. Chair Baney said if she feels uncomfortable with this situation, she would say so, but encouraged him to go forward. Commissioner DeBone said he was a part of the recommendation group for the City. Chair Baney stated there were some concerns about a loss of revenue under this Plan, but other cities have used this and it is ultimately very good for the local economy. Commissioner Unger feels this enables cities to do a lot of things they could otherwise never do. Tom Anderson said that the land the County owns is unincorporated but there is a hope that it ultimately will be annexed and put into the best possible use. UNGER: Move Board signature of the plan. Before the Board was Consideration of Board Signature of Document No. 2014-397, Dedicating Certain Property to the Public for Roadway and Utility Purposes, and Accepting the Deed. Will Groves gave an overview of the item. This is a good example of neighbor cooperation, which will result in an improved right of way without having to remove trees. UNGER: Move approval. Before the Board was Consideration of First Reading by Title Only of Ordinance No. 2014-018, Adopting the Current Version of Deschutes County Code Chapter 15.08, the Sign Code. Laurie Craghead said this is housekeeping but provides a paper trail as to how this is being handled. DEBONE: Move first reading by title only of Ordinance No. 2014-018. UNGER: Second. VOTE: DEBONE: Yes. UNGER: Yes. BANEY: Chair votes yes. Chair Baney conducted the first reading of the Ordinance. The second reading will take place no sooner than in two weeks. 6. Before the Board was Consideration of First and Second Readings by Title Only, and Adoption, by Emergency, of Ordinance No. 2014-023, Amending Code to Increase the Transient Lodging Tax (Voter-approved in 2013). Dave Doyle explained Measure 9-96 was approved last November, increasing the tax rate from 7% to 8%. This was certified afterwards. The Finance Department has already started collecting the higher amount as of July 1. UNGER: Move first and second readings by title only, declaring an emergency. DEBONE: Second. VOTE: UNGER: Yes. BANEY: Chair votes yes. 7. Before the Board was Consideration of Board Signature of Document No. 2014-419, an Addendum to a Real Estate Sale Agreement with Biogreen Sustainable Energy Co. James Lewis said this goes back to 2009, with a variety of extensions since then due to the struggling economy and other complications. Biogreen is working with the City of La Pine on their business plan, and is confident they now have a purchaser for the power. They need to negotiate details regarding the use of water and sewer with the City. Any future extensions would mirror what Biogreen has worked out with the City. Commissioner DeBone feels this extension is appropriate. This could be a good business opportunity for Biogreen and the City. UNGER: Move approval of Document No. 2014-419. DEBONE: Second.
