TITLE OF AGENDA ITEM:
Consideration and Signature of Document No.2014-397, Acceptance of Deed of Dedication, dedicating
certain property to the public for roadway and utility purposes.

BACKGROUND AND POLICY IMPLICATIONS:
On May 18, 2014, Staff approved a request by David L. and Jane A. Tolve for a Road Dedication (RD
14-1) of 30 feet of right-of-way for extending Timland Lane. No opposition to the proposal was
entered into the record.
The applicant is proposing to dedicate the northerly 30 feet of their property for roadway purposes.
There is an existing graveled access road and access easements as shown on the submitted "existing and
proposed roadway" map in the application materials. This existing easement is the access for the
applicant and properties owned by Del and Dee Kennel (tax lots 1400 & 1401) and Fred Teichman (tax
lot 1500 & 1600). The existing roadway begins at Gribbling Road and heads easterly along the east
west center section line of Section 9. The proposed road dedication is intended to coincide with the
recording of Partition MP-I0-04 for Del and Dee Kennel. In MP-1O-04 the Kennels are required to
construct a 20' wide gravel roadway within the 30' road dedication per MP-l 0-4. The applicant wishes
to save some trees at the south end of the proposed roadway in MP-I0-04 and to better construct the
proposed roadway approximately where the existing roadway is currently located where possible.
This application was reviewed by the Deschutes County Road Department and Senior Transportation
Planner. Per their comments, no road improvements would be required for this application.
Under DCC 17.52.090(B), Board Action on Road Dedication, the Board shall take final action on the
road dedication by September 3,2014. If the road dedication is accepted by the Board, the deed of
dedication shall be immediately recorded with the County Clerk.
FISCAL IMPLICATIONS: None.
