Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; Laurie Craghead, County Counsel; Will Groves, Community Development; and Wayne Lowry, Finances. No representatives of the media or other citizens were in attendance. Chair Baney opened the meeting at 10:00 a.m. __________________________ 1. PLEDGE OF ALLEGIANCE 2. CITIZEN INPUT None was offered. 3. Before the Board was Consideration of Second Reading by Title Only of Ordinance 2014-018, Adopting the Current Version of Deschutes County Code Chapter 15.08 regarding the Sign Code. Minutes of Board of Commissioners’ Business Meeting Monday, August 25, 2014 Page 2 of 4 Laurie Craghead said there are no changes since the first reading, and this is meant to make a paper trail of where they are with the current sign code. UNGER: Move second reading by title only of Ordinance No. 2014-018. DEBONE: Second. VOTE: UNGER: Yes. DEBONE: Yes. BANEY: Chair votes yes. Chair Baney then conducted the second reading of Ordinance No. 2014-018. DEBONE: Move adoption of Ordinance No. 2014-018. UNGER: Second. VOTE: DEBONE: Yes. UNGER: Yes. BANEY: Chair votes yes. 4. Before the Board was Consideration of Board Signature of Document No. 2014-462, Amending an Improvement Agreement between Deschutes County and Weston Investment CO, LLC for the Overnight Lodging Units at the Tetherow Destination Resort. Will Groves explained the item, which relates to an extension of an improvement agreement for the overnight lodging. The agreement expires on August 28 and the extension would be for sixty days. They need a little more time to complete some documents with Wells Fargo on an ILOC, per Laurie Craghead. The numbers and all else would remain the same. She will come back to the Board on August 27 if anything arises with Wells Fargo. Commissioner Unger said he is disappointed it has not been done in a timely manner but realizes this is the culmination of a long process. David Doyle suggested the Board wait until August 27 to make sure the anticipated letter from Wells Fargo is what has been discussed. The item was continued to the Wednesday, August 27 business meeting. Minutes of Board of Commissioners’ Business Meeting Monday, August 25, 2014 Page 3 of 4 CONVENED AS THE GOVERNING BODY OF THE COUNTYWIDE LAW ENFORCEMENT SERVICE DISTRICT (DISTRICT 1) 5. Before the Board was Consideration of Signature of Resolution No. 2014- 114 Forgiving Loan between Deschutes County and Countywide Law Enforcement District #1. Wayne Lowry said that the loan was established in 2009 -10 for renovating the existing jail facility, not a part of the improvements now being done. This was evidenced by a promissory note for repayment, but it did not have terms or an interest rate. Tom Anderson added that he could find no history from the records of the previous County Administrator, but perhaps was to be part of the larger bonded project, but it took a different direction for several years. The Sheriff agrees that the loan from the District was to be forgiven. Chair Baney said that this work was part of the overall package, but for operational reasons the work needed to be done sooner. She does not recall the repayment being forgiven, but thought it was to be handled differently. However, the history of this is unclear. Dave Doyle stated that this was an appropriate expenditure from a legal standpoint. Commissioner DeBone said he can see what was happening at the time and this kept the tax rate down. Commissioner Unger added that there is a good relationship with the Sheriff and this is the right thing to do for the big picture. Chair Baney noted that as they do clean-up, costs associated with bonding and construction need to be tracked more specifically. UNGER: Move signature of Resolution No. 2014-114. DEBONE: Second.
