TITLE OF AGENDA ITEM:
Consideration of Board signature of Document 2014-472, a Bargain and Sale Deed for approximately
0.82 acres to the Oregon Department of Transportation for right of way at Wickiup Junction.

BACKGROUND AND POLICY IMPLICATIONS:
As part of the future interchange improvements planned for the intersection of Burgess Road and
Highway 97 in La Pine (commonly known as Wickiup Junction), ODOT is seeking a crescent shaped
parcel of land, 0.82 acres in area, at the southwest corner of the aforementioned intersection (the subject
property is at the extreme northeast corner of the County owned parcel - see Exhibits A and B). The
property, which will be additional right of way, is necessary to construct the transportation
improvements for the interchange as approved by ODOT. After the sale of the property, the remaining
County parcel will be 324.92 acres, and will be available for development according to the approved
neighborhood master plan for the property and the applicable City of La Pine zoning/development
regulations.
In exchange for the land, Deschutes County will receive $15,500. The price is based on an appraisal
report performed by a licensed appraiser contracted by ODOT, and subsequent negotiations with
County Staff. Based on the appraisal report, and the current land use regulations, development plans
and capabilities/limitations for the property, Staff believes that the price is an appropriate value.
FISCAL IMPLICATIONS:
No on-going implications. Deschutes County will receive a lump sum of $15,500 for the property.

BARGAIN AND SALE DEED
DESCHUTES COUNTY, a political subdivision of the State of Oregon, which acquired title as
DESCHUTES COUNTY, a Municipality of the State of Oregon, Grantor, for the true and actual consideration of
$15,500 does convey unto the STATE OF OREGON, by and through its DEPARTMENT OF TRANSPORTATION
Grantee, fee title to the property described on Exhibit "A" dated 8/14/2012, attached hereto and by this reference
made a part hereof.
Grantor agrees that the consideration recited herein is just compensation for the property or property rights
conveyed, including any and all reduction in value to Grantor's remaining property, if any, which may result from the
acquisition or use of said property or property rights. However, the consideration does not include damages
resulting from any use or activity by Grantee beyond or outside of those uses expressed herein, if any, or damages
arising from any negligence.
In construing this document, where the context so requires, the singular includes the plural and all
grammatical changes shall be made so that this document shall apply equally to corporations and to individuals.

included in a strip of land, variable in width, lying on the Northwesterly side of the center
line of the relocated US97: The Dalles-Califomia Highway, which center line is described
