Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; and Chris Doty, Road Department. Robin Edwards took the minutes. 1. PLEDGE OF ALLEGIANCE 2. CITIZEN INPUT None was offered. 3. Before the Board was Consideration of Board Signature of Resolution No. 2014-116, Initiating Legalization Proceedings for a Portion of Neff Road. Chris Doty gave an overview of the item, stating, "We're here to initiate legalization for a portion of Neff Road just west of Powell Butte Hwy. This legalization is a procedure used to clarify the right-of-way and boundaries if one of3 things exists: Minutes of Board of Commissioners' Business Meeting Wednesday, September to,2014 Page 1 of5 Minutes of Board of Commissioners’ Business Meeting Wednesday, September 10, 2014 Page 2 of 5 1. If doubt exists as to the legal establishment of the road itself; 2. If the location cannot be accurately determined; or 3. As in the case of this stretch of road, if the traveled road does not conform to County records. “You’ll see the maps provided in your exhibits in the staff report show the platted right-of-way not conforming to the location of Neff Rd. The legalization process is established in ORS-368. Neff Rd. was originally established in 1909, so it’s not uncommon for those older roads to not conform to the County record. We see this all the time. “We are keen on establishing and legalizing this section of the road because we’ll be buying right-of-way soon from adjacent property owners to accommodate the Powell Butte Hwy/Neff/Alfalfa project, so we need a center line and established right-of-way, to then write legal descriptions and purchase right-of-way. “Before you are two items: Resolution 2014-116 initiates the legalization proceedings and sets the public hearing for October 22. The second, Board Order 2014-021, authorizes the road official to file a report and provide notice to the adjacent property owners of the October 22 hearing. After the hearing, you will be presented with another order for your approval. Pending that approval, we will then file the appropriate documentation to establish the right- of-way as legalized, and then we can begin to purchase right-of-way for the project.” Commissioner DeBone inquired, “Is this utilizing the existing center line? There’s a road and intersection, and on a map it’s just a little bit different than how it has been paved and utilized - is that the history?” Mr. Doty replied, “Correct; the right-of-way records do not conform to the location of the road or the tax lot maps. We take the center line of the road, establish the 60-foot right- of-way of Neff, with 30 feet each side, and legalize that description.” Tom Anderson inquired why the original right-of-way has such a severe jog in it. Mr. Doty said it was due to a rock outcropping; they intended to go around it, then just went through it. It’s typical of the time that they constructed the roads in the easier location based on the early 1900’s road construction technology that was in place. Minutes of Board of Commissioners’ Business Meeting Wednesday, September 10, 2014 Page 3 of 5 Mr. Anderson said that Mr. Doty may want to point out that it’s not that we built the road in the wrong place outside the right-of-way, it’s that the right-of- way was ‘cockeyed’ to begin with, and this will make the road line up. Before the Board was Consideration of Board Signature of Order No. 2014-021, Causing a Portion of Neff Road in Deschutes County to be Surveyed, Causing the County Road Official to File a Report on the Matter and Causing Notice of the Legalization Process for Neff Road to be Provided. Before the Board was Consideration of Signature of Letters Appointing Individuals to the Deschutes County Audit Committee: Shaun Armstrong, through June 30, 2016; and Lindsey Lombard, through June 30, 2015. Commissioner DeBone noted they are adding two Audit Committee members today. Alan was on the committee that interviewed three people for these two positions. He said that what these two people bring to the Audit Committee is an operational component within Shaun Armstrong’s job description that will help bring a different voice to some of the things that our Auditor does. There are a lot of people on the Audit Committee who understand numbers, but a lot of things that David Givans deals with is how well the County functions and how we can make it better.
