Present were Commissioners Anthony DeBone, Alan Unger and Tammy Baney.
Also present were Erik Kropp, Interim County Administrator; Laurie Craghead,
County Counsel; Tom Anderson, Nick Lelack and Peter Gutowsky, Community
Development; George Kolb, Road Department; Joe Sadony, Information
Technology; and ten other citizens.
Newly-installed Chair Anthony DeBone opened the meeting at 10:00 a.m.

The Board acknowledged Commissioner Tammy Baney’s five years of service
to the County.
3. DEPARTMENT PRESENTATION – Information Technology.
Joe Sadony gave a PowerPoint presentation on the services provided by his
department. (An overview is attached, for reference.)
4. Before the Board was a Public Hearing and Consideration of Signature of
Order No. 2012-001, Vacating a Portion of Knickerbocker Avenue
(Terrebonne).
George Kolb said that Central Electric cooperative originally indicated they did
not need the existing right of way, but after the original vacation actions had
occurred they realized they wanted to keep a right of way available to them.

The hearing can take place and the Order approved, but it cannot be signed until
CEC is satisfied that they still have the right of way they need for maintenance
purposes.
There was some confusion when the subdivision was platted and the easement
for the road was put into place. The easements were dedicated to the public.
When properties were developed, this easement was no longer needed for
access. However, CEC needs access to a pole and line. The access to be
vacated is rough and steep, and is not needed by any of the property owners.
Chair DeBone opened the public hearing.
Steve Henderson is a resident in the area, living at the terminus of
Knickerbocker Lane. The road goes to nowhere but is access to private
property. He is concerned about people using it and caus ing damage to the
property and that of others. This traffic occurs at all hours and the users leave
behind lots of trash.
Cindy Murphy of Cascade Lane lives on the east end of the easement. She
agrees that the road should be vacated. People drive behind her property at all
hours. They are working with CEC regarding the maintenance of the
equipment and that should be resolved soon.
Mark Piper added that he has located a place to put a gate, and CEC would have
a key to the lock. All property owners seem to be agreeable to this.
Dennis Hanson of NW Kesley Lane said he submitted a letter also. He agreed
that this is not a typical ‘not in my backyard’ issue. They pay taxes on this road
and it is a public safety issue, with ATV’s, hunters, party-goers and others who
do not need to be on private property at all hours. There is no public property
accessed by the easement. There is a need to address the safety and welfare of
the local property owners.
Ryan Enders said he owns property there as well. He feels there are safety
issues with individuals using this easement for a variety of uses when they have
no business being there. There are no public lands accessible via this easement.
Commissioner Baney thanked the residents for their input. She acknowledged
that there has been no opposition to the vacation except for the clarification of
the CEC use of the easement. The Order would not be ratified until this takes
place.

Laurie Craghead said that the written record could be left open and they would
have to accept any written testimony in the meantime. She recommended that
they do not make a final decision at this time.

record to be left open until such time as CEC is satisfied with the
status of its rights to use an easement.

5. Before the Board was Consideration of Signature of Order No. 2012-004,
Designating Hearings Officers to Adjudicate Civil Penalty Proceedings
relating to Code Enforcement.
Tom Anderson said that Senate Bill 915 requires that any local jurisdiction can
no longer cite offenders to Circuit Court, and must have a process in place to
deal with these types of cases. Part of this is the Board establishment of a
Hearings Officer to hear these cases.
An RFP was done and a pool of hearings officers qualified to hear cases was
selected. The initial intent was to address building code violations, but other
types of cases may be heard. There could be about ten cases a year. About 90-
100 cases are opened each year, but most are resolved through voluntary
compliance. The contracts have a not to exceed amount of $50,000 each. He
anticipates the cost per year may be about $5,000. There is no mechanism to
levy these costs to the defendant, as typically they would not have the funds
available.
Karen Green is local and may be primarily used; the other two live in the valley
so there would be travel expenses involved. The department will try to piggy-
back hearings when possible to economize. It is a multi -year contract and may
be used by other departments for other cases, so it is hard to know what the
costs might be.
Ms. Craghead stated that the Court is efficient and does a good job, but if a fine
is imposed the fine goes to the Court. If a fine is imposed in this new process,
the fine would go to the County. The County also has the ability to lien property
in this situation.

Commissioner Unger asked for an explanation of the civil process. Ms.
Craghead stated these would not be criminal proceedings, so it is a lot less
complicated.

6. Before the Board was Consideration of Second Reading by Title Only, and
Adoption, of Ordinance No. 2012-001, Amending Title 2.28 of Deschutes
County Code – Historical Landmarks Commission.
Peter Gutowsky gave a brief overview of the item. The cities are interested in
forming their own Commission for local control and more options for funding.
A hearing was held, one person in support testified, and the hearing was closed.
The Ordinance would be effective ninety days after adoption.

16. ADDITIONS TO THE AGENDA
Erik Kropp said there is a scheduled item on the afternoon work session
regarding the Regional Economic Opportunity Analysis. Staff recommends
that this be moved into executive session as there is a possibility of litigation on
this issue.

Commissioner Unger complimented John Stark on continuing to work with
legislators on the possibility of a HUB Zone. Review of census tracts is
continuing on this issue to help with economic development.
Commissioner Baney indicated a meeting has been set with FEMA in
Washington, DC regarding wildfire issues.
Being no further items to come before the Board, the meeting adjourned at
11:00 a.m.

Re: Vacation of Portion of Knickerbocker Road
I reside at 1644 Kesley Lane in Terrebonne, and the back of my home is lined by
Knickerbocker Road. When I purchased the home nine years ago, it was with my
understanding and that of the realtor that the road was not a public access, but only a
utility-access road. Even until recently, this has been my understanding and it was
thus with some surprise when this issue arose.
This is not your normal "not-in-my-backyarcl' issue raised in public debate, but it
actually is in my immediate backyard, as well as for all of us who live on Kesley
Lane. It is indeed a public-safety issue, to wit, the ATV and motorcycle traffic that
includes hunters with guns and smokers who create a fire hazard, along with the
mess of alcohol cans and bottles. This would be a different matter were the road to
connect with a BLM or open area, but it is 1,400' that leads to nowhere, terminating
at the top at private property. Just up and back down the steep road, a few feet from
our homes.
It is my understanding that CEC and perhaps another utility wants to have an
easement. I have no problem with that and even encourage it. This seems to be
commonsense.
F or those of us who live on Kesley Lane, we treasure its sense of place. As to
public access, it is in our interests -both public and private-to vacate this roadway.

RE: Testimony favoring vacation of Knickerbocker Avenue.
Please consider the following testimony when dealing with the petition to vacate the portion of Knickerbocker
Avenue described in the Notice of Vacation Hearing issued December 15th, 2011. We hope that in your
deliberations you will consider past incidents, the safety and security of the individuals and property involved,
including utility company, and that through common sense, this will guide you to a decision that prevents a future
tragedy.
In 2010, when we purchased lot 3 of the North C Acres development, our realtor assured us that the
dirt/mud roadway at the south edge of the property was a utility easement, when in fact, it is a right of way.
The only purpose the dirt road can serve is for utility access since it leads to private land only.
Vehicles occasionally travel up the road, some of which may be carrying firearms and alcohol, since I have
found shell casings, beer cans and dead animal carcasses on the hill (Private Property).
The hill is home to many different species including Golden Eagles, Falcons, Hawks and Deer, just to name
a few.
Some dog walkers tum their dogs off-leash while on the right-of-way. This last spring our dog was killed
by another dog, off -leash and on several occasions dogs off-leash have chased our cats and done damage
to our yard.
We have a 19 month old daughter that will be playing in the yard this coming spring and pedestrians with
free access to our back yard and dogs running off leash will be a concern, as will be the likelihood someone
could enter the rear entrance of our house without being viewed by neighbors.
Neighbors with permission will still be allowed to enjoy the hill, but this will allow the property owners to
make the decision of who can walk onto our private property.
Whatever the original intent was for the right of way, it no longer pertains since this road does not give
direct access to public land nor would a new road be necessary to access private property, all of which,
have an existing road to their properties. A utility easement makes sense but a right of way does not.
Lastly, I would think the utility company would be concerned with the potential for vandalism to their
utility boxes and lines.
For all of the reasons listed above and many more, we ask that Knickerbocker be vacated as a right of way and
changed to a utility easement.

Commissioners,
I live at the end of Kelsey Ln in Terrebonne. Knickerbocker Ave. that is being
considered for vacation terminates at the southwest corner of my property. The
Knickerbocker roadway does not connect with any other public road or right of way. It
does not provide access to any public land. All the residents and property owners
adjacent to this road have access to their properties from other maintained public roads or
right of ways .. Knickerbocker Ave is a road to "Nowhere."
This roadway is over 11 % grade and is a rutted rocky trail that is not maintained. The
only vehicular traffic on this road are non-residents on motorcycles or in four wheel
drive rigs that use this road for illegal access to private property. Because of its condition
and the fact that many acres of private undeveloped land can be accessed for "off
roading" this right of way is an attractive nuisance that brings in people that abuse our
property with litter and illegal trespass. I won't bother you with countless stories of
people coming onto our property and the damage they have done, I can provide that
information at your convenience and request, but suffice it to say that the use of this road
is harmful to the property owners that it is supposed to serve and that none of the owners
of the property that this road crosses care to use this roadway for access.
Because misuse of private property create potential fire risks and often results in calls to
911, I hope you will agree that it would be in the best interest of the public and property
owners along Knickerbocker Ave. to vacate this roadway

We are very much in favor of the vacation of Knickerbocker Avenue as described in the Notice of
Vacation issued December 15, 2011. As others experienced, we too were told, when we bought the
house in April 2010, that the dirt path behind our home was a utility easement not open to the public.
After living here we have come to realize that is not the case, and the risk of trespass, theft, wildfire,
illegal activities, crime, and public nuisance has been steadily increasing. Many cruisers find their way
here after dark and late at night when nothing good can come of their presence. It is adjacent to, and
looks directly down into the back of our homes, shops and barns.
This 11% plus trail goes nowhere and dead ends approximately 1400 feet from where it starts. This
does not go to public land but runs up again a fence to privately owned acreage in one direction, or
south straight up the side of a hill on a narrow rocky 15 plus %grade to other private land. All private
properties in the area have access through other routes, so this road is not needed. People who drive
up here have no choice but to turn around and drive back out creating double dust, noise and erosion,
not to mention other possible illegal intentions they may have.
We completely understand the CEC's need to have an easement to service their lines and boxes along
here, and we are not against that. We are, however, opposed to the current status of Knickerbocker
Road as a public easement since there is nowhere legal for the public to go. We have some suggestions
to solutions for the utility easement to discuss with CEC and we have a pending meeting prior to the
January 4th meeting in Bend.

Please consider the following testimony when dealing with the petition to
vacate the portion of Knickerbocker Avenue described in the Notice of Vaca

In 1999, when we purchased lot 4 of the North C Acres development, our re
altor assured us that the 30' -wide roadway at the south edge of the property
w~a utility easement. When general traffic up and down the hill became a
concern to us and we prepared to complain, we learned that it was a public
right-of-way and we had> no right to prohibit anyone from entering the dirt
track named Knickerbocker Avenue.
All manner of vehicles and hikers use the "road to nowhere" on occasion. We
have seen ATVs ridden by people carrying open alcoholic beverage contain
ers. Other ATV traffic involves jOyriders, sometimes holding small children
on their "laps" while running up and down the steep, bumpy roadway. Dur
ing fire season. we have seen hikers and lor riders smoking cigarettes. Hunt
ing season brings increased traffic by drivers with guns on board. In violation
of county ordinances, some dog walkers turn their dogs off-leash while on
the right-of-way.
Users of Knickerbocker Avenue look directly down into our yard and win
dows offering a prime opportunity to survey our comings and goings with an
eye to breaking and entering. In short, our sense of privacy and security are
violated by the presence of a roadway that serves no purpose to the general
public. For all of the reasons listed here, we land owners would be better off
if we had the right to post the steep, rough track as closed to the public.
In your deliberations, please consider the following snmmary in favor of
vacating Knickerbocker Avenue as a public right-Of-way:
1. Whatever its original intent, the Knickerbocker Avenue right-of-way (less
than 1400 feet long and encompassing a steep grade of over 11°) leads
only to private property and should no longer allow public access.
2. The Knickerbocker Avenue right-of-way allows public viewing of our
household, violating our privacy and sense of security.
3. Public traffic on the right-of-way increases the threat of wildfire.
4. Deer range through the area on a regular basis. The right of way offers
easy access to hunters and their vehicles, bringing the potential threat of
gunfire dangerously close to occupied residences.
5. The steep grade and primitive surface of the track pose a physical threat
to any and all who use Knickerbocker Avenue.
