TITLE OF AGENDA ITEM:
Consideration of Board Signature of Document No. 2012-128, a Notice of Intent to Award Contract
Letter declaring Pro-Vend Services, LLC as selected vendor for vending machine services at Deschutes
County Health Services.
PUBLIC HEARING ON THIS DATE? No.
BACKGROUND AND POLICY IMPLICATIONS:
Pro-Vend Services, LLC is the vendor Health Services has selected to provide full service vending
machine services including the provision of all equipment, materials and supplies required for the
vending of food and beverage items at: Deschutes County Health Services, 2577 NE Courtney
Drive, Bend, OR 97701. At least 75% of the food/beverage products provided will meet or exceed
the specified nutrition standards set forth below:
• Packages will be single serving sizes.
• Items will provide < 300 calories per serving.
• The Majority of grains offered will be whole grain.
• Items will contain < 30% of calories from total fat (excluding nuts, seeds, nut butters,
and reduced fat cheeses).
• Items will contain <10% of calories from saturated fat (excluding reduced fat
cheeses).
• Items will contain <30% sugar by weight (excluding naturally occurring sugars and
low fat yogurts).
• Items will not contain sugar as the first ingredient.
• Items will provide minimal to none, trans-fatty acids.
• Duplication of product in same machine shall be minimal.
• Plain water (any size).
• 100% fruit and/or vegetable juice (12 oz. or less size).
• Carbonated beverages with 70 -100% pure juice with no added ingredients except
water.
• Milk (flavored or unflavored).
• 1% fat or less
• 12 oz. or less size
• No more than 30 grams sugar per 8 oz. (as written on the label).
• Soda (regular) may not make up more than 25% of beverage selections.
Pro-Vend Services, LLC will remit a five percent (5%) commission of total gross monthly sales to
Deschutes County. These commissions will be paid monthly. Pro-Vend Services, LLC will provide a
quarterly detailed, itemized financial report.
FISCAL IMPLICATIONS:
Contractor shall pay a five percent (5%) commission of total gross monthly sales to Deschutes County.
RECOMMENDATION & ACTION REQUESTED:
It is the recommendation of the Health Services department that this Intent to Award Letter be signed
by the Board of County Commissioners.

NOTICE OF INTENT TO AWARD CONTRACT
In December, 2011, Deschutes County, Oregon considered proposals for vending machine
service at Deschutes County Health Services, 2577 NE Courtney Dr., Bend, Oregon, 97701. It
was determined that the preferred vendor for this service was Pro-Vend Services, LLC.
A copy of this Notice of Intent to Award Contract is being provided to each firm or individual
that submitted a proposal for this service. See attached list. Any firm or person who believes
that they are adversely affected or aggrieved by the intended award set forth in this Notice,
may submit a written protest within five (5) calendar days after the issuance of this Notice of
Intent to Award to the Board of County Commissioners of Deschutes County, Oregon, at the
above address. The five (5) day protest period will expire at 5:00pm on Monday, March 12,
2012.
Any protest must be in writing and specify any grounds upon which the protest is based. If a
protest is filed, a hearing will be held at 10:00am on March 14, 2012, before the Board of
County Commissioners of Deschutes County, Oregon, acting as the Contract Review Board, at
Deschutes County Services Center, 1300 NW Wall St., Bend, Oregon, 97701.

If no protest is filed within the protest period, this Notice of Intent to Award Contract becomes
an Award of Contract without further action by the Board of County Commissioners unless the
Board, for good cause, rescinds this Notice before the expiration of the protest period. The
successful bidder on a Deschutes County project is required to execute the Contract. In addition
to the execution of Contract, the Contractor will be required to provide a certificate of
Commercial General Liability insurance.
