MINUTES OF BOARD BUSINESS MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, APRIL 23, 2012

Present were Commissioners Anthony DeBone and Alan Unger; Commissioner
Tammy Baney was out of the office. Also present were Laurie Craghead, County
Counsel; Nick Lelack, Tom Anderson and Paul Blikstad, Community Development;
and one other citizen.
Chair DeBone opened the meeting at 10:00 a.m.

None was offered.
3. Before the Board was a Public Hearing and Consideration of First and
Second Readings by Title Only, and Adoption by Emergency, of
Ordinances Incorporating Minor Changes to State Law into Deschutes
County Code (Ordinances No. 2012-007, -008, -00 and -010).
Chair DeBone read the opening statement at this time. In regard to conflicts of
interest, the two Commissioners claimed none. No challenges from the public
were voiced.
Paul Blikstad explained the various changes, most of which are ‘housekeep ing’
in nature and required to comply or be consistent with changes in State law.

Regarding ‘room and board’ arrangements, in the past there was a conditional
use permit for what was perceived as room and board arrangements on EFU
land, but the Commissioners had indicated that this had to be for no less than
thirty days. The most important part of this issue is whether there is to be a
specific timeframe necessary. There is no set definition of room and board
arrangements in Code except for the Board’s decision in this one case.
Commissioner Unger said at the time they were trying to determine the
difference between ‘room and board’ and ‘bed and breakfast’.
Ms. Craghead stated that Statute changed around that time, and the meaning of
bed and breakfast was not clear. At this time the State has clarified they are
similar.
Commissioner Unger indicated that ‘bed and breakfast’ also gives, for instance,
farmers an option of having students come and learn about farming, etc. None
would likely stay for thirty days, however.
Mr. Blikstad said ‘room and board arrangements’ has now been clarified, and
the DLCD does not care if this includes bed and breakfast. Ms. Craghead stated
that the State is going towards broadening these arrangements rather than
restricting them. Mr. Blikstad said that the Board can take out the thirty-day
requirement since the State does not feel this is necessary. This would define
room and board arrangements with no minimum stay.
Mr. Blikstad talked about wind power generating and photo voltaic energy
generating systems, now written into statute. Ms. Craghead stated that the
property owner cannot sell the power, since it is for individual use only.
Otherwise, it would fit under utility facilities with a lot of criteria to meet at that
time. Mr. Blikstad stated that if something has to be reviewed by the Oregon
Department of Energy, it is big enough that it should not be left up to the
County anyway.
Commissioner Unger believes the intent was to allow for small-scale energy
wind generation, but a 100-foot tower would be allowed as a conditional use.
He would like to be open to this and see if there are problems. He does not feel
there will be that many considered due to the cost of such equipment and the
marginal potential energy production capabilities in this area.

Regarding parks dedication and park fees, when the Code was written there was
an entity called the Central Oregon Park and Recreation District. They are now
named the Redmond Park and Recreation District. Rather than being specific,
this change would cover any Park and Recreation District that is created or has
changed its name.
Ms. Craghead went through some small wording changes to clarify and
reformat to meet State wording. The Redmond Fire District addressing system
and the County’s addressing system are not the same. However, there are
properties that are in the Fire District near but not adjacent to other Fire District
covered properties, so the addressing system is not consistent. Mr. Blikstad
said that he does not see a big problem with this. The County can choose to
have properties renumbered or allow the Fire District to do so. For instance, all
of Lower Bridge Estates was renumbered at one point.
Tom Anderson stated that he does not believe Redmond Fire District would
pursue renumbering except for a couple of areas that would help with their
response time. The whole concept was that the Code changes would set the
table for future address creations, with the County matching up with the Fire
District protocols. Ms. Craghead suggested they determine if there is some
leapfrogging that needs to be reviewed. This is just in regard to the Redmond
Fire District and not others. The Commissioners felt that being consistent with
future address creations would be desired, without going back to change others
unless warranted.
Being no further discussion, the public hearing was closed at this time, and
Counsel will prepare final documents for a Board business meeting next week.
