BACKGROUND AND POLICY IMPLICATIONS:
The Primary Election was held on May 15,2012. In that election 30,223 electors cast ballots; 14,421
electors voted YES and 15,802 voted NO on the issue offorrnation of the District. The Measure was
defeated. The Board of County Commissioners needs to officially declare results of the election.
Attached are the documents to allow that action.
FISCAL IMPLICATIONS:
NONE.
RECOMMENDATION & ACTION REQUESTED:
Approve Order No. 2012-030, declaring election results.

An Order Declaring the Results of the *
Primary Election Held on May 15,2012 For * ORDER NO. 2012-030
the 9-1-1 District *
WHEREAS, an election in Deschutes County, Oregon was held on May 15, 2012 on the
measure set forth in Exhibit A concerning the proposed Bend Area Transportation District ("District");
and
WHEREAS, an Abstract of Votes, a copy of which is attached as Exhibit B, shows that a
majority of those persons voting voted to not approve the measure; and
WHEREAS, ORS 198.820(1) requires the Board to canvass the votes and dismiss the Petition
if the Board determines that the majority of the votes cast were in opposition of formation of the
District; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. At the election held in DESCHUTES County, Oregon on May 15, 2012, as
evidenced by the abstract of votes, a copy of which is attached as Exhibit B and incorporated by
reference herein, 30,223 electors cast ballots on the issue of formation of the District and, of those
electors, 14,421 electors voted YES, and 15,802 voted NO on the measure captioned FORM 9-1-1
DISTRICT WITH PERMANENT RATE, WITHDRAW FROM EXISTING DISTRICT, as set forth in
the attached Exhibit, incorporated by reference herein.
Section 2. Because the majority of electors voted in opposition, the measure is declared to have
failed.
Section 3. The Petition is hereby dismissed.

Section 4. The Legal Department shall cause certified copies of this order be filed with the
Deschutes County Clerk and Assessor and the Oregon Department of Revenue and Secretary of State
pursuant to ORS 198.780(1).

A measure election will be held in Deschutes County, Oregon.

The following shall be the ballot title o£ the measure to be submitted to the dish-ict's voters on this date:
CAPTION (10 Words)
Form 9-1-1 district with permanent rate, withdraw from existing district.
QUESTION (20 Words)
Should replacement 9-1-1 district be formed with $0.39/$1000 assessed value permanent tax rate limit
beginning 2012-2013, and current territory withdrawn?
This measure may cause property taxes to increase more than three percent.

SUMMARY (175 Words)
This measure creates the Deschutes 9-1-1 County Service District for emergency communications and
withdraws the territory within Deschutes County from the existing 9-1-1 district. The purpose is to provide
long-term stable funding for emergency communications throughout Deschutes County. This may include
future technology upgrades to provide faster and more accurate ambulance, fire and law enforcement
emergency response.
The existing district has a permanent tax rate limit of $0.1618/$1000 assessed value. State law does not
permit this to be increased unless a replacement district is formed. The balance of the funding for the existing
district comes from a temporary, five-year local option levy of $0.23 that expires 2013. Thus, the total current
taxing authority for the existing district is $0.3918.
The new district would have a permanent rate limit of $0.39. The intent, however, is to initially levy only
$0.33, resulting in a tax decrease.
If formation is approved, the intent is to merge the remaining portion of the existing district in Jefferson
County into the new district in November.
