TITLE OF AGENDA ITEM:
Consideration of Signature of Document 2012-282, and Intergovernmental Agreement with the,Oregon
Department of Transportation for Construction of Improvements to Highway 97 at the Entrance to
Southwest Transfer Station.

BACKGROUND AND POLICY IMPLICATIONS:
Due to increased traffic at the Southwest Transfer Station, it has been determined that improvements to
Highway 97 at the entrance to the site are required for safety reasons. A left turn lane and accellerationl
decelleration lanes will be added to Highway 97.
This will be a joint effort by the County the Oregon Department of Transportation. The proposed
Cooperative Agreement establishes the roles and requirements of each party. The County will contract
for construction of the improvements, ODOT will provide design review and approval as well as
construction inspection. The agreement provides for the County to reimburse ODOT for the cost of
those inspection services.
FISCAL IMPLICATIONS:
Inspection services will be reimbursed by the County for a sum not to exceed $20,000.

COOPERATIVE IMPROVEMENT AGREEMENT
US 97 at Southwest Transfer Station Turn Lanes (MP 159.50)
Deschutes County
THIS AGREEMENT is made and entered into by and between the STATE OF OREGON,
acting by and through its Department of Transportation, hereinafter referred to as "State;"
and DESCHUTES COUNTY, acting by and through its elected officials, hereinafter
referred to as "County ," both herein referred to individually or collectively as "Party" or
"Parties."
RECITALS
1. By the authority granted in Oregon Revised Statute (ORS) 190.110 , 366.572 and
366.576 , State may enter into cooperative agreements with counties , cities and units
of local governments for the performance of work on certain types of improvement
projects with the allocation of costs on terms and conditions mutually agreeable to
the contracting parties.
2. US 97 (The Dalles -California Highway) is a part of the state highway system under
the jurisdiction and control of the Oregon Transportation Commission (OTC).
3. The Deschutes County Solid Waste SW Transfer Station Access Road is a part of
the County Road system under the jurisdiction and control of County.
4. In order to maintain consistent traffic flows and improve safety on US 97 , State and
County wish to make improvements at the intersection of US 97 and Deschutes
County Solid Waste SW Transfer Station Access Road at approximately mile point
159.50 .
5. By the authority granted in ORS 810.210 , State is authorized to determine the
character or type of traffic control devices to be used , and to place or erect them
upon state highways at places where STATE deems necessary for the safe and
expeditious control of traffic. No traffic control devices shall be erected, maintained ,
or operated upon any state highway by any authority other than State, except with its
written approval. Traffic Signal work on this Project will conform to the current State
standards and specifications .
NOW THEREFORE , the premises being in general as stated in the foregoing Recitals, it
is agreed by and between the Parties hereto as follows:
TERMS OF AGREEMENT
1. Under such authority, State and County agree to make roadway improvements at
the intersection of US 97 and Deschutes County Solid Waste SW Transfer Station
Access Road at approximately mile point 159.50, hereinafter referred to as "Project. "
The location of the Project is approximately as shown on the Project Location Map,
attached hereto, marked Exhibit A, and by this reference made a part hereof.
