(current owner) 13593 Bayview Edison Road Mount Vernon, WA 98273 REQUEST: The applicant is requesting an amendment to the Deschutes County Comprehensive Plan Map to change the map designation of the subject property from Agriculture to Airport Development. The applicant is also requesting a zone change for the subject property from Exclusive Farm Use to Airport Development (Aviation Support District). The subject property is located along the southern boundary of the Bend Municipal Airport. STAFF CONTACT: Kevin Harrison, Principal Planner RECORD CLOSED: July 16, 2012 I. APPLICABLE STANDARDS AND CRITERIA: The Board adopts as its own the standards and criteria, findings of fact and conclusions of law adopted by the Deschutes County Hearings Officer in her decision dated January 20, 2009, which is incorporated herein by reference. II. PROCEDURAL HISTORY: A public hearing was held before the Deschutes County Hearings Officer on December 16, 2008. Based on the information in the record, the Hearings Officer denied the applications in a decision dated January 20, 2009. Following the public hearing before the Hearings Officer, a public hearing was held before the Board of County Commissioners ("Board") on February 28, 2009, pursuant to DCC 22.28.030(C). At that hearing, the Board indicated that an update to the Bend Municipal Airport Master Plan was necessary before the Board would consider a Plan Amendment and Zone Change. In response, the applicant requested a continuance of the public hearing to August 3,2009, which was granted by the Board. Page 1 of 3 -DECISION OF DESCHUTES COUNTY BOARD OF COUNTY COMMISSIONERS in PA-08­ 3/ZC-08-3 -Deschutes County Document No. 2012-491 On July 27, 2009, the applicant submitted a letter into the record requesting a second continuance of the public hearing to the summer of 2010 to allow time for the City of Bend to complete the Airport Master Plan update. At the August 3, 2009 public hearing, the Board granted a continuance to February 10, 2010. The applicant submitted letters into the record on January 21, 2010 and January 27, 2010 requesting a continuance of the February 10, 2010 hearing to the spring of 2011. This continuance would allow time for the City of Bend to complete the Airport Master Plan update. At the public hearing on February 10, 2010, the Board granted the requested continuance to July 13, 2011. At the public hearing on July 13, 2011, neither the applicant nor his representative was present. The Board, on its own motion, continued the public hearing to July 16, 2012. This decision follows. As of July 16, 2012, the Bend Airport Master Plan (BAMP) update is in the closing stages with a draft expected to be submitted to the Federal Aviation Administration (FAA) in the next few months. Relative to this decision, the BAMP lists its preferred alternative as extending the runway north, not south. The BAMP anticipates purchasing the land which is the subject of these applications for a few hangars along Powell Butte Highway and to buffer the airport from encroachment and incompatible land uses. The current zoning is appropriate to provide this buffer. III. DECISION: The Board affirms the Hearings Officer'S decision with respect to PA-08-3 and ZC-08-3, denying the requested plan amendment and zone change.
