FROM: Chad Centola Solid Waste Phone # x7172 TITLE OF AGENDA ITEM: Consideration of Chair Signature of Document No. 2012-511, a Notice of Intent to Award Contract Letter for the 2012 Knott Landfill Rock Removal Project. PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: In July 2012, the Department of Solid Waste solicited bids for rock excavation work at Knott Landfill. The project includes the drilling and blasting of approximately 100,000 cubic yards of in-place basalt. The rock removal is necessary to facilitate ongoing excavation activities as filling operations progress at the landfill and to access soil for site operations. Most ofthe rock generated from this project will be processed by the contractor into aggregate products for use by the County's Solid Waste and Road Departments. The contractor will also place rock fill in an area at the Knott Facility that will be used for future compo sting operations. Bids were received from five firms and JAL Construction, Inc. was determined to be the lowest responsible bidder for the project. A summary of the bids received is attached. FISCAL IMPLICATIONS: Funds have been budgeted in the Solid Waste Department budget for this project. RECOMMENDATION & ACTION REQUESTED: Staff recommends that the Board of County Commissioners issue a Notice of Intent to award the 2012 Knott Landfill Rock Removal Project to JAL Construction, Inc. in the amount of $935,491.36. PO Box 6269 Bend, OR 9770B RE: 2012 Knott Landfill Rock Removal Project NOTICE OF INTENT TO AWARD CONTRACT On Wednesday, August B, 2012, the Board of County Commissioners of Deschutes County, Oregon, considered proposals for the above-referenced project. The Board of County Commissioners determined that the successful bidder for the project was JAL Construction, Inc. of Bend, Oregon with a bid of Nine Hundred Thirty-Five Thousand Four Hundred Ninety-One and 36/100 Dollars ($935,491.36) This Notice of Intent to Award Contract is issued pursuant to Oregon Administrative Rule (OAR) 137-047-0610 . A copy of this Notice is being provided to each firm or person that submitted a bid or proposal for the project. Any firm or person which believes that they are adversely affected or aggrieved by the intended award of contract set forth in this Notice may submit a written protest within seven (7) calendar days after the issuance of this Notice of Intent to Award Contract to the Board of County Commissioners of Deschutes County, Oregon, at Deschutes Services Building, 1300 NW Wall Street, Bend, Oregon 97701. The seven (7) calendar day protest period will expire at 5:00 PM on Wednesday, August 15,2012. If a protest is filed, a hearing will be held at 10:00 a.m. on Wednesday, August 22, 2012 before the Board of County Commissioners of Deschutes County Oregon, acting as the Contract Review Board, in the Deschutes Services Building, 1300 NW Wall Street, Bend, Oregon 97701. If no protest is filed within the protest period, this Notice of Intent to Award Contract becomes an Award of Contract without further action by the County unless the Board of County Commissioners for good cause, rescinds this Notice before the expiration of the protest period. The successful bidder on a Deschutes County project is required to execute three (3) copies of the Contract, which will be provided when the bids are finally determined. In addition to the execution of Contract, the contractor will be required to provide a performance bond, payment bond, and certificate(s) of insurance with endorsements naming Deschutes County as an additional insured. All contract copies will need to be returned to the County for execution. After all parties have signed the contract, a copy of the contract will be forwarded to the Contractor along with a notice to proceed.
