PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: On April 20, 2011, the Board of County Comissioners issued a Notice of Intent to award a services contract to Clean Harbors Environmental Services, Inc. for the operation of the County's household hazardous waste management program. The contract incudes the option, at the County's discretion, to extend the contract annually for up to two I-year extensions. Program operation during the first year of the contract with Clean Harbors have been very successful and within the established budget. Clean Harbors Environmental Services, Inc. has requested a 2.7% fee increase to cover cost increases related to program operation, primarily driven by fuel and waste management cost increases related to program oparation. FISCAL IMPLICATIONS: Funds have been budgeted in the Solid Waste Department budget for this project. RECOMMENDATION & ACTION REQUESTED: Staff recommends that the Board of County Commissioners authorize the amendment to Services Contract #2011-186 with Clean Harbors Environmental Services to extend the agreement for year two for the operation of the Household and Conditionally Exempt Generator Hazardous Waste Management Program. Except as provided herein, all other provisions of the contract remain the same and in full force. County's performance hereunder is conditioned upon Contractors compliance with provisions of ORS 279B.220, 279B.225, 279B.230, and 279B.235, which are hereby incorporated by reference. In addition Standard Contract Provisions contained in Deschutes County Code Section 2.37.150 are hereby incorporated by reference. Contractor certifies that the representations, warranties and certifications contained in the original Contract are true and correct as of the effective date of this Amendment and with the same effect as though made at the time of this Amendment. The above listed contract is amended as follows: Effective Date and Termination Date. The effective date of this Contract shall be May 1, 2011 August 10, 2012 or the date, on which each party has signed this Contract, whichever is later. Unless extended or terminated earlier in accordance with its terms, this Contract shall terminate when County accepts Contractor's completed performance or on July 31, 2012 July 31,2013, whichever date occurs last. Contract termination shall not extinguish or prejudice County's right to enforce this Contract with respect to any default by Contractor that has not been a..rred.
