Consideration of Board signature of Order 2012-024, designating certain real property as County Parks.

BACKGROUND AND POLICY IMPLICATIONS:
The Deschutes County Comprehensive Plan is a statement of issues, goals and policies meant to guide
the future of land use in this county. Chapter 1 Section 1.3 identifies three goals. Goal 3 contains
policies to manage county owned land for parks. The goal is to enhance and preserve public access
along rivers, streams or creeks and to preserve lands that contain significant wildlife, scenic or open
space values. According to this policy, the Board of County Commissioners should designate county
owned lands that meet those criteria as park land, where feasible.
ORS 275.320 authorizes counties to designate, by order, any real property acquired for delinquent taxes
or otherwise as county forests, public parks or recreational areas.
Starting in 1994, Deschutes County began to designate certain sensitive properties along rivers, creeks
or streams or with wildlife, wetland or other values, as park lands. There are approximately 385 acres
(70 properties) designated as park land in Deschutes County.
A review of the county land inventory revealed eight parcels (total 3.06 acres) that could qualify as park
land.
• Located near the Little Deschutes River
• Located within the Local Wetland Inventory
• Located adjacent to parcels designated park lands by earlier Orders
• Will enhance and preserve public access to the river
If the Board of County Commissioners signs this Order, it will consolidate county park land and
comply with the policy to manage county-owned lands to enhance public access to the river and
preserve lands with valuable resources.
FISCAL IMPLICATIONS: None.

An Order Designating Certain Real Property as *
County Parks To Be Used Exclusively for Public * ORDER NO. 2012-024
Purposes. *
WHEREAS, Deschutes County has acquired title to certain real property pursuant to real property tax
foreclosure proceedings on file in the Circuit Court of the State of Oregon, which is located near to rivers,
creeks and streams, and which may contain wildlife sensitive habitat and riparian areas; and
WHEREAS, Deschutes County through its Comprehensive Plan has recognized and declared the need
to protect and preserve public access and land along rivers, creeks and streams and public properties possessing
wildlife sensitive habitat and riparian areas, and
WHEREAS, ORS 275.320 provides that Deschutes County may designate county owned lands as public
parks; and
WHEREAS, the Board of County Commissioners find that the preservation and protection of certain
County owned real properties for public access, recreation and habitat preservation is in the public interest; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY
ORDERS as follows:
Section I. That the real property described in Exhibit "A," attached hereto and by this reference
incorporated herein, be designated County Parks for public purposes, pursuant to ORS 275.320.
Section 2. That said real properties be retained in public ownership and managed to the extent feasible
for the enhancement of public access and protection of wildlife habitat.
