Consideration of signature of Document 2011-002, a Lease Amendment between Deschutes County,
Lessor, and Munchkin Manor Preschool, Lessee.

BACKGROUND AND POLICY IMPLICATIONS:
Munchkin Manor Daycare & Preschool has leased space at the Mike Maier Services Building since
2005. The lease expires March 31, 2011; this is a five-year extension. In addition, we are updating all
county leases to include language to limit the use of the leased premises address.
FISCAL IMPLICATIONS:
None. In exchange for rent, Lessee offers priority for open daycare slots first to county emplyees, then
state employees who are housed as tenants in county facilities, then to the general public.
RECOMMENDATION & ACTION REQUESTED:
Staff recommends signature of Document 2011-002.

LEASE AMENDMENT
THIS LEASE AMENDMENT is made and entered into by and between DESCHUTES
COUNTY ("Lessor") and MUNCHKIN MANOR PRESCHOOL AT THE COUNTY, LLC ("Lessee").
WITNESSETH:
WHEREAS, Lessor and Lessee entered into a Lease (DC 2005-019) with an effective date
of June 1, 2005, for property located at 1130 NW Harriman, Bend, Deschutes County, Oregon, and
WHEREAS, Lessor and Lessee entered into Amendments To Lease Agreement (DC 2006-
388 and DC 2008-104) to extend the term of the lease and to make other changes, and
WHEREAS, Lessor and Lessee wish to once again extend the term of the Lease and make
other changes;
NOW, THEREFORE, Lessor and Lessee agree that the Lease is hereby amended to read
as follows:
1. Section 1. Term. The term of this Lease shall be effective June 1, 2005, and shall
continue through March 31, 2016.
2. Section 4. Use of Premises. Lessee shall use the Premises principally for operation
of a childcare center and preschool, together with administrative offices, storage, and other
lawful purposes related to the conduct of its childcare center and preschool business.
Lessee, its principals or agents shall not use the Premises to operate a business other than
that specified in this Lease and shall not use the Premises address as the business or
mailing address for any other business than that specified in this Lease without obtaining the
Lessor's written consent in advance. In addition, when the premises is not being used for
childcare and preschool, Lessee shall allow the nonprofit organization Mary's Place to use
the premises for supervised visits and monitored exchanges for parents going through divorce
or separation when issues of child custody are involved.
In all other respects the Rental Agreement shall be and remain in full force and effect.
