PUBLIC HEARING ON THIS DATE? NO. BACKGROUND AND POLICY IMPLICATIONS: There are several power poles located on Rickard Road (classified as a rural collector) east of Gosney Road that are too close to the pavement and are a liability for the County if they would ever be hit by a motorist. The County has a policy of maintaining a 10 foot clear zone from the edge of the travel lane on County roads and several of these poles are within 2 - 3 feet of the travel lane (see attached photo). The Road Department worked with Central Electric to get these poles relocated back to the edge of the right-of-way but when research was done on the existing right-of-way, it was discovered that the width of the right-of-way was only 40 feet, 20 feet each side of centerline. Based on this information, it was determined that unless we acquired another 10 feet of right-of-way, we would be unable to move the poles out of the clear zone. Normal right-of-way width for County roads is 60 feet therefore this right- of-way will be needed in the future if the road is ever widened out to current collector road standards. FISCAL IMPLICATIONS: The County will be responsible for the cost of the right-of-way acquisition and Central Electric will move the poles at their own expense. The right-of-way acquisition cost is estimated to be approx. $9,000 for the two parcels and this amount is budgeted in the 2010-2011 FY. RECOMMENDATION & ACTION REQUESTED: Move approval of Board Signature on Resolution No. 2011-014, approving the acquisition of right-of- way on Rickard Road ATTENDANCE: George Kolb, County Engineer DISTRIBUTION OF DOCUMENTS: Copy to Sheila Odle (ext. 7148) at the Road Department REVIE '7(21d44- LEGAL 7 d,4 -LEGAL COUNSEL For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Approving the Acquisition of Right -of -Way on Rickard Road for the relocation of power poles * * RESOLUTION NO. 2011-014 WHEREAS, by virtue of the laws of the State of Oregon as set forth and defined in Oregon Revised Statutes, Deschutes County is authorized and empowered to acquire by purchase, agreement, donation or by the exercise of the power of eminent domain, real property, or any right or interest therein, including any easement or right-of-way, for the construction, extension, alteration, widening, straightening or otherwise changing of any roads, highways, bridges or approaches within Deschutes County; and WHEREAS, for the purpose of relocating existing power poles away from the edge of pavement and out of the Clear Zone on Rickard Road; and WHEREAS, for the purpose of performing said work, it is necessary to acquire additional right-of-way as set forth in Exhibit "A" attached hereto and incorporated herein by reference; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. The Board hereby finds and declares that there is needed and required for the construction improvement and betterment of the Deschutes County road system, particularly the relocation of the power poles on Rickard Road, certain interests in, or fee simple title to, certain parcels of real property, as more particularly described in Exhibit "A" attached hereto and incorporated herein by this reference. Section 2. That the specified section of highway and the highway facilities for which said parcels of real property are proposed to be acquired, will be planned, designed, located and constructed in a manner which will be most compatible with the greatest public good and the least private injury. Section 3. That Deschutes County Road Department is hereby authorized to negotiate with the owners of the subject parcels for the acquisition by County of all right, title and interest in and to said parcels, free and clear from any liens or encumbrances and subject to final approval by the Board of County Commissioners of any proposed acquisition.
