BACKGROUND AND POLICY IMPLICATIONS:
Deschutes County cartography section discovered that although the parcel is carried in assessment
records as a tax lot parcel, it is maintained by the county road department. It is identified as a road on
survey CS03253 dated October 23, 1970. The parcel was dedicated to the public for road purposes by
deed dated January 11, 1972, but was never accepted by Deschutes County pursuant to ORS 92.014.
This Acceptance of Deed will correct that deficiency. County Engineer George Kolb confirmed that
this is the appropriate action.
FISCAL IMPLICATIONS:

RECOMMENDATION & ACTION REQUESTED:
Staff recommends signature of Document 2011-319.

ACCEPTANCE OF DEED
For Recording Stamp Only
WHEREAS, CLAUDINA BUNTING, dedicated a parcel of real property to the Public for road
purposes by deed dated January 11, 1972, attached as Exhibit "A," attached hereto and by this reference
incorporated herein; and
WHEREAS, said deed was recorded January 18, 1972, with the County Clerk at Volume 181,
Page 603 of the deed records; and
WHEREAS, said deed has not yet been accepted by the County pursuant to ORS 92.014; and
WHEREAS, said real property deeded to the Public has been continuously used by the Public as
public road right of way; now, therefore,
DESCHUTES COUNTY, ACTING BY AND THROUGH ITS BOARD OF COMMISSIONERS,
DOES HEREBY ACCEPT THE FOREGOING DEED, DESCRIBED ABOVE, AS PUBLIC ROAD RIGHT
OF WAY PURSUANT TO ORS 92.014.

CLAUDINA BUNTING hereinafter called grantor grants
an easement to THE PUBLIC for right of way purposes described
as follows:
A 60 foot roadway running North and South through the
center of the West Half of the Northwest Quarter of
Section 32, Township 17 South, Range 13, E.W.M., being
3.6 acres more or less and being more particularly
described as follows: Starting at the corner to
Sections 29, 30, 31, and 32, Township 17 South, Range
13 East, W.M., said corner being an existing galvpipe
set in concrete; thence S. 89° 54' 04" E., 661.54 feet
more or less along the line common to Sections 29 and 32,
Township 17 South, Range 13 East, W.M. to the mid point
of the North line of the West Half of the Northwest
Quarter of Section 32, Township 17 South, Range 13 East,
W.M., and being the true point of beginning for the
following described 60 foot roadway, lying and being 30
feet Easterly and Westerly of the following described
center line:
Thence S. 0° 06' 44" E., 181.66 feet to the
beginning of a 19.98887 degree curve to the right; thence
along the arc of said 19.98887 degree curve 140.91 feet
to the end of said curve, the long chord of said curve
bearing S. 13° 58' 17" W., 139.50 feet; thence S. 28° 03'
17" W., 48.10 feet to the beginning of a 54.97007 degree
curve to the left; thence along the arc of said 54.97007
degree curve, 102.48 feet to the end of said curve, the

E., 2,008.08 feet more or less to a point, being the mid
point of the South line of the West Half of the Northwest
Quarter of Section 32, Township 17 South, and being the
end of the above described road center line.
