A public hearing to hear an Appeal (A-II-3) by John W. Russell of the Hearings Officer's decision
denying a request ofa Lot of Record Verification. File No. A-11-3 (A-l1-1 and LR-1O-8).
PUBLIC HEARING ON THIS DATE? Yes
BACKGROUND AND POLICY IMPLICATIONS:
Before the Board is an appeal filed by the applicant, John W. Russell, who is represented by his
attorney, Mr. Robert Lovlien. The appeal is in response to the Hearings Officer's decision, file nos. A
ll-I and LR-l 0-8, denying the applicant's verification of a legal Lot of Record. The applicant's appeal
requests the Board reverse the Hearings Officer's decision. The Board accepted review of this appeal
via Order No. 2011-019. Based on the Order adopted by the Board, the appeal will be heard de novo.

FISCAL IMPLICATIONS:
None
RECOMMENDATION & ACTION REOUESTED:
The Board needs to hold a de novo public hearing and make a decision based on the record, and the
written and oral testimony to be presented.
