Approve signature of Resolution No. 2011-138 Approving Formation of a New Countywide 911
Service District the Deschutes 911 County Service District -and the Withdrawal of Territory from the
Existing Deschutes County 911 Service District Upon Voter Approval of the New District.

BACKGROUND AND POLICY IMPLICATIONS:
Resolution No. 2011-138 approves the Countywide Law Enforcement District Territory and includes it
in a new Countywide 911 Service District which is also on the agenda for the Board's examination
today. (Please see the Agenda Request for Order No. 2011-027.) Resolution No. 2011-138 must be
accepted before the Board hears Order No. 2011-027.

ACTING AS THE GOVERNING BODY OF
THE COUNTYWIDE LAW ENFORCEMENT DISTRICT

District Upon Voter Approval of the New *
District. *
WHEREAS, in order to create a more stable funding source for emergency communication
services by establishing a new permanent tax rate, Deschutes County proposes to form the Deschutes
9-1-1 County Service District {'New District") a new countywide service district to provide emergency
communications services; and,
WHEREAS, Deschutes County also proposes to simultaneously withdraw the territory of the
existing Deschutes County 9-1-1 Service District ("Existing District") that is within Deschutes County;
and
WHEREAS, a portion ofthe Existing District is within Jefferson County that will remain in the
Existing District upon formation of the New District; and
WHEREAS, upon formation of the New District and withdrawal of the territory from the
Existing District, the Board of County Commissioners ("Board"), acting also as the governing body of
the Existing District will initiate the procedures to merge the two districts; and,
WHEREAS, the Countywide Law Enforcement District finds that the formation of the New
District is in the best interest of the citizens; now, therefore;
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, ACTING AS THE GOVERNING BODY OF THE COUNTYWIDE LAW
ENFORCEMENT DISTRICT, as follows:

~~~. Pursuant to ORS 451.605(3), the Countywide Law Enforcement District approves
and endorses the formation of the New District for emergency 9-1-1 communications, the withdrawal
of territory from the existing district within Deschutes County upon voter approval of the new district,
and the merger of the remaining Existing District with the New District upon voter approval of the
New District.
