DATE: January 5, 2010 FROM: Teresa Rozic Property & Facilities 385-1414 TITLE OF AGENDA ITEM: Consideration of signature of Document No. 2010-025, a Bargain and Sale Deed to Trevor Wigle and Kristin C. Wigle. PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: Staff received an offer from Mr. and Mrs. Wigle, the adjacent property owner, to purchase tax lot 161231-00-00417 (a 30' x 330' strip), which was acquired by Deschutes County by foreclosure for nonpayment of property taxes. ORS 275.225 authorizes a private sale if the parcel is unbuildable and has a market value of less than $15,000. According to Assessor's records, the current real market value of the lot is $190.00. Road Department has no objection to disposing of the parcel by private sale. At their work session January 4, 2010, the Board directed staff to proceed with the sale. ORS 275.225(3) requires that the sale take place not earlier than 15 days after public notice of the private sale. Staff will arrange for publication in the Bend Bulletin as soon as possible. The buyers paid a $1,000 non-refundable processing fee and signed a Sale and Purchase Agreement. They have paid the full purchase price in advance of receiving the deed. FISCAL IMPLICATIONS: Purchase price of $190 and the $1,000 processing fee. RECOMMENDATION & ACTION REQUESTED: Staff recommends signature of Document 2010-025, AND CLOSING THE TRANSACTION NOT EARLIER THAN 15 DAYS AFTER PUBLIC NOTICE OF THE PRIVATE SALE.
