Nichols Community Services Manager Signature of DLCD Grant Program Manager Department of Land Conservation and Development Deschutes County 2009-20 II General Fund TA Grant Agreement Date Date Page 2 of 11 TA-R-II-158 DEPARTMENT OF LAND CONSERVATION AND DEVELOPMENT SPECIAL AWARD CONDITIONS Subject to the debt limitation of Oregon counties set forth in Article XI, Section 10, of the Oregon Constitution, and contingent upon funds being appropriated therefore, Grantee agrees to the provisions below. 1. Grantee agrees that this grant, number TA-R-1l-158, to Deschutes County supports the work described in the Grantee's grant application, which is incorporated into this grant agreement as Attachment A-Grantee Grant Application and Narrative. Where the terms of this grant agreement and proposal differ, the terms of this grant agreement shall prevail. 2. Grantee agrees that all reports, studies, and other documents (referred to herein as "product(s)") under this grant agreement must indicate on their cover or the title page an acknowledgement of the financial assistance provided by the DLCD. 3. Grantee agrees to identify the location of the originals, if the submittal is a copy. 4. Grantee agrees that if a product(s) is a one-of-a-kind document, it will identify the location of the original. 5. Grantee agrees to coordinate closely with the DLCD Grant Manager regarding the selection and approval of the facilitator (consultant) designated by the grantee to perform all, or a portion of the work under grant. 6. Grantee agrees to first obtain DLCD approval before contacting, and locally approving a facilitator (consultant) to perform all, or a portion, of the work under the grant. 7. Grantee agrees to complete the following Work Plan by March 31, 2010: a. Identify by name, address, telephone, and email address, those person(s) who will be performiog the work under the grant and which grant tasks they will work on. b. Provide a detailed, written explanation of the process that will use to perform the work under this grant. c. Provide a copy of any Request for Proposal (RFP) for consulting services, as well as a copy of any contract with consultants selected including the scope of work. d. List benchmarks, or progress indicators, for each grant product(s). e. Provide a specific and descriptive explanation of each grant product. 8. Grantee agrees in performiog work under this grant, to ensure consistent, coordinated use of population, employment, housing, and land needs projections associated with any post- acknowledgment plan and land use regulation amendments proposed by the grantee. 9. Grantee agrees in performiog work under this grant, develop and recommend multiple methods to hold sites for the intended use beyond plan designation and zoning, including the benefits and burdens of each method and the circumstances most appropriate for the method. One or more method must include county adoption of comprehensive plan policies under ORS 195.025 "Regional coordination of Planning Activities". Grantee agrees in performing work under this grant, to develop as part of Grant Product 3 (as described in Grant Application and Narrative Task 3,4, and 5) sample UGB amendment fIndings to support the UGB inclusion of identifIed and qualifying sites as determined by the large-lot industrial regional Economic Opportunities Analysis recommended comprehensive plan policies. 11. Grantee agrees to coordinate and provide notice to DLCD, all cities in the three-county area of Deschutes County, Jefferson County and Crook County; Confederated Tribes of the Warms Springs Indian Reservation, other agencies, and organizations listed in Attachment A of the Grant Application and Narrative of public meeting(s), workshop(s), work session(s), andlor hearing(s) to develop, review or approve products prepared under this grant. . 12. Grantee agrees to submit a written report with each interim payment request that describes the progress to date on each grant product(s) undertaken during the billing period. Other written or verbal progress reports will be provided upon reasonable request by the DLCD Grant Manager. 13. Grantee agrees the final draft product(s) (i.e., ordinances, maps, websites, databases, supporting documents, and photographs) shall be hearings ready draft quality. 14. Grantee agrees to no more than one interim payments and a final payment by DLCD during the term of this grant, and agrees that payments will be made only upon submittal of qualifying product(s) in accordance with the terms ofthis grant agreement. 15. Grantee agrees and understands that grant payments under this agreement will be reduced by up to thirty percent (30%), in consultation with grantee, if grant products scheduled to be completed are not completed by its governing body by the timeline provided in Special Award Conditions Table. The total grant payments under this grant agreement will not be reduced under this paragraph by more than $15,000.00. 16. Grantee agrees that the total reimbursement request for all the Grant Product(s) 1 through 2 (as described in Grant Application and Narrative Task 1 and 2) shall not exceed $31,000, and for Grant Product(s) 3 (as described in Grant Application and Narrative Task 3, 4, and 5) shall not exceed $19,000. The total reimbursement of all products shall not exceed $50,000. 17. Grant agrees to submit Economic Opportunities Analysis (EOA) materials according to the EOA specifIcations in Attachment-D. 18. Grantee agrees to comply with EOA standards and contents requirements per Attachment-D. EOA product(s) will comply with the Oregon Statewide PI arming Goal 9 -Economic Development requirements and OAR 660-09-0015 as defined in Attachment-D. 19. Grantee agrees to submit geographic information system (GIS) materials according to the GIS specifIcations in Attachment-E and to submit hard copy maps in addition. 20. Grantee agrees to comply with GIS standards and contents requirements per Attachment-E. GIS product(s) will comply with State of Oregon standards as defIned in Attachment-E. 21. Grantee agrees that DLCD may display appropriate product(s) on its web interface or corporate GIS data generated as part of this grant and any additional data provided that is not specifIcally restricted into state agency databases, acknowledging that the grantee and agents of the grantee are not responsible for the accuracy of said data. DLCD may also share the data specifIcally generated with grant funds with other agencies and organizations, as this is data that DLCD owns. Grantee agrees to not use or charge grant contract funds for consultant(s) trip expense(s), lodging, or any other expense submitted by consultant(s), except for the initial consultant(s) trip to the city and product( s) produced by consultant( s). 23. Grantee agrees to not use or charge grant contract funds for all scheduled or non-scheduled meetings, hearings, and notices. The grantee may use its own funds, or in-kind contributions. 24. Grantee agrees to provide copies of all fInal product(s) produced under this grant to DLCD in the manner described in the following Special Award Conditions Table and in Attachment A. 25. Grantee agrees to perform the following activities described in further detail in the Special Award Conditions Table below and the Grantee's application (Attachment A). Department of Land Conservation and Development Deschutes County 2009-20 11 General Fund TA Graul Agreement Due Datel Target Date 06/30/2010 02/0112011 05/3112011 Totals Reimbursement Amount $31,000 $19,000 $50,000.00 Page 6 of 11 TA-R-II-158 DEPARTMENT OF LAND CONSERVATION AND DEVELOPMENT STANDARD AWARD CONDITIONS Subject to the debt limitation of Oregon counties set forth in Article XI, Section 10, of the Oregon Constitution, and contingent upon funds being appropriated therefore, Grantee agrees to the provisions below. 1. DLCD Funds: DLCD certifies that on the effective date of this grant sufficient funds are available and authorized. 2. Reporting: At any time during the grant peliod, when requested by the DLCD Grant Manager, Grantee shall provide a written report on the status and progress of work performed under this grant. 3. Payments: DLCD payments to Grantee under this grant agreement shall be made in accordance with the grant payment schedule described in the "Special Award Conditions Product( s), Activities, or Payments Table" of this agreement. Payment is contingent upon DLCD's acceptance of the product(s) produced under the grant. Grantee agrees that reimbursement of all amounts requested by Grantee is contingent upon compliance with all the terms and conditions of this grant agreement. 4. Penalty: Payments to Grantee may be withheld or reduced ifDLCD determines that work performed under the grant is unsatisfactory, based on the best professional judgment of the DLCD Grant Manager, or if one or more telIDS or conditions of this agreement have not been met to the extent provided by law. 5. Ownership of Work Product(s). a. Definitions. As used in this Paragraph 5 and elsewhere in this agreement, the following terms have the meanings set forth below: i. "Grantee Intellectual Property" means any intellectual property owned by Grantee and developed independently ii-om the Project. ii. "Third Party Intellectual Property" means any intellectual property owned by parties other than DLCD or Grantee. iii. "Work Product(s)" means every invention, discovery, work of authorship, trade secret or other tangible or intangible item and all intellectual propelty rights therein that Grantee is required to deliver to DLCD pursuant to the Project. b. Original Works. All Work Product(s) created by Grantee pursuant to the Project, including derivative works and compilations, and whether or not such Work Product(s) is considered a work made for hire or an employment to invent, shall be the exclusive property ofDLCD. DLCD and Grantee agree that such Oliginal works of authorship are "work made for hire" of which DLCD is the author within the meaning of the United States Copytight Act. If for any reason the original Work Product(s) created pursuant to the Project is not "work made for hire," Grantee hereby irrevocably assigns to DLCD any and all of its rights, title, and interest in all Oliginal Work Product(s) created pursuant to the Proj ect, whether atising ii-om copyright, patent, trademark, trade secret, or any other state or federal intellectual property law or doctrine. Upon DLCD's reasonable request, Grantee shall execute such further documents and instruments necessary to fully vest such rights in DLCD. Grantee forever waives any and all rights relating to original Work Product( s) created pursuant to the Proj ect, including without limitation, any and all rights arising under 17 USC § 1 06A or any other rights of identification of authorship or rights of approval, restriction or limitation on use or subsequent modifications. i. In the event that Work Product( s) created by Grantee under this agreement is a derivative work based on Grantee Intellectual Property, or is a compilation that includes Grantee Intellectual Property, Grantee hereby grants to DLCD an irrevocable, non-exclusive, perpetual, royalty-free license to use, reproduce, prepare derivative works based upon, distribute copies of, perform and display the pre-existing elements ofthe Grantee Intellectual Property employed in the Work Product(s), and to authorize others to do the same on DLCD's behalf ii. In the event that Work Product( s) created by Grantee under this agreement is a derivative work based on Third Party Intellectual Property, or is a compilation that includes Third Party Intellectual Property, Grantee shall secure on DLCD's behalf and in the name ofDLCD an in'evocable, non-exclusive, perpetual, royalty-free license to use, reproduce, prepare delivative works based upon, distribute copies of, perform and display the pre-existing elements of the Third Party Intellectual Property employed in the Work Product(s), and to authorize others to do the same onDLCD's behalf. d. Grantee Intellectual Property. In the event that Work Product(s) is Grantee Intellectual Property, Grantee hereby grants to DLCD an irrevocable, non-exclusive, perpetual, royalty-fi'ee license to use, reproduce, prepare derivative works based upon, distribute copies of, perform and display the Grantee Intellectual Property, and to authorize others to do the same onDLCD's behalf e. Third Party Works. In the event that Work Product(s) is Third Patty Intellectual Property, Grantee shall secure onDLCD's behalf and in the name ofDLCD, an ilTevocable, non-exclusive, perpetual, royalty-free license to use, reproduce, prepare derivative works based upon, distribute copies of, pelform and display the Third Party Intellectual Property, and to authorize others to do the same on DLCD's behalf. 6. Indemnity. a. GENERAL INDEMNITY. GRANTEE SHALL DEFEND, SAVE, HOLD HARMLESS, AND INDEMNIFY THE STATE OF OREGON AND DLCD AND THEIR OFFICERS, EMPLOYEES AND AGENTS FROM AND AGAINST ALL CLAIMS, SUITS, ACTIONS, LOSSES, DAMAGES, LIABILITIES, COSTS AND EXPENSES OF ANY NATURE WHATSOEVER, INCLUDING ATTORNEYS FEES, RESULTING FROM, ARISING OUT OF, OR RELATING TO THE ACTIVITIES OF GRANTEE OR ITS OFFICERS, EMPLOYEES, SUBCONTRACTORS, OR AGENTS UNDER THIS CONTRACT. Department of Land Conservation and Development Deschutes County 2009-2011 General Fund TA Grant Agreement Page 8 of 11 TA-R-II-158 b. INDEMNITY FOR INFRINGEMENT CLAIMS. WITHOUT LIMITING THE GENERALITY OF SECTION 6.a, GRANTEE EXPRESSLY AGREES TO DEFEND, INDEMNIFY, AND HOLD DLCD, THE STATE OF OREGON AND THEIR AGENCIES, SUBDNISIONS, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES HARMLESS FROM ANY AND ALL CLAIMS, SUITS, ACTIONS, LOSSES, LIABILITIES, COSTS, EXPENSES, INCLUDING ATTORNEYS FEES, AND DAMAGES ARISING OUT OF OR RELATED TO ANY CLAIMS THAT THE WORK, THE WORK PRODUCT(S) OR ANY OTHER TANGIBLE OR INTANGIBLE ITEMS DELNERED TO DLCD BY GRANTEE THAT MAY BE THE SUBJECT OF PROTECTION UNDER ANY STATE OR FEDERAL INTELLECTUAL PROPERTY LAW OR DOCTRINE, OR DLCD'S USE THEREOF, INFRINGES ANY PATENT, COPYRIGHT, TRADE SECRET, TRADEMARK, TRADE DRESS, MASK WORK, UTILITY DESIGN, OR OTHER PROPRIETARY RIGHT OF ANY THIRD PARTY; PROVIDED, THAT STATE SHALL PROVIDE GRANTEE WITH PROMPT WRITTEN NOTICE OF ANY INFRINGEMENT CLAIM. c. CONTROL OF DEFENSE AND SETTLEMENT. GRANTEE SHALL HAVE CONTROL OF THE DEFENSE AND SETTLEMENT OF ANY CLAIM THAT IS SUBJECT TO SECTIONS 6.a OR 6.b; HOWEVER, NEITHER GRANTEE NOR ANY ATTORNEY ENGAGED BY GRANTEE SHALL DEFEND THE CLAIM IN THE NAME OF THE STATE OF OREGON OR ANY AGENCY OF THE STATE OF OREGON, NOR PURPORT TO ACT AS LEGAL REPRESENTATIVE OF THE STATE OF OREGON OR ANY OF ITS AGENCIES, WITHOUT FIRST RECENING FROM THE OREGON ATTORNEY GENERAL, IN A FORM AND MANNER DETERMINED APPROPRIATE BY THE ATTORNEY GENERAL, AUTHORITY TO ACT AS LEGAL COUNSEL FOR THE STATE OF OREGON, NOR SHALL GRANTEE SETTLE ANY CLAIM ON BEHALF OF THE STATE OF OREGON WITHOUT THE APPROVAL OF THE ATTORNEY GENERAL. THE STATE OF OREGON MAY, AT ITS ELECTION AND EXPENSE, ASSUME ITS OWN DEFENSE AND SETTLEMENT IN THE EVENT THAT THE STATE OF OREGON DETERMINES THAT GRANTEE IS PROHIBITED FROM DEFENDING THE STATE OF OREGON, OR IS NOT ADEQUATELY DEFENDING THE STATE OF OREGON'S INTERESTS, OR THAT AN IMPORTANT GOVERNMENTAL PRINCIPLE IS AT ISSUE AND THE STATE OF OREGON DESIRES TO ASSUME ITS OWN DEFENSE. 7. Termination: a. DLCD's Right to Terminate at its Discretion. At its sale discretion, DLCD may terminate this Grant Agreement: i. For its convenience upon thirty (30) days' prior written notice by DLCD to Grantee; ii. Immediately upon written notice ifDLCD fails to receive funding, appropriations, limitations, allotments or other expenditure authority at levels sufficient to allow DLCD, in the exercise of its reasonable administrative discretion, pay for the work or product( s) hereunder; or iii. Immediately upon written notice if federal or state laws, regulations, or guidelines are modified or interpreted in such a way that the DLCD's financial assistance under this Grant Agreement is prohibited or DLCD is prohibited from paying for the work or product( s) hereunder from the planned funding source. In addition to any other rights and remedies DLCD may have under this Grant Agreement, DLCD may terminate this Grant Agreement innnediately upon written notice by DLCD to Grantee, or at such later date as DLCD may establish in such notice, or upon expiration of the time period and with such notice as provided below, upon the occurrence of any of the following events: i. Grantee is in default because Grantee institutes or has instituted against it insolvency, receivership or bankruptcy proceedings, makes an assignment for the benefit of creditors, or ceases doing business on a regular basis; ii. Grantee is in default because Grantee commits any material breach or default of any covenant, warranty, obligation or agreement under this grant agreement, fails to perfOlm any of its obligations under this grant agreement within the time specified herein or any extension thereof, or so fails to pursue its work hereunder as to endanger Gl'antee's performance under this grant agreement in accordance with its terms, and such breach, default or failure is not cured within fomieen (14) calendar days after DLCD's notice, or such longer period as DLCD may specifY in such notice. c. Grantee's Right to Terminate for Cause. Grantee may telminate this grant agreement with written notice to DLCD upon the occurrence of the following events: i. DLCD is in default because DLCD fails to pay Grantee any amount due pursuant to the tenns of this grant agreement, and DLCD fails to cure such failure within thirty (30) calendar days after Grantee's notice or such longer period as Grantee may specifY in such notice; or ii. DLCD is in default because DLCD commits any material breach or default of any covenant, warranty, or obligation under this grant agreement, fails to perform its commitments hereunder within the time specified or any extension thereof, and DLCD fails to cure such failure within thiliy (30) calendar days after Grantee's notice or such longer period as Grantee may specifY in such notice. d. Return of Property. Upon telTllination of this grant agreement for any reason whatsoever, Grantee shall innnediately deliver to DLCD all ofDLCD's propeliy (including without limitation any work or work product( s) for which DLCD has made payment in whole or in part) that is in the possession or under the control of Grantee in whatever stage of development and form of recordation such property is expressed or embodied at that time. Upon receiving a notice of telTllination of this grant agreement, Grantee shall innnediately cease all activities hereunder, unless DLCD expressly directs otherwise in such notice of telTllination. Failure to Comply: If a party fails to comply with any ofthe requirements or conditions of this agreement, the other may, without incurring liability, refuse to perform further pursuant to this agreement. DLCD shall make no further reimbursement to Grantee and Grantee shall upon demand by DLCD promptly repay DLCD all unexpended grant funds and grant funds expended in breach of this grant agreement. 9. Accounting and Fiscal Records: Using standard accepted accounting and fiscal records, the Grantee shall maintain records of the receipt and expenditure of all funds subject to this grant agreement for a period of tln'ee (3) years after the Closing Date, or for such longer period as may be required by applicable law or until the conclusion of any audit, controversy or litigation arising out of or related to this agreement, whichever date is later. Grant accounting records will be separately maintained from other accounting records. 10. Closeout report: The Grantee shall submit a closeout repOlt to DLCD within thllty (30) days after termination of the grant period. 11. Subsequent funding: Eligibility for subsequent funding is contingent upon receipt of such reporting by DLCD. 12. Closeout Payment: Reimbursement up to the total amount of remaining grant funds will be made upon submittal of all required grant product( s), up to and including those required for the final reimbursement, and a signed DLCD closeout form acceptable to DLCD. DLCD shall authorize payment to the Grantee within ninety (90) days of such submittal for all required work and grant product(s) that are accepted by the DLCD Grant Manager after review for compliance with the grant conditions. 13. Closeout Penalty: DLCD reserves the right to reduce or withhold final payment if a closeout report is submitted to DLCD after the thirty (30) days, as referenced in Standard Condition Number 8. 14. Audit: The Oregon Secretary of State, Attorney General of the State of Oregon and the Director ofDLCD or any other duly authorized representative ofDLCD shall have access to and the right to examine any records of transactions related to this agreement for three (3) years after the final payment under this agreement is authorized by the department. 15. The memo states that large, ready-to-go industrial sites have been one of the state's most significant development challenges in the last few years and that OBDD "supports the addition of large industrial sites, especially those of 100 to 200 net contiguous developable acres, to the state's industrial land inventory ... " This statewide large-lot industrial lands deficiency is suspected to be an issue in the Central Oregon region as well. Large industrial tracts, especially those with potential rail access, are rare or unavailable. Expanding and new industries seeking large-lot industrial sites in the Central Oregon region do not have an adequate supply of sites to select from. The purpose of this grant application is to address this regional large-lot industrial land supply issue through an economic opportunity analysis (EOA), as provided for in OAR 660, Divisions 9 and 24, to address regional large-lot industrial land needs. Approach The April 14, 2008 DLCD technical memorandum regarding the seven elements of an EOA will provide primary guidance. Through an EOA, a specific, unmet need for large-lot industrial uses in the region will be evaluated and documented. It will identify economic opportunities for large-lot industrial lands in the Central Oregon region and identify the necessary characteristics and features required of potential sites to accommodate those opportunities. As part of this characterization, the EOA will define what constitutes a large industrial lot or parcel in the Central Oregon market and will prioritize large-lot industrial opportunities that incorporate principles of sustainability and responsiveness to global climate change. An EOA of regional employment land needs will be required, factoring in the potential for large-lot industrial development at available and qualifying candidate sites in the region. The boundary or extent of this Central Oregon employment region will need to be established and defined. It will likely include Deschutes County, Jefferson County, Crook County and the cities of Bend, Culver, La Pine, Redmond, Prineville, Sisters and Madras within those counties. A new, regionally applicable strategy for large-lot industrial development for the Central Oregon study area will be developed. Department of Land Conservation and Development Deschutes County 2009-2011 General Fund TA Grant Agreement Attachment A Narrative Page 1 of8 TA-R-11-158 This TA Grant proposal assumes the work to conduct the regional EOA will be conducted by a planning consultant retained by Deschutes County according to all applicable procurement procedures. This application for Technical Assistance (TA) Grant funds is focused on a regional EOA for a specific land use -large-lot industrial. Based on the EOA's findings, local jurisdictions may choose to pursue future initiatives to develop large lot industrial uses through specific site selection and associated land use actions, e.g. urban growth boundary amendments, intended to implement the EOA's findings and respond to demonstrated market demand. The information contained within this Regional EOA for large-lot industrial sites is intended to satisfy the data assemblage and analysis directives of OAR 660-009-0015 (1) including "Cities and counties are strongly encouraged to analyze trends and establish employment projections in a geographic area larger than the planning area and to determine the percentage of employment growth reasonably expected to be captured for the planning area based on the assessment of community economic development potential pursuant to section (4) of this rule." As such, this information is strategiC empowerment that can be used by any participating jurisdiction with identified, qualifying candidate sites to pursue a UGB amendment without internalizing the additional burden of data (and trends) assemblage and analysis to substantiate the unmet regional need for large-lot industrial lands. This Regional EOA will establish and validate the unmet regional land need, identify community (infrastructure, housing and workforce, etc.) and site attributes necessary to satisfy the unmet land need, inventory areas within and adjacent to UGBs to identify available (if any) land supply and candidate UGB expansion sites that could potentially satisfy the demonstrated unmet regional land need, prepare Development Code provisions (including large-lot retention requirements) and Comprehensive Plan policies that support and nurture large-lot industrial land development, and provide sample UGB amendment findings to support the UGB inclusion of identified and qualifying candidate sites for large-lot industrial development. In summary, the work products from this TA grant project will be able to be used by various local jurisdictions aspiring to avail an entirely new site for large- lot industrial development. This information will not be in lieu of the standard burdens of proof and due diligence typically required to achieve a UGB amendment, BUT, it will provide very tailored, regional data and analyses necessary to satisfy OAR 660-009-0015 (1) to address regional unmet land needs demonstration. The provision of this uncommon (and currently unavailable) and rarely assembled/analyzed information and support materials can make a substantial difference in private property owner and local government decision- making whether or not to endeavor to address the regional unmet land need for large-lot industrial sites. Additionally, this TA project work scope and work products can serve as a model to be replicated in other regions of the state to help address similar unmet large-lot industrial land needs. Augmenting Work Currently Underway The first phase of the EOA process has been initiated under the auspices of the Department of State Lands (DSL). This grant application acknowledges and builds upon the tasks that DSL is currently undertaking while seeking grant funding support to implement the balance of EOA tasks necessary to satisfy the comprehensive requirements of a regional EOA investigation. This additional Phase 1 work includes coordination with economic development professionals, land use planners and local community representatives to identify future industrial development trends and scenarios focusing on the issues of: 1) In the Central Oregon region, what constitutes an appropriately sized large-lot industrial site (50, 75, 100, or 200 acres, for example) to effectively support state industrial recruitment efforts? 2) What is the threshold of minimum lot sizes that are acceptable to private ownership to engage their participation in large-lot industrial development? 3) What does the Regional EOA process avail in land supply that the conventional land supply marketplace does not/cannot; and 4) How does the Regional EOA focus on large-lot uses maintain connection and relevancy to emerging local and regional industrial development trends? These four issues must be resolved in a regionally collaborative fashion in order to avoid future compromises to the retention of large-lot industrial lands in the face of marketplace forces seeking short-term profits from smaller-lot development opportunities. For purposes of local match requirements, Task 1 expenses that have already been incurred are considered to be credited to the total EOA local match support for this grant request. Work Scope Note: Tasks 1.1-1.3 are currently being undertaken. Task 1: Statement of Regional Economic Development Objectives Task 1.1: Documentation of Regional Economic Development Outlook This initial step will establish the baseline information needed to articulate a regional perspective on economic development and employment opportunities in the region including: history of economic development activities in the region, trends and recent changes in industrial development and job growth; new opportunities for the region as indicated by the dynamics in select industrial/business sectors; regional and local economic development initiatives and business recruitment efforts; and local government business- support programs, associated Code and Plan updates and infrastructure investment plans. (NO FUNDING REQUESTED) Task 1.2: Study Area Defined The overview information gathered in Task 1.1 will reveal which communities and places within the 3-county area (Deschutes, Jefferson and Crook) have an interest in and institutional support for large-lot industrial development and resulting job creation. The cities of Bend, Culver, LaPine, Redmond, Prineville, Sisters and Madras are all candidates for inclusion in the study area and are considered to define the Central Oregon employment and business region. Additionally, these cities and counties are the subject of a concurrent "Central Oregon Rail Study'; the findings of which will be incorporated into this EOA The final identified study area will be comprised of all appropriately designated urban growth boundary (UGB) lands as well as lands abutting UGBs. The basis for defining the study area will be included in this task. (NO FUNDING REQUESTED) Task 1.4: LocallRegional Data Collection and Coordination. Create a Regional Advisory Committee (RAC) comprised of representatives from Deschutes County (applicant), other cities and counties within the study area and Economic Development in Central Oregon (EDCO) to: • Introduce the project and collect background information, including regional market data and existing information on industrial/employment sites and inventories. • Identify commonalities and differences in perspectives on the studies scope, the definition of "large-lot", mechanisms to retain large-lot status, and other aspects of the EOA and large-lot industrial uses (initial query on the four questions identified above). • Identify land use requirements and procedures needed to support future, local community implementation of EOA findings, conclusions and recommendations. Summary notes will be prepared of all meetings and a preliminary "white paper" report will be prepared identifying commonalities/differences in perspectives and issues to be discussed/resolved that would serve as the basis for a regional forum on large-lot industrial land development in Task 1.5. Task 1.5: Local/Regional Industrial Land Development Trends. Conduct an Industrial Land Development Forum among RAC members, economic development and land use professionals, state agency staff, and local/regional elected officials to identify future industrial development trends and scenarios focusing on the four issues described above. Building off the individual meetings in Task 1.4, the goal of the forum is to seek to achieve consensus on future industrial land development trends in Central Oregon that can serve as the foundation for other elements of the regional EOA. In essence, the forum is intended to answer the questions revolving around what large-lot industrial development means and how it functions now and in the future in the Central Oregon region (it is intended that the Central Oregon Economic Revitalization Team [COERT] will host this Forum). Based upon forum results, the EOA scope of work will be further refined (if necessary), including agreeing on roles and responsibilities, clarifying the time schedule and discussing any other outstanding issues. Schedule: Coordination meetings with economic development specialists, land use planners, elected officials and business leaders (Task 1.4) and the forum (Task 1.5) will occur within four months of TA Grant funding award. Strategic analysis and response to issues identified by COERT representing the interest or concems of state agency programs, regulations and processes. • Revisions to the EOA scope of work as needed. Task 2: Report on Trend Analysis and Suitability Requirements Approval of a UGB amendment requires demonstrating that the existing urban land supply is inadequate to satisfy an established land need and that more (site and type specific) land must be added to the UGB in order to address/satisfy the land need for the identified, specific land uses. The first step in this process is to identify the overall need. Task 2.1: Review National, State and Regional Economic Trends Review national, state and regional economic trend data, including but not limited to population and job forecasts for the 20-year planning period, unmet demand and commute pattems. The review will focus on regional, large-lot industrial/employment land needs including identifying existing economic development issues, projected trends, opportunities, constraints and needs. The method preferred by DLCD is to clearly articulate the communities' economic development objectives, examine the characteristics of available and potential sites within the study area for different kinds of employment uses, and examine the costs and risks of providing services to the sites. The development of detailed policies for managing the short- term supply of sites is recommended to all communities and required within an MPO. Task 2.2: Assess Economic Development Potential Assess economic development potential by analyzing factors such as workforce; availability of transportation facilities for access and freight mobility (including rail); access to suppliers and utilities; location, size, and buying power of markets; land costs; state and federal environmental protection laws; and service infrastructure. Incorporate economic opportunities and constraints into the analysis by describing how they affect future land demand. Department of Land Conservation and Development Deschutes County 2009-2011 General Fund TA Grant Agreement Attachment A Narrative Page 5 of8 TA-R-11-158 • Compile employment and wage data for the region, and conduct an industry clusters analysis to ascertain emerging economic development characteristics. • Describe site requirements for industrial/employment uses that are likely targets for regional, national and international business recruitment to the region in the short-term (5-year) and longer-term (20-year) planning horizons. • Assess regional economic development potential according to workforce, transportation and public services access and other opportunities and constraints regarding market and land use characteristics. Consider railroad-shipping strategies. Address the findings and conclusions of the Central Oregon Rail Plan. Evaluate the certified industrial sites within the study area. • Estimate total numbers of large-lot industrial/employment sites and acres needed in the study region/area for the 20-year planning period. Obtain information from state and regional economic development agencies. Explain the factors, data, assumptions, and conclusions used to estimate large-lot industrial/employment land demand for the 20- year planning period. This may be accomplished with assistance from OBDD site selection specialists and/or other suitable mechanisms. • Prepare a summary assessment of the demand and likely opportunities for large-lot industrial/employment development in the study region and how large-lot development of the most suitable site(s) can meet that demand in comparison to other available lands in the study region. Analyze the information gathered to estimate net land demand for industrial/employment land the study area for the 20-year planning period. Review summary assessment with Deschutes County, DLCD, COERT, the RAC, EDCO and other interested project partners. Task 2.3: Conduct Expert Interviews and Convene the Regional Advisory Committee Conduct up to 12 interviews with land and economic development/industrial recruitment experts to discuss: • The region's economic role within the state, national and global economy • Types of jobs/preferred growth clusters best suited for the region • Effects of changing regional demographic patterns on land needs Convene a meeting of the RAC to discuss interview results. Schedule: Complete interviews within eight weeks from the completion of Task 1. Department of Land Conservation and Development Deschutes County 2009-2011 General Fund TA Grant Agreement Attachment A Narrative Page 6 of8 TA-R-1l-158 Task 3: Identify and Evaluate Potential Sites Task 3.1: Inventory large lots for industrial/employment uses Convene the RAC to inventory, analyze and map the study region's existing supply of large- lot industrial/employment lands for acreage, development constraints, ownership patterns, and accessibility and other suitability and availability criteria to determine the readiness of the current land supply for large-lot industrial/employment development. The inventory will include the number, size and location of buildable properties available for large-lot use and the development potential for those properties, taking into account existing zoning and other environmental and property-related constraints, and the identified large-lot industrial site characteristics and infrastructure capabilities necessary to be competitive for national and international industrial/business recruitment. Examine the possibility of assembling adjacent vacant properties to establish large-lots. Examine the potential for redevelopment of existing sites, as required by EOA inventory standards. The candidate large-lot industrial site inventory information will be presented in an electronic format that is compatible with Deschutes County's GIS map standards. The report will consider whether land is ready in the short-term (ready for construction within one year of a building permit application or service extension request). The report will not provide a relative ranking or rating the candidate sites but rather will provide a listing and GIS mapping of eligible and qualifying candidate sites. Schedule: Twelve weeks from the completion of Task 1 Estimated Fee for Task 3: $8,000 Deliverables: GIS map and written report Inventory of suitable and qualifying candidate large-lot sites. Task 4: Comprehensive Plan and Zoning Review Review study region comprehensive plan policies, designations and associated zoning codes for consistency with regional economic development objectives, specifically to accommodate large-lot industrial/employment lands. Recommend changes if needed. This will include a range of specific policies and mechanisms to protect prime industrial/employment lands for desired uses. • Analyze and make suggested updates to existing policy and code requirements to implement the recommendations of the EOA. Develop policies that address targets for the type and location of industrial/employment uses. • Designate an adequate number of sites of suitable sizes, types and locations including Brownfield redevelopment areas • Develop policies regarding provision of needed public facilities, user recruitment and other relevant economic development strategies. Schedule: One month from the completion of Task 3 Estimated Fee for Task 4: $3,000 Deliverables: Recommended comprehensive plan policy and/or code text changes for specific jurisdictions as well as a generic set of recommended Plan and Code policies and standards supportive of large-lot industrial development. Review draft EOA with Deschutes County, DLCD and project partners. Convene a meeting of the RAC and other interested parties to review the draft EOA. Incorporate comments into public review draft EOA. Provide a variety of opportunities for public review, including the stakeholder meeting, web site postings, and presentations to local government bodies to gather feedback and guidance from the community on the public review draft EOA. Incorporate final comments from public review process into a final EOA. Participate in local, regional and state meetings to help ensure Regional EOA understanding (and appreciation) by participating jurisdictions, EDCO and state agencies including DLCD. Given that to date, no Regional EOA (especially for large-lot industrial sites) has been conducted or used within the Central Oregon region (or possibly the entire state), the conclusions, findings and ultimate utility of such information and resulting reference document may not be fully understood or appreciated by elected and appointed officials, property owners, local government and state agency staff. As determined by the RAC, present findings through a regional forum, report distribution or other appropriate venue to elected and appointed local government officials, local and state government staff, potentially affected property owners, and local, regional and statewide industrial recruitment and economic development staff, and business and land development (including real estate) professionals. The purpose for this presentation is to focus on and provide elected officials and private development interests an opportunity to learn about the EOA/study findings in a group forum where they can learn from professional experts, hear from others in the region, and express their own reflections including how the EOA can be used by their community. This presentation forum will promote local acceptance and use of the EOA/study findings. Schedule: Two months from the completion of Task 4.
