Construction of the Deschutes Recovery Center.

BACKGROUND AND POLICY IMPLICATIONS:
Deschutes County opened bids for construction of the Deschutes Recovery Center on Tuesday, Jan iary
12, 2010. The project consists of a 16 -bed mental health residential treatment center of approximately
7500 square feet and an outbuilding of approximately 300 square feet. The project also includes
parking, landscaping, and other site improvements as well as some off-site utility improvements.
The solicitation was conducted using the design -bid -build method (low bid). Eight bids were recei ved
(see attached bid tabulation sheet). HSW Builders, a firm based in Bend, Oregon, is the low bidder
with a bid of $1,397,500.
FISCAL IMPLICATIONS:
Deschutes County will enter into a contract for $1,397,500 once the protest period has expired. A
dedicated construction fund has been established for this project, which is being funded with a grant
from the State Mental Health Division and proceeds from a county bond issue.

A Resolution Adopting a Supplemental
Budget of the Deschutes County Budget for *
Fiscal Year 2009-2010 and Making Appropriations. *
RESOLUTION NO. 2010-006
WHEREAS, there are several funds in the Deschutes County 2009-2010 Budget that have
additional resources which were not ascertained at the time of the preparation of the budget whi :h
requires a change in financial planning; and
WHEREAS, these additional revenues and expenditures must now be appropriated; and
WHEREAS, ORS 294.480 authorizes the adoption of a Supplemental Budget; and
WHEREAS, Notice of Supplemental Budget Hearing and Summary was published in the
Bulletin on January 28, 2010; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUT'�S
COUNTY, OREGON, as follows:
Section 1. The Board of County Commissioners hereby adopts the attached Supplemental
Budget for Fiscal Year 2009-2010, marked as Attachment "A," attached hereto and by this reference,
incorporated herein.
Section 2. The amounts set forth in the Adopted Supplemental Budget are hereby appropria:ed
in the amounts set forth in Section 1 of this Resolution.
Section 3. That the Finance Director makes the appropriate modifications to the 2009-2010
Fiscal Year Budget to reflect the adoption of the Supplemental Budget as set forth in Section 1 of this
Resolution.

NOTICE OF INTENT TO AWARD CONTRACT
On February 3, 2010, the Board of County Commissioners of Deschutes County, Oregor,
considered bids for the above -referenced project. The Board of County Commissioners
determined that the lowest responsive bidder for the project was HSW Builders, LLC, of
Bend, Oregon, with a base bid of ONE MILLION THREE HUNDRED NINETY SEVEN
THOUSAND FIVE HUNDRED DOLLARS ($1,397,500.00).
This Notice of Intent to Award Contract is issued pursuant to Oregon Administrative Rule
(OAR) 137-047-0610. A copy of this Notice is being provided to each firm or person that
submitted a bid for the project. Any firm or person who believes that they are adversely
affected or aggrieved may submit to the Board of County Commissioners of Deschutes
County, Oregon, at the above address, a written protest of the County's intent to award
within seven (7) days after the issuance of this Notice of Intent to Award Contract. The
seven (7) day protest period will expire at 5:00 PM on Wednesday, February 10, 2010.
Any protest must be in writing and specify any grounds upon which the protest is based. If
a protest is filed, a hearing will be held at 10:00 a.m. on Wednesday, February 17, 2010.

Contract Review Board, in the Deschutes Services Center, 1300 NW Wall Street, Bend,
Oregon 97701.
If no protest is filed within the protest period, this Notice of Intent to Award Contract
becomes an Award of Contract without further action by the Board of County
Commissioners unless the Board, for good cause, rescinds this Notice before the
expiration of the protest period. The successful bidder on a Deschutes County project i:;
required to execute the Contract provided by the County when the bids are finally
determined. In addition to the execution of Contract, the contractor will be required to
provide a performance bond, payment bond, and certificate of insurance.

All contract copies will need to be returned to the County for execution. After all parties
have signed the contract, a copy of the contract will be forwarded to you along with a
notice to proceed.
