DATE: April 6, 2010 FROM: Dave Kanner Administrator ext. 6565 TITLE OF AGENDA ITEM: Consideration and authorization of County Administrator signature of Document No. 2010-237, a Memorandum of Understanding with the 9-1-1 County Service District for County internal services. PUBLIC HEARING ON THIS DATE? No. BACKGROUND AND POLICY IMPLICATIONS: In 2004, Deschutes County entered into a memorandum of understanding with the 9-1-1 County Service District for the provision of internal services such as personnel, accounting, payroll, information technology, etc. The 2004 MOU also stated that the County would bill 9-1-1 for these services using the same formulas as those used for billing County departments. However, County Legal Counsel was specifically excluded from the list of services for which 9-1-1 would be billed, stating instead that 9-1-1 could use County legal services and be billed for them at an hourly rate. T his has raised some confusion as to whether County Legal Counsel is also the District's legal counsel. 'This revised MOU clarifies that question and provides that the District will pay indirect service charges for County legal services beginning in FY 2011. FISCAL IMPLICATIONS: For FY '11, the District will be billed $20,255 (subject to change through the budget process) in internal service charges for legal services. This will be included in both the requested and proposed budgets. RECOMMENDATION & ACTION REQUESTED: Staff recommends Board authorization of County Administrator signature of Document No. 2010-237, a Memorandum of Understanding with the 9-1-1 County Service District for County internal servicer. ATTENDANCE: Dave Kanner, County Administrator DISTRIBUTION OF DOCUMENTS: Dave Kanner Andy Jordan, Interim Director, 911 Service District REVIEWED LEGAL COUNSEL For Recording Stamp Only MEMORANDUM OF UNDERSTANDING Document No. 2010-237 Deschutes County (County) and Deschutes County 911 Service District (District) agree: 1. County will provide District with the following services: a. IT support for desktop, email, internet, intranet network and software support for workstations, but not CAD, paging, radio or telephone; b. Legal; c. Building Services, including cleaning; d. Administrative Services; e. Accounting and payroll processing, accounts payable, cash receipts, investment of idle funds, budget preparation and administration, preparation of and coordination with outside auditors regarding the annual financial reports, coordination of audit committee activities and financial research as required; and f. Personnel administrative services, including without limitation, human resource assistance, administration of employee benefits, employment recruitment services, salary adjustments, maintenance of employee records and files and labor contract administration and negotiation. These services will by provided by County in the same manner and with the same effect as such services are furnished to other County departments, based upon County policies, procedures and practices. 2. County will charge District on a monthly basis for services described in 1, based upon the formulas used by the County for charging or billing County departments. County Legal Counsel shall be the District's attorney of record. 3. District will pay County for services described in 1 based upon the County's charges, as determined under 2. 4. Either on its own initiative or at District's request, County will consider modifying or discontinuing to provide to District one or more of the services listed in 1 above, provided, the decision whether to modify or discontinue such service(s) shall be solely within County's discretion. 5. This agreement shall be effective on and after July 1, 2010. If either party wishes to withdraw from this Memorandum, they agree to furnish the other party at least six (6) months advance written notice. 6. This agreement is signed by the County Administrator and Chair of the District Executive Board, each of whom has full authority to sign on behalf of their respective agency.
