Services 388-6584 TITLE OF AGENDA ITEM: A continuation of the pubic hearing from March 3, 2010 on Ordinance No. 2010-013, Amending ' 'itle 10, adding Chapter 10.06, to the Deschutes County Code to Regulate Bicycle Travel on Skyliners Road and Declaring an Emergency. PUBLIC HEARING ON THIS DATE? Yes. BACKGROUND AND POLICY IMPLICATIONS: Skyliners Road has been a popular location for events. Residents in the area have expressed commis about events and recreational cyclists that use Skyliners Road. At the February 8, 2010 public hearing, many residents submitted testimony about cyclists riding two or more abreast endangering publik: safety. The proposed ordinance would limit cyclists on Skyliners Road to ride single file unless when passing another cyclist, making a left turn or a U-turn, or when the cyclist is riding as a registered participant and in compliance with and conditions imposed on an event that has been specificall approved by the County. The Board of Commissioners asked the Bicycle and Pedestrian Advisory Committee (BPAC) tc provide input on this draft ordinance. BPAC will present their recommendations to the Board w the April 14, 2010 afternoon Work Session. FISCAL IMPLICATIONS: None. ATTENDANCE: Erik Kropp, Deputy County Administrator DISTRIBUTION OF DOCUMENTS: Erik Kropp For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Ordinance Amending Title 10, adding Chapter 10.06 to the Deschutes County Code to Regulate Bicycle Travel on Skyliners Road and Declaring an Emergency. * * ORDINANCE NO. 2010-013 WHEREAS, Title 10 of the Deschutes County Code concerns vehicle and traffic regulations on a id along roads subject to regulation by the County; and WHEREAS, Skyliners Road from approximately Mile Post 1.77 on the east at the Bend City Limits to and including approximately Mile Post 10.038 where the road reverts to U.S. Forest Service jurisdiction (her( in "Skyliners Road") is subject to County regulation as the road authority pursuant to ORS 810.010; and WHEREAS, The current conditions of Skyliners Road are that it is a narrow two-lane road with seve-a1 curves which provide limited visibility, poor pavement conditions and contains no bicycle lanes; and WHEREAS, due to its proximity near Bend, the relatively low motor vehicle usage and the nearby availability of ample parking at Summit High School, Skyliners Road has become a popular venue lbr recreational bicyclists, as well as for the organizers of competitive bicycling races and events; and WHEREAS, the purpose of this ordinance is to impose restrictions under ORS 810.030 which addrkss potential conflicts and safety risks on Skyliners Road between operators of motor vehicles and people riding bicycles, which become more acute when bicyclists ride side by side; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. AMENDMENT. DCC Title 10 is amended by adding a new Chapter 10.06 to read as described in Exhibit "A," attached hereto and by this reference incorporated herein. Section 2 EMERGENCY. This ordinance being necessary for the immediate preservation of Ihe public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. BICYCLE RESTRICTIONS ON SKYLINERS ROAD 10.06.010. Bicycle Restrictions on Skyliners Road. 10.06.020. Exceptions. 10.06.030. Signage 10.06.040 Violation 10.06.010. Bicycle Restrictions on Skyliners Road. Except as provided in Section 10.06.020, it shall be unlawful for the operator of a bicycle on Skyliners Road to ride alongside and in the same direction as another cyclist. (Ord. 2010-013 §1, 2010) 10.06.020. Exceptions. A person is not in violation of the offense under Section 10.06.010 if the person operates a bicycle alongside another cyclist in the same direction under any of the following circumstances: a. when overtaking and passing another cyclist; b. when preparing to execute a left turn or a U-turn; c. at such time as the cyclist is riding as a registered participant and in compliance with any conditions imposed on an event, which has been specifically approved by the County. The Director of the Road Department is authorized and directed to erect appropriate signs giving notice of the restrictions in Section 10.06.010 of this chapter consistent with the provisions of ORS 810.030 and the Manual on Uniform Traffic Control Devices, current edition.
