Legal 388-6623 TITLE OF AGENDA ITEM: Consideration and Approval of Order 2010-035 Order Appointing Members of the District Board of Commissioners of the Pinewood Country Estates Special Road District PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: On May 18, 2010, the Primary Election was held and the electors voted to form the Pinewood Coumry Estates Special Road district. In order for the District Board to proceed with the formation process, i:he District must have three members appointed to their Board. The Deschutes County Board of Count Commissioners needs to appoint such members to the District Board pursuant to the Petition for Formation dated November 5, 2009. FISCAL IMPLICATIONS: None. REVIEWED LEGIOUNSEL For Recordin• Stam• Onl BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Appointing Members of the District Board of Commissioners of the Pinewood Country Estates Special Road District * ORDER NO. 2010-035 * WHEREAS, on June 9, 2010, the Board of County Commissioners of Deschutes Coun y ("Board") declared the Pinewood Country Estates Special Road District ("District") formed; and, WHEREAS, ORS 371.318 and 317.330 authorize the Board to appoint the members of the District Board of Commissioners ("District Board"); and WHEREAS, on May 24, 2010, Chief Petitioner Terry Reed sent to County Legal Counsel a list of names for nomination for the District's first Board of Commissioners; and WHEREAS, the names listed were Terry Reed (one-year term), Leland (Lee) J. Landice (two- year term), John E. Carrigg, Jr. (three-year term), with Fred H. Seger as an alternate appointmert; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. Terry Reed is hereby appointed to the District Board for an initial term ending December 31, 2011; Leland (Lee) J. Landice is hereby appointed to the District Board for an initi al term ending December 31, 2012; and John E. Carrigg, Jr. is hereby appointed to the District Board fir an initial term ending December 31, 2013; each appointment being effective July 1, 2010.
