BACKGROUND AND POLICY IMPLICATIONS:
The US Department of Agriculture, Forest Service ("Forest Service") requests permission to enter
county -owned land to collect data about forest conditions and vegetation for the Forest Inventory a id
Analysis program. They wish to gather data on an 80 -acre vacant parcel that is about 9 miles east i .f
Sisters (see attached map). The information gathered in this inventory is combined with informatic n
collected from across the nation. Individual information is not released. The county forester has no
objection to the Forest Service performing this work.

Staff recommends signature of Document 2010-565.

LEGAL COUNSEL
RIGHT OF ENTRY
Deschutes County, hereinafter referred to as "Grantor", does hereby grant to USDA
Forest Service ("Forest Service"), its employees, agents, or contractors, the right and
license to go upon the real property described below for the following purposes:
Forest Inventory and Analysis: This survey will require one or more environmental
specialists to walk the project area and measure and mark trees and vegetation. No
ground disturbing activities will take place. Photographs may be taken.
The estimated time frame for the surveys above is mid-August to the end of December,
2010.
Property Description:
The East Half of the Northeast Quarter (E 1/2 NE 1/4) of Section Thirty -Six (36) in
township Fourteen (14) South, Range eleven (11) East of the Willamette Meridian,
Deschutes County, Oregon.
IT IS UNDERSTOOD AND AGREED that this right and license shall continue until
December 3, 2010, unless expressly revoked by Grantor before work is completed. It is
further understood that Forest Service shall, to the extent permitted by Oregon law, be
responsible for any damage arising from the activity of Forest Service, its officers,
employees, agents, or contractors on said land and exercise of rights under this Right of
Entry either by repairing such damage or, at the option of Forest Service, by making an
appropriate settlement with the above named in -lieu thereof.
Grantor hereby represents and warrants that he is the owner of said real property or
otherwise has the right to grant this permit for entry.
