DATE: November 5, 2010 FROM: Teresa Rozic Property & Facilities 385-1414 TITLE OF AGENDA ITEM: Consideration of signature of Document Number 2010-689, a letter to the Planning Director requesting approval of the final plat for a two -lot partition in the La Pine Industrial Site. PUBLIC HEARING ON THIS DATE? No BACKGROUND AND POLICY IMPLICATIONS: Deschutes County owns several tracts of industrial land in southern Deschutes County. The La Pine Industrial Group Inc. manages the land on behalf of the County and markets it to industrial service firms and light manufacturers that can create jobs in the community. Biogreen Sustainable Energy Co. ("Biogreen"), based in St. Helens, Oregon, wishes to purchase 19.5 acres in the northeast corner of Lot E of the La Pine Industrial Site (see attached map). Biogreen proposes to build and operate a biomass power facility. Deschutes County received approval for a partition to divide an approximate 49.37 -acre parcel into two parcels. Prior to final plat approval, we must dedicate road right-of-way and install sidewalks. We want final plat approval now so that Biogreen may apply for building permits, which will preserve funding commitments they have. According to Deschutes County Code Chapters 17.24.120 and 17.24.130, the Planning Director may approve the final plat before the required improvements are completed and accepted if the developer can provide a form of security, usually a bond. The County will complete the required improvements after Biogreen exercises its option to purchase the 19.5 -acre parcel. Staff does not believe that it is necessary to require the County to provide financial assurance to itself. FISCAL IMPLICATIONS: None. RECOMMENDATION & ACTION REQUESTED: Staff recommends Board signature of Document Number 2010-689. We have made application for the final plat. The County and Biogreen Sustainable Energy Co. entered into an Option Agreement which, if exercised, will allow Biogreen to purchase one of the two parcels. Biogreen plans to build a biomass power generation facility on the property. Biogreen must begin construction as soon as possible in order to preserve funding commitments from various sources. Deschutes County Code Chapter 17.24.120.B prohibits issuance of any building permits before the required improvements are completed and accepted by the County. According to DCC 17.24.120 and 17.24.130, the Planning Director may approve the final plat before the required improvements are completed and accepted if the developer can provide a form of security that is acceptable to the County. Given that the purpose of the security is to make the County whole in the event the County has to complete the required improvements instead of the developer and that the County will be completing the improvements in this case either way, the Board does not believe that it would be appropriate or necessary to require the County to provide financial assurance to itself. The Board of County Commissioners has authorized the expenditure of funds and the conditional conveyance of land specifically for the Biogreen project.
