NO BACKGROUND AND POLICY IMPLICATIONS: Order 2008-086 to accept this petition was approved on 12/15/08 and a public hearing was set for 1/5/09 to take public testimony and make a determination to approve or not approve the petition for the proposed restricted firearms district. FISCAL IMPLICATIONS: None. RECOMMENDATION & ACTION REQUESTED: Conduct a public hearing and make a determination to approve or not approve the petition. ORDER NO. 2008-086 WHEREAS, a petition requesting designation of certain territory as a restricted area pursuant !o Deschutes County Code section 9.08, referred to as the "Lazy River West No Shooting District" has been du'y filed with the County, a copy of which petition is attached hereto as Exhibit 1 and by this reference incorporated herein; and WHEREAS, the Deschutes County CIerk has verified that the no discharging of firearms distrit t petition was signed by no less than 60 percent of the registered voters of the subdivision included within the proposed restricted area; a copy of the Clerk's Certification is attached as Exhibit 2, and WHEREAS, a public hearing is required to consider the petition and notice of that hearing must b provided in accordance with ORS 198.857; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section L That a hearing on the designation petition be held on January 5, 2008, which petition may bti! referred to as the "Lazy River West No Shooting District." This petition is filed pursuant to Deschutes County Code (DCC), Title 9, Chapter 9.08. that is the principal Act for the district. 2. The purpose of the proposed district is to restrict the discharge of firearms. Said formation affects only Deschutes County, Oregon. 3. The territory subject to this petition is inhabited. 4. 'The description of the boundaries of the territory proposed to be included in the district is attached as Exhibit "A" and incorporated by reference herein. 5. A map of the proposed no shooting district is attached as Exhibit "B" and incorporated by reference herein 6.
