DATE: December 23, 2008 FROM: George Kolb Road Department 322-7113 TITLE OF AGENDA ITEM: Consideration of Signature of Order No. 2009-006, establishing four (4) roads as County Roads. PUBLIC HEARING ON THIS DATE? NO BACKGROUND AND POLICY IMPLICATIONS: By establishing these roads as "County Roads", the Board is accepting responsibility for all future maintenance costs of the roads. The roads to be established are Skyline Ranch Road (1.80 mi.), Metolius Drive (0.75 mi.), Spring River Road (1.75 mi.) and River Summit Drive (11.43 mi.) for a total of 15.73 mi. added to the system. Skyline Ranch Road and Metolius Drive were created as part of tl Le Tetherow Destination Resort land use application. The land use for this resort was approved prior tc the BOCC signing of Resolution 2006-049 which declared a suspension on the establishment of any new County Roads. River Summit Drive and Spring River Road are the portions of forest roads 40 ;and 45 that were improved to County standard through the Federal Highway Administration program. 'I his route was originally maintained by Sunriver but the County agreed to take over maintenance once tl e roads were improved to County standard. FISCAL IMPLICATIONS: The County accepts all future maintenance costs for these roads (the annual maintenance cost for paved arterial or collectors is $13,000 to $15,000 per mile). ORDER NO. 2009-006 WHEREAS, the rights -of- ways described in Section 1 are public rights -of -ways within unincorporated Deschutes County, Oregon; and WHEREAS, said rights -of -ways have been constructed to County Standards; and WHEREAS, the County Road Official has recommended that the Board of County Commissioners accept said rights -of -ways into the County Maintained System; and WHEREAS, the County may not expend road fund monies on said rights -of -ways unless said rights -of -ways are accepted into the County Maintained System; and WHEREAS, the Board of County Commissioners, in accordance with ORS 368.016, may by resolution or order make any public road within its jurisdiction a County Road; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the public rights -of -ways described in Exhibit "A", attached hereto and by this reference incorporated herein, be hereby established as County Roads. DATED this day of , 2009.
