DATE: January 20, 2009 FROM: George Kolb Road Department 322 -7113 TITLE OF AGENDA ITEM: Consideration of signature of Order No. 2009 -010, setting a construction speed limit of 30 mph for Deschutes Market Road at the location of the Deschutes Market Road overcrossing phase II project. PUBLIC HEARING ON THIS DATE? NO. BACKGROUND AND POLICY IMPLICATIONS: The Deschutes County Road Department is in the process of constructing the Deschutes Market Overcrossing Phase II project located off Deschutes Market Road. As part of this project, a temporary construction detour has been constructed to allow traffic to use Deschutes Market Road during the construction of the project without impacting the construction crews. Because of the high speed of traffic in this area, the contractor requested that a construction speed zone be installed to slow traffic: down and increase safety in and around the work area. After review of the plans, it was decided to have a construction speed zone of 30 mph established by order of the BOCC during construction. Per OF.S 810.180(8), a road authority may establish by ordinance or order a temporary designated speed for highways that is lower than the statutory speed. After completion of the project, the Road Department will conduct a speed study to determine the speed for the realigned portion of Deschutes Market Road. FISCAL IMPLICATIONS: The Road Department will install the necessary signs with their own crews RECOMMENDATION & ACTION REQUESTED: The Road Department recommends signature of Order No. 2009 -010 ATTENDANCE: George Kolb, County Engineer DISTRIBUTION OF DOCUMENTS: Copy to Wanda Kuntz (ext. 7103) at the Road Department REVIEWED LEGAL COUNSEL For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Setting a Construction Speed Limit of 30 mph on Deschutes Market Road from Milepost 0.32 to Milepost 0.65 located within Deschutes County, Oregon * * * ORDER NO. 2009 -010 WHEREAS, commencing on January 5, 2009, Deschutes County started road construction on Deschutes Market Road between Milepost 0.32 to Milepost 0.65; and WHEREAS, the statutorily designated speed for the subject section of Deschutes Market Road is 55 miles per hour; and WHEREAS, the Deschutes County Road Department, pursuant to the provisions of ORS 810.180(8), has determined that the construction project constitutes a hazard to the public traveling over Deschutes Market Road and a hazard to workers working on the construction project; and WHEREAS, based upon said engineering determination of danger to the public and to workers on the construction project, the County Engineer has found that a reduced temporary designated speed of 30 miles per hour for the subject section of Deschutes Market Road during the time of the construction project is necessary to protect the safety of the pubic and workers; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HERE 3Y ORDERS as follows: Section 1.
