Luke and Alan Unger; Commissioner Tammy Baney was out of the office. Also present were Dave Kanner, County Administrator; Tom Blust and George Kolb, Road Department; Tom Anderson, George Read, Barbara Rich and Dan Haldeman, Community Development; Hillary Borrud of The Bulletin and a representative of KOHD TV, and two other citizens. Vice Chair Luke opened the meeting at 10:00 a.m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was Consideration of Vice Chair Signature of a Notice of Intent to Award Letter regarding the Overlay of Several Redmond Area Roads. George Kolb gave an overview of the item. Commissioner Luke asked why there is a big spread in the estimates. Mr. Kolb stated that he never thought he'd see this kind of difference in asphalt costs. LUKE: Move approval. UNGER: Second. Before the Board was Consideration of Approval of Accounts Payable Vouchers for the 9 -1 -1 County Service District in the Amount of $5,880.09. LUKE: Move approval, subject to review. UNGER: Second. RECONVENED AS THE DESCHUTES COUNTY BOARD OF COMMISSIONERS 8. Before the Board was Consideration of Approval of Accounts Payable Vouchers for Deschutes County in the Amount of $1,625,800.33. LUKE: Move approval, subject to review. UNGER: Second. VOTE: UNGER: Yes. LUKE: Vice Chair votes yes. 9. Before the Board was an Addition to the Agenda. Before the Board was Consideration of Vice Chair Signature of Document No. 2009 -138, an Application to the Oregon Department of Environmental Quality's Clean Water State Revolving Fund Program regarding Financial Assistance for Onsite Wastewater Treatment System Upgrades. Barbara Rich said that the Board directed staff previously to proceed. Since that time the DEQ set a deadline for application for this to March 16. They also issued the terms of the fund for the stimulus money, some of which that can be used for infrastructure purposes. DEQ said this amount would be $5 million. It will be 25% loan and 75% forgiveness. Commissioner Luke stated that stimulus money seems to have strings; he is concerned about requirements and who the funds can go to. Ms. Rich said that this would apply for low - income homes for maintenance of systems and long- term monitoring to determine the quality of water downstream. The original part does not have to be reimbursed. The DEQ has done a good job about trying to get this funding out quickly and into the localities where it is needed. Commissioner Luke asked if the Sunriver sewer district expansion would fit into this. Ms. Rich stated that the DEQ determined that studies did not qualify. Minutes of Board of Commissioners' Business Meeting Wednesday, March 11, 2009 Page 3 of 5 Pages Commissioner Unger said that $62,500 a year would need to be paid back. With the grant they would be able to do over 600 more systems, to help to address the high nitrate challenges with different systems. He feels this helps to continue to solve problems in South County. Commissioner Luke stated that there is little incentive for people to put in the new systems. Ms. Rich said that if there is a drain field failure or a new system, the improved system is required. She recommended that part of the initial disbursement be set aside in a reserve fund to cover payments for the first few years. After that time, there will be loan repayments coming in. Dave Kanner said that the repayment will have to be reflected in the Community Development budget in the future, under the groundwater protection fund. Mr. Unger asked if Neighborlmpact is handling the oversight of the project. Ms. Rich said yes, but that the County also runs the PRC program separately. LUKE: Move approval. UNGER: Second. VOTE: UNGER: Yes. LUKE: Vice Chair votes yes. Commissioner Luke said that it is naive to think that because the Local Rule failed at the ballot, that the underlying problem has gone away. Eventually the groundwater pollution will have to be addressed and it might be by the State or even the Federal government at that time. The failure of Local Rule takes away one of the options local citizens would have had to address the issue. He thanked Community Development for its ongoing work on handling this situation. This has significantly tied the hands of the local government and citizens, who will find it harder to get funding to address this problem. Barbara Rich thanked the Board for its hard work on this issue.
