Resolution No. 2009 -028 authorizing participation in the 2009 -11 Oregon Community Dispute
Resolution Grant Fund Program.

BACKGROUND AND POLICY IMPLICATIONS:
Every two years, the Oregon Office for Community Dispute Resolution (OOCDR) makes funding
available to eligible applicants through a publicly advertised application process coordinated by
counties in partnership with OOCDR. To qualify for the program, each county must adopt a resolution
stating its intent to participate and to engage in a selection process to award grant funds. Consistert
with OOCDR guidelines, Deschutes, Jefferson, and Crook Counties must adopt a joint resolution
indicating intent to participate or opt out of the program allowing the Dean of the University of Oregon
School of Law to assume the county role. Although Crook County's participation was solicited, it has
decided to opt out of the program this biennium. As a result, the resolution reflects Deschutes County
and Jefferson County only as participants. Following adoption of the resolution, both counties will
advertise the application process and select a grantee to perform mediation services within their
boundaries. Additional information about the OOCDR program can be found in the attached letter
from the OOCDR.
FISCAL IMPLICATIONS:
None. The OOCDR will enter into a grant agreement and disburse funds directly to the selected
grantee.
RECOMMENDATION & ACTION REQUESTED:
Adopt Resolution No. 2009 -028 authorizing participation in the 2009 -11 Oregon Community Dispute
Resolution Grant Fund Program.

Dear Mr. Inbody,
This is an invitation for your County to participate in the selection process for the
2009 -2011 Community Dispute Resolution Program (CDRP) Grant Funds
pursuant to ORS 36.160.
Assuming funding for 2009 -2011 is reauthorized by the 2009 Legislature at the
same level as the prior biennium, grant funds for your County will be
approximately $38,338 for the period July 1, 2009 - June 30, 2011. The funding
for these grants is derived from an appropriation from the general fund for "the
purpose of providing dispute resolution services in counties" and will be allocated
per the attached Administrative Rules.
Enclosed is a packet of all of the materials necessary to proceed with the grant
process.
The first step in the local selection process is the County's adoption of a
resolution to participate. ORS 36.160 requires that a County notify the Oregon
Office for Community Dispute Resolution (OOCDR) of its intent to .participate in
the selection process to award grant funds. A sample county resolution is
provided in the enclosed county information packet. Upon your County's adoption
of the resolution, please send a copy to the OOCDR. Following is the timeline for
the 2009 -2011 grant process:
By March 27, 2009 County Commission adopts a resolution of desire to
participate in the process.
April 3, 2009
Legal ad published by the County to announce the
application process (sample included). The County and

May 22, 2009 OOCDR issues notices of eligibility to applicants and
County.
May 29, 2009 Any appeals from applicants determined ineligible by the
OOCDR must be received by 5:00 pm.
June 12, 2009 County Commission selects grantee(s) and notifies
OOCDR of selection.
June 30, 2009 OOCDR enters into Grant Agreement with the grantee(s).
According to the Administrative Rules, each County Commission needs to
designate a County dispute resolution program coordinator. OOCDR staff
provides technical assistance and advice to this County staff person to make
sure the process runs as smoothly as possible. If you have received this letter
and are not the County's dispute resolution program coordinator, please forward
these materials to the proper person.
The OOCDR encourages collaboration in all phases of the grantee selection
process. In some Counties there will be only one interested and qualified
applicant. However, if your County receives applications from more than one
qualified applicant, we encourage you to have conversations with all applicants to
determine whether there are ways for them to work together to best provide
dispute resolution services in your County.
You may elect to opt out of the selection process if you desire. In that
case, the Dean of the University of Oregon School of Law will assume the
county's role in the process: If this is your choice, please provide me with
a written notice to opt out by March 20, 2009. Feel free to contact me at 541-

RESOLUTION NO. 2009-028
WHEREAS, the Deschutes County Board of Commissioners and the Jefferson County Boar 1
of Commissioners believe that the settlement of disputes by mediation may lead to more long - lasting
and mutually satisfactory agreements; and
WHEREAS, mediation may reduce the need for time - consuming and costly litigation; and
WHEREAS, the Oregon Legislature has charged the State of Oregon acting by and through tl.e
State Board of Higher Education on behalf of the University of Oregon for the University of Oregc,n
School of Law (Grantor) with the responsibility to foster the development of community mediation
programs by making grant monies available to participating counties; and
WHEREAS, any county wishing to participate must formally notify the Grantor of its
intentions; now therefore,
IT IS HEREBY RESOLVED THAT, Deschutes and Jefferson Counties hereby notify the
Grantor of their desire to be participants in the expenditure of funds for community dispute resolution
programs within Deschutes and Jefferson Counties, and Deschutes and Jefferson Counties agree to
engage in a selection process and to select as funding recipients those entities both qualified by t'ie
standards and guidelines adopted by the Grantor and capable of and willing to provide community
dispute resolution services according to the rules adopted by the Grantor.
