MINUTES OF BUSINESS MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, JUNE 10, 2009
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Tammy Baney and Alan Unger; Commissioner
Dennis R. Luke was out of the office. Also present were Dave Kanner, County
Administrator; Erik Kropp, Deputy County Administrator; Ken Hales,
Corrections; Judith Ure, Administration; Shannon Danes, Health Department;
Marty Wynne, Jeanine Faria and Christina Edelston, Finance; Mark Pilliod and
Laurie Craghead, Legal Counsel; Bob Haas, Information Technology; Timm
Schimke, Solid Waste Department; Tom Blust, Road Department; Tom Anderson
and Nick Lelack, Community Development; several other County employees, and
about twenty other citizens.
Chair Baney opened the meeting at 10:00 a.m.
1. Before the Board was Citizen Input.
Commissioner Baney said that Home Rule Charter hearing was originally going
to be held today but had to be postponed. Some people who did not get the
update asked to speak.
Laura Harvey of Three Rivers area outside of Sunriver said that she supports
the formation of the Home Rule. She read from an article in the Bulletin, and
asked Dave Kanner if he said what they indicated he did. She said he should be
removed if he made those comments.
Commissioner Baney said that the Board does want to hold a hearing, but
believes the rest of what the Bulletin wrote is incorrect.
Ms. Harvey stated that South County wants to have more representation and
thinks that having a Home Rule Charter would serve them better.

Commissioner Baney said that Ed Criss is now on the Planning Commission
and previously Bob Otteni was on the Planning Commission for a long time;
both are from La Pine.
Ted Scholer, a resident of the La Pine area, said that he served on the Home
Rule Charter Committee the last time and felt the group did a lot of good work.
Some additional work would help to get it passed this time. He feels there is a
lot of support for this in South County.
He asked if Commissioner Unger is the liaison with South County. They would
like to have their own Commissioner representing the area.
Ruth Gates stated that she would like to gather information about Home Rule
and feels the community needs more education on this. She wondered about
where people would need to live to be on the Committee.
She said that her friends, the Browns, warrant protection from the State so they
can practice religious activities on their property in Tumalo. She also made
comments about the Tumalo School and the Fire District.
Commissioner Baney stated that there are a lot of aspects related to Home Rule
Charter, and some people might want different things out of it.
No further input was offered.
Commissioner Baney recognized Steve Griffin of the County, who assisted a
woman and others who were threatened by a hostile man some time ago while
in Safeway. Mr. Griffin said he and his wife were at the store to rent a movie
and heard a woman who had been stabbed screaming. Mr. Griffin and his wife
and others assisted the woman and followed the man, who went to his vehicle
and got a shotgun, at which time law enforcement arrived.
At this time the Commissioners recognized members of the Oregon Youth
Authority. The Cadets gave their names and reasons why they feel the program
is successful, and what they learned about and enjoyed most. He said that 156
youth signed up and 124 will graduate. The cadets indicated that they are going
to continue their education, join the service, or becoming gainfully employed
otherwise.
2. Before the Board was Consideration of Selecting Central Oregon
Mediation, Inc. as Grantee to Receive Oregon Community Dispute
Resolution Funds.

Judith Ure gave an overview of the item. Each County receives a share of the
overall funds from the State. Central Oregon Mediation was the only qualified
respondent. The University of Oregon handles the contract and works with the
entity direct.
UNGER: Move approval.

3. Before the Board was Consideration of Approval and Chair Signature of
Document No. 2009 -234, an Intergovernmental Financial Agreement with
the Oregon Department of Human Services for the Financing of Local
Public Health Services for Fiscal Year 2009 -10.
Sherri Pinner of Health Services explained the item. Commissioner Baney
asked if the County Administrator will be able to approve the many
amendments that will follow. Mr. Kanner said that a separate action is needed
to have the Department Director sign to a certain level, and Mr. Kanner to sign
up to a certain level as well. Ms. Pinner stated that this should be on the June
24 agenda.

4. Before the Board was a Public Hearing on the Fiscal Year 2009 -10 Fee
Schedule for Deschutes County.
Chair Baney opened the hearing at this time.
Jeanine Faria and Chris Edelston gave an overview of the item. Their role is to
collect the data from the departments, so questions on the fees should be
answered by the department representatives.
Commissioner Baney asked about recent changes. Ms. Edelston said there was
a work session with the Board and a few changes were requested.

Tom Anderson explained that a minor correction needs to be made; it follows
CDEH 20, following tile dewatering. It indicates not to exceed $170; this
should be $210. The Commissioners indicated this change is already on the
revision they received.
Cameron Jett, local business owner of a pizza company, spoke about the fee
increase proposed for temporary event licensing. He thanked Commissioner
Baney for meeting with him and for the Commissioners' time today.
He is opposed to this increase, which is an onerous burden to his business and
family livelihood, as well as a problem for small farmers' markets and similar
events. Commissioner Unger said that there has been some problem solving
done on this and it is difficult, because it is Countywide and all providers have
to be considered. It is a State mandate forced upon the County to enforce.
Mr. Jett stated that he does not understand the whole situation. He views the
Community Development Department and Environmental Health as a partner,
with similar goals. He gave an overview of his business and products.
He said his company went from one cart to seven, and has recently been able to
open a restaurant. He has personally seen the economic benefits and value of
the farmers' markets and similar events. Small businesses drive the engine of
the economy. The fee increase is out of line with similar counties. In regard to
State law, temporary events have to been inspected every week. Other counties
are not doing this due to staffing problems. Farmers markets bring the highest
quality of food to the area, and the producers have a vested interest in what they
are selling. Substandard providers just don't make it.
It is important to understand that according to the Department of Agriculture,
there are no current food safety issues with farmers' markets and other small
venues. He understands that Community Development is struggling to comply
with the requirement. There are no current problems with food safety.
Inspecting every week is unnecessary for public health.
He compared the fee increase with others. Washington County receives
$164.50 per market per month, or about $4 per market day. In contrast,
Deschutes County would charge $320 per month, and the traffic by his booth is
much lower. It effectively prevents him from going to farmers' markets. At
$80 per week, it is too high. Sometimes they don't make that much. The profit
margin is about 5 -8% for companies like his. This would prevent him and
similar businesses from making any kind of profit at these events.

He also commented on the $125 fee if the ten -day window has not been met.
No other counties are doing this. Jefferson County is lowering its fees for
temporary or small events because they understand the benefit of these. He has
had to turn down a few events because of the fee increase or because he doesn't
have enough lead time to meet the ten -day requirement.
He also feels that the fee is discriminatory. If you can get more than six people
together for an event, the fee is waived; if not, you have to pay it. It does not
make sense.
The fee is out of line compared to other counties, and prohibitive to the growth
of farmers' markets and similar events. He is frustrated to not be able to do
what he needs to do to grow his business at small events. The small profit
margin and a 400% increase in the fee makes it impossible.
Commissioner Unger said that there has been discussion about the fees and
would like to have something more equitable. With State law, it has to be
handled properly. They want businesses to be successful and want food to be
safe as well.
