BACKGROUND AND POLICY IMPLICATIONS:
The attached petition was circulated for Deschutes County Board of Commissioners (BOCC) signa ures
as a result of written requests made by several property owners in April 2009 to annex county own( d
property to an existing no shooting district, and a work session held on June 17, 2009, wherein the
BOCC directed a public hearing be set to obtain citizen input before consideration of approval of tl e
proposed annexation.
FISCAL IMPLICATIONS:
None.
RECOMMENDATION & ACTION REQUESTED:
Accept the petition and set a public hearing date.

WHEREAS, a petition requesting annexation of certain territory to a restricted area pursuant to
Deschutes County Code section 9.08, referred to as the "Deschutes River Recreation Homesites, Unit
6, Parts I and II No Shooting District" has been duly filed with the County; and
WHEREAS, the Deschutes County Assessor has verified that the no shooting district petition to
annex was signed by no less than 100 percent of the owners of the contiguous lots included within t
restricted area; and
WHEREAS, a public hearing is required to consider the petition and notice of that hearing mist
be provided in accordance with ORS 198.857; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREI;Y
ORDERS as follows:
Section 1. That a hearing on the annexation petition be held on August 17, 2009, which petition
may be referred to as the Annexation to the "Deschutes River Recreation Homesites, Unit 6, Parts; I
and II No Shooting District." a copy of which petition is attached hereto as Exhibit "1" and by this
reference incorporated herein.
Section 2. That a notice in a form consistent with that set forth in Exhibit "2 ", attached hereto
and by this reference incorporated herein be provided in accordance with ORS 198.800(2).

PETITION TO ANNEX PROPERTY TO
Deschutes River Recreation Homesites, Unit 6, Parts I and II
No Shooting District
To: The Board of County Commissioners
Deschutes County, Oregon
The undersigned state as follows
1. This Petition for Annexation is filed pursuant to ORS 198.705 to 198.955.
2. This annexation Petition affects only Deschutes County and the Deschutes River
Recreation Homesites, Unit 6, Parts I and II No Shooting District.
3. The principal act for the Deschutes River Recreation Homesites, Unit 6, Parts 1 an II
No Shooting District is Deschutes County Code, Chapter 9.08.
4. The territory that is subject to this Petition for Annexation is primarily uninhabited The
attached signature sheet is signed by the land owners in the territory proposed to be annexed as indicated
opposite their respective signature.
5. It is requested that the proceedings be taken for the annexation of said ten-itory to
Deschutes River Recreation Homesites, Unit 6, Parts I and II No Shooting District, Deschutes County,
Oregon. A description of the boundaries of the territory to be annexed is attached hereto and marled
Exhibit "A." A map of the boundaries of the territory to be annexed is attached hereto and marked
Exhibit "B."
6. That said Petition has been signed by 100 percent of the land owners within the ter itory
proposed to be annexed.

NOTICE OF PUBLIC HEARING
BY THE BOARD OF COUNTY COMMISSIONERS
OF DESCHUTES COUNTY, OREGON
A public hearing regarding a proposed annexation of territory to the Deschutes River
Recreations Homesites, Unit 6, Parts I and II No Shooting District will be held on Monday,
August 17, 2009, at 10 a.m. in the Barnes and Sawyer rooms of the Deschutes Services
Building Hearing Room at 1300 NW Wall Street in Bend.
The boundaries of the proposed territory to be annexed are: Tax lot 2110030000700: That
portion of lot 2, Section 03, Township 21 South, Range 10 East, of the Willamette
Meridian, Deschutes County, Oregon, lying South of the Deschutes River; and Tax lot
2110030000800: That portion of the N1/2NE1/4SW1/4 and the SE1 /4NW1/4, Section 03,
Township 21 South, Range 10 East, of the Willamette Meridian, Deschutes County,
Oregon, Tying Northerly, Southerly and Easterly of the Deschutes River, being all that
portion, generally, on the east side of the river; and Tax lot 2110030001100: Beginning at
the Southeast corner of the NE1 /4 of the SW1 /4 of Section 03, Township 21 South, Range
10 East, of the Willamette Meridian, Deschutes County, Oregon, thence Westerly alorg
the South line of the NE1 /4 of the SW1 /4 to the Deschutes River; thence along sa d
Deschutes River in a northerly and Easterly direction to the East line of said NE1 /4 of the
SW1 /4; thence leaving said Deschutes River, Southerly along the said East line to the
point of beginning.
The purpose of the proposed annexation is to restrict the discharge of firearms for the
welfare and safety of the inhabitants surrounding the proposed area to be annexed. All
interested persons may appear and be heard.
